The US has a long history regarding water rights and law suits over them. Wyoming where I grew up has many rivers that begin in the state, and even though most of the state is high plains desert the water rights laws have prevented them from building dams and claiming the water that rains on their state as being their own. States downhill from Wyoming have "legal" claims on the use of some of that water.

You can own land there with a river running across it, yet have no rights to use the water in that river on your land. Same is true in Texas I believe.

What rain falls on your land is yours, but that is not so of the rivers flowing across it.
