I think Obama knew the problems this was going to create for states and washed his hands of it.
He said it would be up to states to determine. And this just gives him fodder to push blanket amnesty even more.
So now Michigan will issue the driver's licenses...
From the article:
"The feds now say they consider these young people to be lawfully present while they participate in the ... program, so we are required to issue driver's licenses and identification cards," Johnson said in a statement. "I will continue to follow the law."
"She had come under pressure from civil liberties and immigrants' rights groups who said many other states were issuing licenses. A coalition filed a federal lawsuit in December asking a judge to declare that those in the Deferred Action for Childhood Arrivals program were eligible for licenses."
Wrong! They are not lawfully present and I'd sure like a link to where the fes said so. They have only been granted a stay of deportation. If you read the last paragraph you can see how she was pressured by so-called "immigrant's" right's groups. She had every right to continue to not grant them licenses because they are not lawfully present in our country.
Because when the deferred deportation was first issued it gave no claim to being here legally..it just deferred deportation for 2 years and allowed them to get work permits.
The WH has since come out and said now that these people do have legal standing and that changes things.
I think states will have no recourse but to issue DL's to them now.
While they may not be legal permanent residents they are legal deferred residents.
While they may not be legal permanent residents they are legal deferred residents.
What CIS states is
Quote:
The Department of Homeland Security published updated guidelines for the Obama Administration’s Deferred Action for Childhood Arrivals (DACA) program that say illegal aliens who receive deferred action are “lawfully present” in the United States but do not have “lawful status.” The new statement is meant to influence the debate over whether such illegal aliens can access driver’s licenses or benefits such as in-state tuition under state laws that require legal presence.....The updated guidelines say “An individual who has received deferred action is authorized by the Department of Homeland Security (DHS) to be present in the United States, and is therefore considered by DHS to be lawfully present during the period deferred action is in effect. However, deferred action does not confer lawful status upon an individual, nor does it excuse any previous or subsequent periods of unlawful presence.”
They are not and can not be considered legal deferred residents. They hold NO legal status, they are only lawfully present. Being lawfully present isn't enough to be allowed to obtain a DL in most states.
