Discussed employee health, time as a public health control (TPHC). Zaxby's time control policy for cold food in prep unit exceeds 4 hour timeframe as indicated by VDH. Operator will use VDH TPHC while unit is being repaired. Food will be used or discarded w/n 4 hours. Food handlers cards are due in 90 days for all food staff that do not have certification in food management. Follow-up for prep unit will be done and permit is pending follow-up.

The following items were noted: (1) The pump assembly for the milk dispenser for making the milk shake is to be removed and cleaned (washed, rinsed and sanitized) at least every four hours. Alternatively, have a back-up pump assembly to replace the one in use at least every four hours

Observation: The Center Line Utility cooler was not operating at proper temperature to cold hold foods at 41 F or lower. Foods were cold holding between 43 F and 55 F.
Correction: Discard potentially hazardous foods/TCS foods that were found at temperatures greater than 48 F. Lower the temperature of this cooler unit so that it can cold hold potentially hazardous food at 41°F or below to inhibit the growth of harmful bacteria.

Observation: There were gaps underneath the back exit door that could serve as rodent entry points.
Correction: Protect the food establishment against the entry of insects and rodents by gaps underneath the back exit door by providing a weather-stripping material.

Noted the following: (1) Found the milk sitting in the line at elevated temperature (47 F) while the rest of the milk was below 41 F. Therefore the holding unit for the milk/whipped cream located by the Drive-through window is to continue having the milk discarded every 4 hours and have the pump assembly cleaned and sanitized. There should be a written policy for using time as a public health control

Observation: Magnosol used for filtering used oil was being stored in close proximity to chemical cleaning agents where it may be exposed to contamination..
Correction: Relocate the magnosol to an area away from the chemical cleaning agents to prevent contamination.

Observation: There was no hot water coming out of the handwashing sink located in the Service are by the swing door.
Correction: Ensure that all handwashing stations have hot and cold running water.

A reminder was given to the PIC/Operator, David Feuer, that all Foodhandlers are to receive adequate food sanitation training so they can get a Foodhandler's Card. A notation was made about the gap underneath the back exit door. Conditions otherwise were satisfactory. HM
