    Observation: The person in charge did not demonstrate their knowledge of correct procedures for cleaning and sanitizing utensils and food-contact surfaces of equipment.
    Correction: Based on the risks inherent to the food operation, during inspections and upon request the person in charge shall demonstrate to the regulatory authority knowledge of foodborne disease prevention, application of the hazard analysis and critical control point principles, and the requirements of this Code. The person in charge shall demonstrate this knowledge by responding correctly to the inspector's questions as they relate to the specific food operation. The areas of knowledge include explaining correct procedures for cleaning and sanitizing utensils and food-contact surfaces of equipment.

    Observation: The person in charge did not demonstrate their knowledge of the required food temperatures and times for the safe cooking of time/temperature control for safety foods (chicken).
    Correction: Based on the risks inherent to the food operation, during inspections and upon request the person in charge shall demonstrate to the regulatory authority knowledge of foodborne disease prevention, application of the hazard analysis and critical control point principles, and the requirements of this Code. The person in charge shall demonstrate this knowledge by responding correctly to the inspector's questions as they relate to the specific food operation. The areas of knowledge include stating the required food temperatures and times for the safe cooking of time/temperature control for safety foods including meat, poultry, eggs, and fish.
  • Manual Warewashing/Sink Compartment Requirements (corrected on site)
    Observation: Three (3)-compartment sink is not properly setup. The employee/PIC said that dishes and utensils are sanitized first, then soaked in soapy water and rinsed in final step.
    Correction: Manual warewashing equipment must provide for accomplishment of the same 3 steps: 1. Application of cleaners and the removal of soil
  • Sanitizing Solutions, Testing Devices
    Observation: A chlorine test kit or other device that accurately measures the concentration of the sanitizing solution is not provided. A quat test kit, however, was available.
    Correction: A test kit or other device that accurately measures the concentration in mg/L of sanitizing solutions shall be provided. Testing devices to measure the concentration of sanitizing solutions are required for 2 reasons: 1. The use of chemical sanitizers requires minimum concentrations of the sanitizer during the final rinse step to ensure sanitization
  • Controlling Pests
    Observation: Insect, rodent, and/or other pest harborage conditions exist on the premises. Dead roaches observed in the ceiling light shields. Few fruit were also seen on the front line.
    Correction: The presence of insects, rodents, and other pests shall be controlled to minimize their presence on the premises by eliminating harborage conditions. Insects and other pests are capable of transmitting disease to man by contaminating food and food-contact surfaces. Effective measures must be taken to control their presence in food establishments.

    Observation: The ceiling tiles and walls around return air inlets have dust accumulation.
    Correction: Physical facilities shall be cleaned as often as necessary to keep them clean. Cleaning of the physical facilities is an important measure in ensuring the protection and sanitary preparation of food. A regular cleaning schedule should be established and followed to maintain the facility in a clean and sanitary manner.
  • Poisonous or Toxic Materials/Common Name/Working Containers (corrected on site)
    Observation: Working containers used for storing windex solution and degreaser are not clearly and/or individually identified with the common name of the material.
    Correction: Working containers used for storing poisonous or toxic materials such as cleaners and sanitizers taken from bulk supplies shall be clearly and individually identified with the common name of the material. It is common practice in food establishments to purchase many poisonous or toxic materials including cleaners and sanitizers in bulk containers. Working containers are frequently used to convey these materials to areas where they will be used, resulting in working containers being stored in different locations in the establishment. Identification of these containers with the common name of the material helps prevent the dangerous misuse of the contents.
  • Sanitizers, Criteria/Chemicals for Food Contact Surfaces (corrected on site)
    Observation: Chlorine concentration in 3-compartment sink observed more than 200 ppm.
    Correction: Chemical sanitizers and other chemical antimicrobials applied to food-contact surfaces shall meet the requirements specified in 40 CFR 180.940 Tolerance exemptions for active and inert ingredients for use in antimicrobial formulations (food-contact surface sanitizing solutions). Chemical sanitizers are included with poisonous or toxic materials because they may be toxic if not used in accordance with requirements listed in the Code of Federal Regulations (CFR). Large concentrations of sanitizer in excess of the CFR requirements can be harmful because residues of the materials remain. The CFR reference that is provided lists concentrations of sanitizers that are considered safe.

