    Observation: Water from the handwashing sink was measured at a temperature less than 100°F. (95F)
    Correction: A handwashing sink shall be equipped to provide water at a temperature of at least 100°F through a mixing valve or combination faucet.

  • Duties / Monitor Sanitizing Practices and Procedures (corrected on site)
    Observation: Employees are not properly sanitizing cleaned multiuse equipment and utensils. Observed sanitizer mixed with soap.
    Correction: The Person in Charge or certified food manager shall train his/her employees to properly sanitize all equipment, utensils, and surfaces after being cleaned using either an approved sanitizer at the adequate concentration or heat sanitization at the proper temperature to destroy pathogenic bacteria. Sanitizer-soap mix was discarded. EHS provided training for wash, rinse, and sanitize.
  • Thawing / Approved Methods (corrected on site)
    Observation: Observed the following food thawing using an improper method: beef tongue in standing water.
    Correction: Potentially hazardous foods (time/temperature control for safety food) shall be thawed using one of the following methods: 1) under refrigeration that maintains the food temperature at 41°F or less, 2) completely submerged under running water at a water temperature of 70°F or below with a sufficient velocity to agitate and float off loose particles of food as long as held for period of time at a temperature of 41°F or less, or 3) as part of a cooking process if the food is cooked as specified by Law or thawed in a microwave oven and immediately transferred to a conventional cooking process. Beef tongue was moved to cooler to finish thawing.

    Observation: There is no test kit located in the facility for monitoring the concentration of the chemical sanitizing solutions.
    Correction: Obtain a bleach test kit.
  • Critical: Chlorine Sanitizer Solution Concentration based on pH and Water Temp (corrected on site)
    Observation: No sanitizer available in restaurant at beginning of inspection. Staff provided bleach from store and prepared solution for EHS at 100 PPM.
    Correction: A chlorine-based sanitizing solution shall have a minimum concentration of at least 50 to100 ppm total chlorine when tested using the appropriate test kit.

REMINDERS:
**Monitor cooling methods and temperatures.
**When reheating in microwave, stir the food every 2 minutes and check temperature before putting food on steam table.
**Datemarking should be followed and monitored.
**Focus on CRITICAL and REPEAT violations to avoid future enforcement actions. Some violations may require TRAINING and MONITORING of employees to ensure that they remain corrected.
Furthermore, it was noted that both cold holding and cross contamination violations were cited, this is now the third time these have been cited, these were observed on inspection on previous inspections. If these violations are observed again, you will be subject to further enforcement action.

  • Critical: Food Protection from Contamination / Separate Raw from RTE (corrected on site) (repeated violation)
    Observation: Raw animal food stored over ready-to-eat food in the refrigeration unit. Observed raw broken eggs in 3-4 containers stored above cut vegetables and raw chicken stored above tamale--True 2dR upright left and right
    Correction: Raw foods like poultry, beef, pork, seafood, and eggs shall be stored properly inside refrigerators and freezers to prevent cross contamination. Raw foods shall be stored on shelving units BELOW or SEPARATED from all cooked foods, commercially processed foods, washed produce, leftover foods, etc.

    Observation: Unwrapped or uncovered food in the following location where the food is subject to contamination: Uncovered ham in 3DR prep refrigerator
    Correction: Foods shall be protected from contamination by being stored in packages, covered containers or wrappings unless being cooled.

