NEW YORK, Dec. 13 (UPI) -- A New York teacher's lawsuit claims he was given "unruly" students purposefully to aggravate his heart condition and urge him toward retirement.

Monte Kuhr, 46, said in his lawsuit against the city administrators at A. Philip Randolph High School, including Principal Henry Rubio, dismissed a suggestion from his physician that he stick to teaching the senior classes, which are "the source of fewer student behavioral problems," the New York Daily News reported Monday.

I think it would be pretty cool if all teachers sued for unruly classes. Maybe then we could get the "unruly" element out. Money talks.

Since when does a doctor get to decide that a teacher should only teach seniors. Really, you have to be prepared to teach all levels if you teach high school. Are freshman significantly more *unruly* than seniors? Sure. Does that mean that everyone gets to choose to only teach seniors? Nope.

This is a frivolous lawsuit as so many are today.

That's a new spin on things; I wonder if I could get a lawsuit going against parents who don't engage in their child's learning. Maybe everytime a student gets ISS, or OSS their parents should haveto adequately explain the student's behavior or pay the district reparations for time lost while disciplining their child. Hmmmmm, I like it.

Good for him! More teachers need to stand up for their rights (what rights they have left this is).

Teachers do NOT have the right to choose which kids they teach though unless they are tutoring.

In industry, you do not get to choose which projects you work on either, those are assigned to you by your boss unless you own the business.

But, in industry, you get the same parts to make the same product. In education, you're expected to have the same product but get perfect parts, broken parts, dysfunctional parts, etc. You cannot compare the mind of a child to producing an industrial product. That's just stupid.

I was NOT comparing the mind of a child to a product. I was comparing the choice you get in the job.

Your boss determines what you are to do in both schools and industry. You can't reject some kids and teach only the honors students, for example, unless your boss gives you those classes.