  • Critical: Time/Temperature Control for Safety Food, Cold Holding (corrected on site)
    Observation: Flan cold holding at the improper temperature of 48 F in the "Master Bilt" three door drink/dessert refrigerator. The flan and tres leche desserts were relocated to another refrigerator.
    Correction: Except during preparation, cooking, or cooling, or when time is used as the public health control as specified under section 3-501.19, and except as specified under paragraph (B) of this section, time/temperature control for safety food shall be maintained at 5ºC (41ºF) or less. Bacterial growth and/or toxin production can occur if time/temperature control for safety food remains in the temperature "Danger Zone" of 5ºC to 57ºC (41ºF to 135ºF) too long. Up to a point, the rate of growth increases with an increase in temperature within this zone. Beyond the upper limit of the optimal temperature range for a particular organism, the rate of growth decreases. Operations requiring heating or cooling of food should be performed as rapidly as possible to avoid the possibility of bacterial growth.
  • Nonfood-Contact Surfaces/Nonabsorbent (repeated violation)
    Observation: The shelf liners of cardboard and aluminium foil are not corrosion-resistant, nonabsorbent, and/or smooth.
    Correction: Nonfood-contact surfaces of equipment that are exposed to splash, spillage, or other food soiling or that requires frequent cleaning shall be constructed of a corrosion-resistant, nonabsorbent, and smooth material. Nonfood-contact surfaces of equipment routinely exposed to splash or food debris are required to be constructed of nonabsorbent materials to facilitate cleaning. Equipment that is easily cleaned minimizes the presence of pathogenic organisms, moisture, and debris and deters the attraction of rodents and insects.
  • Temperature Measuring Devices
    Observation: The chicken hot holding counter top units, the "Superior" three door sliding refrigerator, and the "Master Bilt" three door refrigerator are not equipped with at least one integral or permanently affixed temperature measuring device that is located to allow easy viewing of the device's temperature display.
    Correction: Cold or hot holding equipment used for potentially hazardous food (time/temperature control for safety food) shall be designed to include and shall be equipped with at least one integral or permanently affixed temperature measuring device that is located to allow easy viewing of the device's temperature display. This section does not apply to equipment for which the placement of a temperature measuring device is not a practical means for measuring the ambient air surrounding the food because of the design, type, and use of the equipment, such as calrod units, heat lamps, cold plates, bainmaries, steamtables, insulated food transport containers, and salad bars. A permanent temperature measuring device is required in any unit storing potentially hazardous (time/temperature control for safety) food because of the potential growth of pathogenic microorganisms should the temperature of the unit exceed Code requirements. In order to facilitate routine monitoring of the unit, the device must be clearly visible.
  • Equipment/Good Repair and Proper Adjustment (repeated violation)
    Observation: The ice cream freezer has an accumulation of frost.
    Correction: Equipment shall be maintained in a state of repair and condition that meets the requirements specified under Parts 4-1 [Materials for Construction and Repair] and 4-2 [Design and Construction]. Proper maintenance of equipment to manufacturer specifications helps ensure that it will continue to operate as designed. Failure to properly maintain equipment could lead to violations of the associated requirements of the Code that place the health of the consumer at risk. For example, refrigeration units in disrepair may no longer be capable of properly cooling or holding potentially hazardous (time/temperature control for safety) foods at safe temperatures.
  • Equipment Food-Contact Surfaces and Utensils/Time Temperature Control For Safety Food/Cleaning Frequency
    Observation: Some mold was observed inside the ice machine.
    Correction: Except when dry cleaning methods are used as specified under section 4-603.11, surfaces of utensils and equipment contacting food that is not time/temperature control for safety food shall be cleaned: (1) At any time when contamination may have occurred
  • Outer Openings, Protected
    Observation: The outer openings of the food establishment are not protected against the entry of insects and rodents (an air gap was observed at the bottom right corner of the garage door).
    Correction: Outer openings of a food establishment shall be protected against the entry of insects and rodents by: (1) Filling or closing holes and other gaps along floors, walls, and ceilings
  • Physical Facilities/Repairing
    Observation: There is missing cove base at the bottom of the wall to the left of the three compartment sinks. There are several tiny holes that need filling in at the walls by the three compartment sink, mop sink, and a couple of larger holes by the garage door. Ensure all cove base and FRP are secured tight to their adjoining walls.
    Correction: Physical facilities shall be maintained in good repair. Poor repair and maintenance compromises the functionality of the physical facilities. This requirement is intended to ensure that the physical facilities are properly maintained in order serve their intended purpose.
  • Controlling Pests (repeated violation)
    Observation: Insect, rodent, and/or other pest harborage conditions exist on the premises. Mouse droppings were observed on the floor by the lockers. Fruit flies and German cockroach was observed on the wall to the left of the three compartment sinks.
    Correction: The presence of insects, rodents, and other pests shall be controlled to minimize their presence on the premises by eliminating harborage conditions. Insects and other pests are capable of transmitting disease to man by contaminating food and food-contact surfaces. Effective measures must be taken to control their presence in food establishments.

