In the future definitely do background checks on tenants and don't rent to illegals. Do things by the book, especially in a tenant friendly state like NJ.

Given the tight turnaround with the new renter, I would probably offer 1/2 the security deposit back in exchange for getting out a day or two prior to when the lease is up (assuming apt is in decent shape). Obviously no payment until his stuff is out and the locks are changed.

You should have served him with a 3-day notice for possession or compliance on October 2nd. He didn't pay rent. End of story.
