Bills would reduce illegal-immigrant car seizures - Total Buzz - The Orange County Register

The state Senate Public Safety Committee is expected today to consider two bills, AB1389 and AB353, that would make it more difficult for law enforcement officials at sobriety checkpoints to seize the cars of unlicensed drivers.

The section that makes it more difficult to seize cars codifies the court decision of Miranda v. City of Cornelius (United States Court of Appeals, Ninth Circuit, 2005), which essentially found that police may not impound the vehicle if it can be safely parked or driven away by a licensed driver (with exception for public safety - e.g. it is allowed to tow a car that blocks a fire hydrant).

It is still illegal to drive without a valid license, it is a misdemeanor under California Vehicle Code 12500 punishable by up to 6 months in prison. In practice, though, the first violation would be punished by a fine on the order of $500.

But the law about unlicensed drivers says that when discovered their car will be impounded for 30 days.

I do recall some news story recently about a politician wanting to pass a law that the illegal aliens would be immune from several laws, including the 30-day-impound law. Doesn't much pay to be legal.

Since none of you white guys will take a job from an illegal, they need to drive to put vegies on your plate, sounds reasonable.

Like I said, that law was found unconstitutional in 2005. Sacramento is just slow to catch up.

I had a certain tongue in cheek there, but, hey, that is what non insured motorists coverage is for.

But, then again, seriously, a big chunk of the economy of California is dependent on unlicensed uninsured motorists to keep going... Whose idea was that?

Well, certainly not the Democrats, pretty tough to find a Democrat vegetable or fruit grower in this state.
