I live in Norway Maine on a private ROW. The town just approved a commercial site at the end on this 15foot drive with 3ft ditches on the side in some areas. They now are utilizing buses to transport people up the hill to the site. I am appealing the towns site ordinance as this private drive is not safe for public transportation. The ordinance reads All streets public or private shall conform to or surpass the town road standards. The town does not a a road ordinance but the MDOT has guidelines for towns to follow. Can anyone HELP!!! My deadline is August 31st for appeal

You have a ROW over this property.

Who owns the land?
How is your ROW actually described in your deed?

This additional use could "overburden" the ROW. That is the magic word.

How did the town obtain permission from the landowner to construct ditches on land the town does not own?

I built the first house twenty years ago. Now there are eight beyond me and at the top of the hill they built an estate and now wedding barn to hos weddings and events. All the eight houses below are now overburdened with traffic and noise fro cars late at night. The right of way wa slowly develop by these small houses over the years and is only 15ft wide, My stance for the appeal is that it can not accommodate two way traffic an is not safe for large limousines and buses as we have developed ditches for the run off from the top of the hill.

theirs no association?? who plows in the winter??

their may be more concern for emergency vehicles
what if a house fire?? someone is having a heart attack?

If this is a major problem for you I'd suggest a good real estate attorney. Mr. Dana Hanley would be my choice.
I used him 10 years ago regarding litigation involving old family land and won-yippee!
