Man I hope this penalty is over turned, seriously what are teams supposed to do tear down every engine before they put it in the car? This is one of reasons why we only have 43 45 cars running, fewer fans watching and going to races. why would I want to start a team if I know NASCAR can fine me out of existence for something I have absolutely no control over. Gibbs did not build this engine they had nothing to do with it. Nascar has gone off the deep end and must stop this nonsense before it's to late because as a fan I'm getting tired of it and very close to not watching anymore.
Gibbs does indeed build their own engines as HMS, RCR, & Roush also buid their own engines. These aren't crate motors.

JGR only builds Nationwide and Truck series motors now and has no influence with the cup motors what so ever. They do indeed show up in a crate and come from TRD in California.

The engines for the Cup cars are built and crated by TRD. That particular engine could have ended up at Waltrip racing just as easily as it did at JGR.
My feeling is that the penalty will remain after the appeal, but will be cut in half. So Matt would only lose 25 points, fine would drop to $100k and suspensions for Crew Chief and Joe Gibbs would be only 3 races.

I think the fines and the winning of an appeal depends upon who the arbitrator happens to be.
If the arbitrator for Penske happens to be a former Ford executive I can see the fines being lessened.
If the arbitrator for Gibbs happen to be a former Toyoda executive I can see the fines being lessened.
However if the arbitrator happens to be a GM executive like it was for Hendrick last year.

Penske penalty confrimed for unauthroized rearend parts used but one more appeal left. Penske said the hearing was fair they just loss the appeal and will appeal again. to second allowed.Heard commentator say he looked at what aprts weher used not approved and its specfically i rule book as violation.
