Hey everyone I'm new to the forum and I've got a question that maybe you guys can help me with. A couple of weeks ago my wife got pulled over in Henderson because her registration got suspended. We actually had no idea that the suspension happened until the officer told us. Anyway, she was given a ticket and her plate were taken. So I called my insurance company (Progressive) and they said that they mailed me a letter regarding a lapse in coverage that was reported by the DMV. We actually didn't get the letter until a couple of days after getting pulled over, so that wasn't a big help. I called the DMV and they said that my wife wasn't insured from 2006 to 2008. I told them that that was impossible and that I had proof that she was. Besides, if she wasn't insured then she wouldn't have been able to register her car last year. What happened was that in March of 2008 I got a new policy number from Progressive and that information was sent to the DMV. For whatever reason the DMV either didn't see or lost my old Progressive policy number. So I was able to get that all squared away and now DMV has proof that my wife was insured from 2006 to now. Because it was an insurance related ticket we have to settle this thing in court. If I have proof of continuous coverage from the DMV and my insurance company when am I suppose to show that in court? Neither my wife or I have ever been to court over anything so this is pretty new to us. Also, how likely is it that the judge will dismiss the ticket. Thanks in advance for your help.

Cops dont take plates. If you are not registered they can and will take your whole car. The only reason a registration can get suspended is if your insurance lapses which sounds like what happened. In Nevada and probably some other states if your insurance lapses, they contact the DMV.

Even if you can prove to the Judge that your insurance never lapsed I doubt you will win any favorable leniency. The courts are there to take your money, not find loop holes to let you off of a fine.

I wish you luck in court. I hope your boss gives you some sick time because you will spend the entire day in court. Sometimes if the schedule is full your docket number will spill onto the next day. More waiting.

Most of us here show up and tell the clown at the window that we are prepared to fight the ticket. It is standard practice here for them to just offer for you to pay half the ticket extortion rate and you are clean and free to go. In most cases it is worth it. You will not feel much better but after weighing your valuble time VS wasting it in a Mickey Mouse Court that you are very unlikely to win............you choose.

In NV, it is incumbent on your insurance company to update the DMV that you have insurance. If for whatever reason the DMV isn't notified (ins. co fault DMV fault whatever), DMV automatically suspends your registration. If that is the case, get something from the DMV showing the reason for your suspension and coverage info from your ins. co. Bring all of that to your court summons date.
