Ok ... I know that this is a topic that is confusing and on a lot of military members minds that are in this situation, because it is on mine. I am recently divorced (29Feb2012) and the divorce was due to my ex cheating on me with at least 3-4 other men while I was deployed and come to find out (recently) she got pregnant by one of them before the divorce was even finalized. I did the math and she got pregnant the week of Christmas 2011 (which was when I just got my kids for the holiday). Also we were married for 13 years 11 months before the divorce was finalized. In the final divorce decree my military retirement was not put in to be divided. I was told by my lawyer that since there was no guarantee I would retire from the military that it doesn’t need to be there. I have read that if it’s not in the divorce decree she don’t get it; I have also heard that since she cheated she don’t get it; but I also heard that no matter what she still gets her share of the retirement because we was married over 10 years. I don’t think anyone really understands the rules on military retirement for divorcies. If you do understand the rules would you please tell me so that I will understand and please list references (if it’s not in black and white somewhere, I have to believe that it is only a opinion) so that I can have them for future reference.
