Just thought I'd share what I just found out talking to a few architects about my plans for a full dormer. The Town of Oyster Bay JUST passed a new revision to the zoning regulations. Now the TOB is going to include basements in your square footage, however they did not increase the limit on the maximum allowed square footage. The two architects that frequently work in the TOB were basically telling me that now a lot of people are going to have to get a variance if they want to do a full dormer on their home in the TOB.
Oyster bay is a bunch of crooks. If that is true it’s just a way to extract more permit fees and collect more township taxes.
Unfortunately, it is true. I spoke to two architects yesterday and they both told me the same thing. And they're both very frustrated about it. It came without warning.
Another way to extort tribute to the zoning board, lawyers, map makers, etc in order to complete a project that is already permitted by the state building codes.

Hasn’t changed. For a 7,000 square foot lot in the R1-7 section, 3,200 square feet. You now need a variance for a full dormer in most cases. One of the architects I spoke with yesterday said he thinks due to this, it may be a bit easier to get a variance for this now if this new change is what puts you over the limit, especially if you have neighbors that have this done without issue, which I do. Just makes the process even more annoying.
Doesn’t matter. If it’s 7’ or more from the slab to the bottom of the joist, it now counts. Which is basically all basements.