    Observation: Food stored in a wet or soiled location as follows: Observed big round pans of dough and raw beef sitting on trash cans.
    Correction: Food shall be protected from contamination by storing the food in a clean, dry location.
  • Cooling Methods (corrected on site)
    Observation: The following methods used for cooling were not adequate to facilitate proper cooling: Observed cooked pork indeep metal pan covered with lid on shelf under stove. Observed heaped cooked beans in deep lastic container in 2DR upright refrigerator.
    Correction: Cooling hot foods shall be accomplished as follows: 1) placing the food in shallow pans
  • Critical: Hot Holding of Potentially Hazardous Foods at 135°F or More (corrected on site)
    Observation: The following food items were observed hot holding at improper temperatures using a calibrated food temperature measuring device: cooked beans 119F, cooked chicken 89F--steam table (there was no water under the container).
    Correction: Potentially hazardous foods (time/temperature conrol for safety food) shall be held hot at a temperature of 135°F or above unless the permit holder is using "time as the public health control" as specified under 3-501.19. Note: Discarded cooked chicken and reheated beans.
  • Critical: Cold Holding of Potentially Hazardous Food at 41°F or less (corrected on site) (repeated violation)
    Observation: The following food items were observed cold holding at improper temperatures using a calibrated food temperature measuring device: cheese 54F--3DR prep top.
    Correction: Potentially hazardous foods (time/temperature control for safety food) shall be held cold at a temperature of 41°F or below unless the permit holder is using "time as public health control" as specified under 3-501.19 to limit bacteria growth. Note: Put inside the refrigerator.
  • Equipment / Good Repair / Components / Gaskets
    Observation: The door gaskets of the following unit are damaged: 3DR prep refrigerator.
    Correction: Equipment components such as doors, seals, hinges, fasteners, and kick plates shall be kept intact, tight, and adjusted in accordance with manufacturer's specifications.
  • Cutting Boards / Resurface / Discard
    Observation: The cutting boards along the 3DR prep refgerator is heavily scratched and scored. The food contact surface is no longer easily cleaned and sanitized due to condition.
    Correction: Surfaces such as cutting blocks and boards that are subject to scratching and scoring shall be resurfaced if they can no longer be effectively cleaned and sanitized, or discarded if they are not capable of being resurfaced.
  • Outdoor Refuse Areas, Curbed and Graded to Drain
    Observation: The outdoor refuse area is not curbed or graded to properly drain. Observed that the grass area behind the facility is damaged. Stains of grease observed. The wastewater should not flow in grass area.
    Correction: Provide an area for refuse, recyclables, and/or returnables that is curbed and graded to drain to collect and dispose of liquid waste from the refuse and from cleaning the area and receptacles. Note: The owner mentioned that he will use bricks to curb the area.
  • Cleaning Frequency for Physical Facilities
    Observation: Observed that the faucet for 3-vat sink in the kitchen is in need of cleaning.
    Correction: Clean the physical facilities at a frequency necessary to ensure the protection and safe preparation of food.

The purpose of today's visit is to conduct a risk factor assessment.

  • Critical: Handwashing / When to wash hands (corrected on site)
    Observation: A food employee failed to wash his or her hands before engaging in food preparation, after touching bare human body parts, after coughing, sneezing, eating, after handling soiled utensils, or after engaging in any activity that could contaminate the hands. Observed employee failed to change gloves and wash hands after breaking raw shell eggs with gloved hands.
    Correction: ALL food employees shall wash their hands OFTEN especially after handling trash, using the restroom, handling raw meats, handling soiled equipment and utensils, BEFORE putting on clean gloves, etc. Proper handwashing frequencies will aid in the reduction of foodborne illness.
  • Critical: Food Condition / Safe, Unadulterated, and Honestly Presented (corrected on site)
    Observation: The following food item is observed to be unsound or adulterated: Observed carrots with mold on it in a big plastic tub in dry storage area. Per the owner they were going to clean and throw that away.
    Correction: ALL food shall be safe, unadulterated and honestly presented as specified under 3-601.12.
  • Critical: PHF(TCS) Cooled from 135°F to 41°F within 6 Hours Total (corrected on site) (repeated violation)
    Observation: The following cooked potentially hazardous foods are not being adequately cooled from 135°F to 70°F within 2 hours and to 41°F within a total of 6 hour: Salsa cooling for more than 12 hours in the True upright refg observed at 57°F. Note: Discarded.
    Correction: Potentially hazardous foods shall be cooled from 135°F to 70°F within 2 hours and to 41°F within a total of 6 hours to prevent the growth of harmful bacteria.
  • Critical: Date Marking of Refrigerated, Ready-to-Eat PHF (TCS Food) (corrected on site) (repeated violation)
    Observation: The following refrigerated, ready-to-eat, potentially hazardous food that is prepared on site is not used or discarded within 24 hours of preparation and was not observed to be date marked: The employees not datemarking correctly counting 8-9 days instead of 7 days. Note: Trained employees on datemarking and cooling.
    Correction: Refrigerated, ready-to-eat, potentially hazardous foods that are prepared on site and kept for more than 24 hours cannot have a shelf-life of more than 7 days, including the day of preparation. These food items must be marked with either the "consume-by" date and/or "preparation" date, color-coded labels, or another marking system/method that effectively indicates shelf-life that is clearly understood and properly used by the employees.

    Observation: The food-contact surfaces of the following equipment were not observed sanitized: metal pans. Note: Set up sanitizing sink.
    Correction: All utensils and food-contact surfaces of equipment shall be sanitized before use and after cleaning.

