I was recently fired from my job for something that I did not do wrong. I was in the process of fighting for my job back when it came down to my word against a supervisor who "didn't recall the exact events that occurred" my employer told me that if I stopped fighting their decision and accepted my termination they wouldn't show up for my unemployment appeal. My unemployment appeal has yet to be scheduled but has been filed. If my ex-employer keeps their word and does not show up for the appeal to contest my termination will I win my case?

Maybe. The Appeals Ref has to decide if the Adjudicator made the right decision, and the Adjudicator has already interviewed your employer who obviously said you are guilty of misconduct of some kind. It would be your job to show proof that the employer gave false information, or that there were other extenuating circumstances in your favor. No emotional stuff, just FACTS showing that you were not guilty of misconduct.

Do you work under a Union? Those are helpful, but if not, I really don't know...It's all up to the hearing process. After that, the adjudicator, I believe....

All I can say is good luck, because Ive been out of work for 2 months and NOBODY is hiring!


PS - If you got fired over "politics" (ie they exploit any mistakes you make as a reason to "thin the herd"), it's going to be more difficult to prove...I hope your last employer isn't corrupt.

Thank you for the advice please keep me in your thoughts as my appeal will be held soon. I don't really have any proof since it's my word against my employers word. The only proof my employer showed was my signature from their handbook since they say I broke a minor rule that they used as an exuse to fire me. Hopefully my testimony and their lack of showing up to fight the appeal will help my case. Thank you again and Happy Holidays.
