Hello Friends-

We are building a home in Flower mound, TX in Canyon Falls community, we opted for a corner lot( approx 7700 SQFT LOT) and during the pre construction meeting they gave the information that they will have to leave out 20 feet from the side walk to our home, which is like practically having no side yard what so ever . Then, we reported that none of the homes built on corner lots in the Canyon falls community have such fence layout.

The builder took almost a month to get back to us saying that extending the fence in the backyard will block the driveway of the home to be built behind our lot which is something we understood as it's a safety issue.

My concern here is if they have told about this prior to signing the contract, we would have opted for a different lot and we paid lot premium as well .

Can someone please let us know how I could negotiate with the builder to cancel out the lot premium as we are not getting what we were promised in terms of square footage of the backyard and side yard. And just wanted to understand if this issue could be considered as a potential reason to contend with the builders to void the contract.

I guess I am a little confused. You paid a lot premium and the fact that you can't erect a fence is causing you to have a small enough yard that the lot premium has no benefit? What does the contract, covenants, etc say about fencing? Maybe you are just trying to get along, but if they don't say anything then you can do whatever you want on your land.
