    Observation: Surfaces of ice bins, beverage dispensing nozzles, and enclosed components of equipment are not being cleaned as required.
    Correction: Surfaces of utensils and equipment contacting food that is NOT potentially hazardous (time/temperature control for safety food) such as ice bins, beverage dispensing nozzles, and enclosed components of equipment such as ice makers, cooking oil storage tanks and distribution lines, beverage and syrup dispensing lines or tubes, coffee bean grinders, and water vending equipment at a frequency specified by the manufacturer or at a frequency necessary to preclude accumulation of soil or mold.

The purpose of this visit was to conduct a follow-up inspection on the 3dr preptop cooler. Air temperature was at 41F and below and is able to keep potentially hazardous foods cold.
  • Critical: Consumer Advisory Required for Raw or Undercooked Animal Food
    Observation: A review of the menu with the foodservice operator indicates that there is no consumer advisory for the following food item(s) that may be served raw and/or undercooked: salmon cream cheese and lox bagel
    Correction: If an animal food such as beef, eggs, fish, lamb, milk, pork, poultry, or shellfish is served or sold raw or undercooked the permit holder shall inform consumers of the significantly increased risk of consuming such foods by way of a disclosure and reminder using brochures, deli case or menu advisories, label statements, table tents, placards, or other effective written means.
  • Food Contact Surface/Smooth, Easily Cleanable
    Observation: The food-contact surfaces of the following equipment and/or utensils are not finished to have a smooth, cleanable surface: wooden plaques used for bagels

    Observation: The following farm-raised fish served raw or partially cooked were observed without a written statement from the supplier stating that the fish were raised and fed according to 3-402.11(B)(3)- smoked salmon
    Correction: Contact your fish supplier and ask for a written statement stating that the fish were raised in net pens if in open water OR land-based operations AND fed formulated feed that contains no live parasites. FAX a copy of this letter to your inspector and keep this statement on site at the food establishment for 90 days beyond the time of service of the fish. CFM was able to locate the parasite destruction letter on the supplier website
  • Critical: Cold Holding of Potentially Hazardous Food at 41°F or less (corrected on site) (repeated violation)
    Observation: The following food item(s) were observed cold holding at improper temperatures using a calibrated food temperature measuring device: 1) sliced tomatoes 44F, egg salad 46F, chicken salad 45F in 3dr preptop cooler, 2) milk in carafe 59F
    Correction: Potentially hazardous foods (time/temperature control for safety food) shall be held cold at a temperature of 41°F or below unless the permit holder is using "time as public health control" as specified under 3-501.19 to limit bacteria growth. all potentially hazardous food items in 3dr preptop cooler were put back in the walkin cooler. milk in carafe was changed out and refilled.

The purpose of today's visit is to conduct a follow-up inspection. The manager called this afternoon to notify that they defrosted the 3Dr prep refrigerator is under 40F. This visit is to assess cold holding capability of the 3DR prep refrigerator.
The ambient temperature was observed at 35F. See food temperatures noted above. It is okay to use the refrigerator.
**Monitor ambient and food temperatures in all refrigerators. Check temperatures of potentially hazardous foods on prep top after lunch and breakfast rush.

No violation noted during this evaluation.

    Observation: Observed the following ready-to-eat, potentially hazardous food being held for more than 7 days at 41°F: strawberry cream cheese and several other cream cheese dated (discard date) 3/25 and 3/30 in 1DR prep refrigerator.
    Correction: Foods shall be discarded if it: 1) exceeds 7 days or at 41°F (except the time it is frozen)

    Observation: There is no test kit located in the facility for monitoring the concentration of the chemical sanitizing solutions.
    Correction: Obtain a BLEACH test kit.

    Observation: The following refrigeration unit is not operating properly and is unable to maintain cold food at or below 41°F: 3DR prep refrigerator 45F.
    Correction: Repair/adjust the unit so it is able to maintain foods at or below 41°F. Do not use the unit to store potentially hazardous foods while it is not operating properly. Note: Adjusted the thermostat, temperature not going down.
  • Equip/Utensils/Linens/Single-Service/Invert, Cover (corrected on site)
    Observation: Disposable plates and paper boxes were observed stored with the food-contact surface facing upward.
    Correction: Clean equipment and utensils shall be stored in a self-draining position that allows air drying and covered/inverted.
  • Equip/Utensils/Linens/Single-Service/Original Package (corrected on site)
    Observation: Coffee filters were observed stored unprotected at the coffee station.
    Correction: Single-service items shall be stored in a clean, dry location that is not exposed to splash, dust, or other contamination and at least 6 inches off the floor on approved shelving units or dunnage racks. In addition, the single-service items shall be kept in the original protective package or stored by using other means that afford protection from contamination until used.
  • Physical Facilities Good Repair (repeated violation)
    Observation: Observed that the ceiling tile above 3-vat sink and above 2DR display refrigerator front is missing. Per manager there was a water leak last week and the management was working on leak.
    Correction: Repair the physical facilities. Poor repair and maintenance compromises the functionality of the physical facilities. Note: Replace the ceiling tiles.
  • Maintaining Premises Free of Unnecessary Items and Unused Equipment
    Observation: Observed that soft serve machine that are unnecessary to the operation or maintenance of the establishment are being stored on the premises.
    Correction: Remove unnecessary items, including equipment which is no longer in use, from the premises to allow for regular and effective cleaning and to prevent harborage conditions.
  • Critical: Conditions of Use/Presence & Use of Toxics Per Law (corrected on site)
    Observation: Pesticides labeled for residential use were observed in the facility and are being applied by the operator to control pests. Big spray can for roaches.
    Correction: Remove residential use pesticides from the facility. When necessary for pest control, chemical pesticides must be applied by a certified pesticide applicator to prevent injury and contamination. Note: Owner will take it home.
  • Critical: Sanitizers, 21 CFR Criteria for Food Contact (corrected on site)
    Observation: Scented bleach being applied to food contact surfaces, it does not meet the requirements of 21 CFR 178.1010.
    Correction: Chemical sanitizers shall be used in accordance with the CFR. High concentrations of sanitizer in excess of the CFR requirements can be harmful because residues of the materials remain. Note: The employee went and bought unscented bleach.

    Observation: Plumbing connections under the sanitizing sink and faucet at 3-vat sink is leaking. NOTE: REPEAT--FAX INVOICE TO the health inspector within 10 days.
    Correction: A plumbing system shall be maintained in good repair.

    Observation: Observed that the ceiling tile near the oven is broken/fell down and leaking. Water leaking near the entrance of the bagel prep area.
