I received a Summons from Home Owner Ass.'s attorney. They sueing us for not paying home association fees ( this property is sole in forclosure sale- I'm no longer own it) This property is located in Madera County.

They sueing us for $3,335.00, this included late fees, attorney's fee and lien fees... I actually owe them $1,200.

I lost my home because my husband lost his job. Now,I lost every thing: home and my credit. Plus, I don't have money to pay them. What happen if I don't pay them this amount? Can some body give me advise, please? Thank you.

We have about 10 homes here in foreclosure. My wife is on the HOA board. To receive and past due HOA fees they are in a long line of others who you owe. They have to basically sue to be in front of the line to be repaid.

So, basically you go in front of the judge. He will place a judgement on you. If the bank sells the house for more than owed the HOA may get paid. If not you may have to pay payments or a collection on future funds.

I would talk to a attorney to see your part in the process.

What we noticed with the owners here is the house is the last of their past due payments. Usually credit cards, utilities, HOA dues, car payments, furniture payments usually do not get paid first. So buying a home in foreclosure is not quite the great deal when you pay off the other debts to own the house.
