I called SM rent control--they have no record of the unit, but the woman there said if it was built after 1979 and has all the proper permits, it could still be legal.

If the utilities are charged to the unit it should be legal. If you have to split the bill with the owner or other unit it is likely illegal.

The unit was utilities all included. Guesthouse on their property. How can I get definitive proof to bring to small claims court?

His basis is that he wants to liver there for free - he wants to rip off somebody. He is a 'victim' of circumstances of his own decisions.

I had a similar issue years ago. Was renting the lower half of a duplex, the owner's kid was occupying the unit above me, was loud at all hours of the day, called a real estate attorney to see if I could find a way to break my lease due to the constant nuisance, and the attorney told me that the unit I was leasing wasn't legal. The owner had basically converted their basement/storage area to a second "unit" and was trying to pass it off as it's own separate dwelling. I took the LL to small claims court, the judge threw the case out on the basis that I had no claim against LL, and instructed the LL that they could not lease it out again unless proper permits were pulled and the unit was signed off on by the proper city department.

So, if you are trying to use the "my unit wasn't permitted properly, I want my past rent back", trust me, it will not work.