    Correction: All non-movable equipment must be sealed to adjoining wall.

    Observation: Some of the shelving in the Superior 3 door uprt unit used for cole slaw were observed in disrepair.
    Correction: Equipment must be maintained in proper repair.
  • Critical: Backflow Prevention Device, Design Standard
    Observation: The mushroom type backflow prevention device installed on the mop sink is not rated for continuous pressure.
    Correction: Backflow prevention devices must conform with design standards.
  • Plumbing System/Maintained in Good Repair (corrected on site)
    Observation: The left side hand sink in men's restroom was observed backing up when left side or right side hand sink was in use. Plumber on-site making repairs.
    Correction: Plumbing systems must be maintained in proper repair.
  • Light Bulbs, Protective Shielding
    Observation: The light bulb in the 3 door glass uprt unit in back was not shielded.
    Correction: All lights must be shielded in food prep and storage areas.
  • Poisonous or Toxic Materials/Common Name/Working Containers (corrected on site)
    Observation: Chemical spray bottles observed not labelled.
    Correction: Chemical spray bottles must be labelled with common name of contents.

    Observation: The nonfood-contact surface of some cardboard and aluminium foil to line some shelving are not corrosion-resistant, nonabsorbent, and/or smooth.
    Correction: Nonfood-contact surfaces of equipment that are exposed to splash, spillage, or other food soiling or that requires frequent cleaning shall be constructed of a corrosion-resistant, nonabsorbent, and smooth material.     Observation: The nonfood-contact surface of the shelving in the cole slaw refrigerator, and inside the ice machine are not cleaned at a frequency necessary to preclude the accumulation of soil residues.
    Correction: Nonfood-contact surfaces of equipment shall be cleaned at a frequency necessary to preclude accumulation of soil residues. The presence of food debris or dirt on nonfood contact surfaces may provide a suitable environment for the growth of microorganisms which employees may inadvertently transfer to food. If these areas are not kept clean, they may also provide harborage for insects, rodents, and other pests.
  • Refuse/Maintaining Refuse Areas and Enclosures
    Observation: The storage area and/or enclosure for refuse, recyclables, or returnables is not maintained free of unnecessary items and/or clean [three trash bags observed on the pavement by the dumpsters].
    Correction: A storage area and enclosure for refuse, recyclables, or returnables shall be maintained free of unnecessary items, as specified under section 6-501.114, and clean. Proper storage and disposal of garbage and refuse are necessary to minimize the development of odors, prevent such waste from becoming an attractant and harborage or breeding place for insects and rodents, and prevent the soiling of food preparation and food service areas. Improperly handled garbage creates nuisance conditions, makes housekeeping difficult, and may be a possible source of contamination of food, equipment, and utensils.
  • Intensity/Lighting
    Observation: The light intensity is below 50 foot candles where a food employee is working with food [lights over the fryers not on/switch broken?].
    Correction: The light intensity shall be at least 540 lux (50 foot candles) at a surface where a food employee is working with food or working with utensils or equipment such as knives, slicers, grinders, or saws where employee safety is a factor. Lighting levels are specified so that sufficient light is available to enable employees to perform certain functions such as reading labels