  • Critical: Responsibility of PIC to Require Food Employees to Report GI Symptoms or Cuts, Disease, Medical Condition or Exposure to PIC (repeated violation)
    Observation: Upon discussion with the person-in-charge, one or more of the elements of an effective employee health policy is either missing or incomplete. A complete employee health policy is required to be in place at the food establishment. At the time of this inspection, the Health Department provided and reviewed handouts and resource information in a red folder labeled "Employee Health Policy.
    Correction: A complete employee health policy must have the following elements:
    1) Employee training on foodborne illness, particularly symptoms of illness and prevention of the Big Five illnesses (see "What is Foodborne Illness" handout)
  • Jewelry Prohibition (corrected on site)
    Observation: Employees observed wearing watch while cleaning dishes and cooking food.
    Correction: Food employees shall limit their jewelry to a plain wedding ring while preparing food. Food employees may not wear bracelets, watches, etc. because they can inhibit proper hand washing.
  • Critical: Food Protection from Contamination / Separate Raw from RTE (corrected on site) (repeated violation)
    Observation: Raw animal food holding in a manner that may cause cross contamination of ready-to-eat food as follows: Observed raw eggs stored above beverage and produce--True 2DR refg left. Observed raw chicken and beef stored above cooked pork.--True 2DR upright right.
    Correction: Food shall be protected from cross contamination by separating raw animal foods like poultry, beef, pork, seafood, and eggs during holding from ALL other foods such as cooked foods, ready-to-eat foods, washed produce, etc.
  • Utensils That are In-Use / Between-Use Storage (corrected on site)
    Observation: Observed a bowl used to dispense rice and tomato sauce.
    Correction: During pauses in food preparation or dispensing, food utensils shall be stored in one of the following manners: 1) in the food with their handles above the top of the food and the container. Using a utensil without handle could contminate food.
  • Wiping Cloths / Use Limitation / Soiled Cloths
    Observation: Heavily soiled wiping cloths in use.
    Correction: Dry and wet wiping cloths shall be free of food debris and visible soil.
  • Critical: PHF(TCS) Cooled from 135°F to 41°F within 6 Hours Total (corrected on site) (repeated violation)
    Observation: The following cooked potentially hazardous foods are not being adequately cooled from 135°F to 70°F within 2 hours and to 41°F within a total of 6 hour: Cooked tamale cooling for 10 hours in the kitchen observed at 82°F. Note: Per the owner they left it out all night to cool it. Not in refrigerator or freezer. Discarded.
    Correction: Potentially hazardous foods shall be cooled from 135°F to 70°F within 2 hours and to 41°F within a total of 6 hours to prevent the growth of harmful bacteria.
  • Critical: Cold Holding of Potentially Hazardous Food at 41°F or less (corrected on site)
    Observation: The following food items were observed cold holding at improper temperatures using a calibrated food temperature measuring device: shredded cheese 66F--prep table. Cooked pork 47F, rice 46F, cooked veg. 45F, salsa 45F--True 2DR upright refg right. Note: Discarded.
    Correction: Potentially hazardous foods (time/temperature control for safety food) shall be held cold at a temperature of 41°F or below unless the permit holder is using "time as public health control" as specified under 3-501.19 to limit bacteria growth.
  • Critical: Cold Holding of Raw Shell Eggs at Ambient Temperature of 45°F or less (corrected on site) (repeated violation)
    Observation: Observed raw shell eggs stored at room temperature. Note: The employee took it out for trash upon my arrival.
    Correction: Shell eggs that have not been treated to destroy Salmonella shall be stored in refrigerated equipment that maintains an ambient temperature of 45°F or less.

Note: Discarded due to cold holding violation.
    Correction: Refrigerated, ready-to-eat, potentially hazardous foods that are prepared on site and kept for more than 24 hours cannot have a shelf-life of more than 7 days, including the day of preparation. These food items must be marked with either the "consume-by" date and/or "preparation" date, color-coded labels, or another marking system/method that effectively indicates shelf-life that is clearly understood and properly used by the employees.

  • Critical: Food-Contact Surface Sanitized before Use after Cleaning (corrected on site)
    Observation: The food-contact surfaces of the following equipment were not observed sanitized: Employee was cleaning dishes did not have sanitizing sink set up and skipped sanitizing.
    Correction: All utensils and food-contact surfaces of equipment shall be sanitized before use and after cleaning.
  • Critical: Certified Food Manager/Presence Required (corrected on site)
    Observation: There is no Certified Food Manager present at the beginning of the inspection.
    Correction: It shall be unlawful to operate a food establishment unless it is under the immediate control of a certified food manager. It is highly suggested that you have more than one employee with the food manager's license. ORS Interactive, Inc. (see handout provided) issues the required photo identification card with proof of successful completion of a certified food manager's exam. Failure to have a certified food manager on site during ALL hours of operation including food preparation, food service, and cleaning/sanitizing of equipment/utensils will result in closure of the establishment.
  • Handwashing Sink / Accessible at All Times (corrected on site)
    Observation: The handwashing facility located at the 3-vat sink is blocked, preventing access by employees for easy handwashing.
    Correction: A handwashing sink shall be maintained so that it is accessible at all times for employee use.
