First, you have to file a claim with Mecklenburg county. The forms/instructions should be on NCcourts.org. Then, you have to go to court. The judge usually gives the resident 10 more days to pay the rent. Assuming that they don't pay, then, you have to file another set of paperwork. Again, another 10 days. Finally, you can file the set that allows you to sell all of their stuff (this rarely happens).
If you go to the General forums, there is one for Renting, with a lot of threads on various aspects of this question and a lot of knowledgeable people on there who might be able to give you some pointers as well. Good luck, I had to go through this with my parents house years ago and it wasn't easy!
1. Go to the county sheriff's office any arrange an eviction notice (a fee is required).
2. The eviction notice will be served and the tennant will be given a period of time to either pay rent or vacate. This is basically a period of time where they can live in your unit without paying a penny.
3. If he/she decides to vacate, your option is to take him/her to small claims court, First, you will meet an arbitrator that will attempt to come up with an agreement that may sound good, but will not work out and you will probably lose your money. I would imagine that your tennants are waiting for the stimulus package to take care of them.
4. Chances are you will lose your money.
5. Hope the renters didn't trash the place too bad.
The law is usually on the side of the criminal. They will likely get by without paying a penny. I used to be a property owner in Florida and rented five units that I owned. Being a landlord is a nightmare.
How many days does the tennant have to be pass due on the rent before you can have them evicted in North carolina?
