Not technically so.
If a first time illegal comes, that's a civil offense. Not a crime.
Now, if the illegal actually jumped the border illegally, then that is a criminal offense, but that doesn't matter since it's very difficult to prosecute unless an illegal is caught red handed.

Things like using fake IDs (common for illegals getting work) are criminal offenses too.
