I thought I'd ask some opinions on the following scenario, as I'm thinking of taking my ex-landlord to court for deducting from my security deposit without giving me any advance notice she was doing so:

Basically, we held a walk-through of the apartment on the day I moved out and she mentioned 2 items that she would be deducting for. She said she would send me a check for the balance. I expected the deductions to amount to under $100 (she was going to cover up some nail holes and repair some paint chipping near a ledge). About 3-4 weeks later I receive a check with a letter and she deducted nearly $700 for numerous cleanings, painting (like 4-5 hours to repaint the entire apartment), and a host of other random things we NEVER discussed during the walk-through.

My question is, do I have a small claims case since we had an in-person walk-through where we agreed upon the condition of the apartment, but then she went and charged me for things without telling me? For ex, if she had mentioned that she was going to get a cleaning service, I would have made sure I went through and re-cleaned the apartment to her standards. I have tried resolving this with her, but she is ignoring me, so I am thinking of going to small claims.

It does sound like she did almost everything correctly.

Would it be worth your time and additional expense to take her to small claims court?
