The reason I ask is I was looking at some vehicles for sale locally, one was a BMW 540I....a quick search showed it gets quite poor gas mileage but somehow I doubt the 'Holier than Thou' types put it in the saem category as Suburbans and such.....
Holier than thou types aside, trucks and SUV's are catagorized as trucks and therefore are exempt from fuel mileage restrictions such as this. google "gas guzzler" or "gas guzzler tax" and you should be able to read it down to the letter of the law.

I would but the difference is this- the BMW as well as other "cars" like the Corvette and Viper have to pay a tax for poor gas mileage while "suvs" are not penalized the same way. The standards should apply to ALL non commercial vehicles.
My general definition is that if it doesn't at least average 20mpg it's a gas guzzler. So if your B'mer is getting less than that it's not much better than most SUV's.

Hmmmm, quite an interesting group of 'gas guzzlers'....
If I were you, I'd buy what I like and not worry about what other people think. That's a nice car, if properly maintained. I say see how you like it.
