Damaged Vehicle (2) Blown Tires with (2) Cracked Rims with Front Bumper Damage. Vehicle needed a flatbed to be towed for repair and further assessment. Town of Oyster Bay contracted Posillico Materials in Farmingdale to repave the roadway in the Jericho Gardens and surrounding areas. A Hicksville Water Metal Valve cover in the street was lodged in the upright position. The angle and the grade of the roadway made it impossible to see. The Hicksville Water Department was notified and a complaint filed within less than 24 hours of the incident which occurred on a Sunday evening. A letter of response stated, they have no liability.
A civil court date filing has been submitted and served. I will update on the outcome of the hearing

Good luck winning the case because it isn't going to happen. My brother in law hit a pot hole on his motorcycle blew out a tire and almost fell off his bike and hurt himself. He reported it to Town of Babylon and they said it's not their problem.

Yeah not gonna happen. I'm surprised the lawsuit hasn't been tossed, the government probably has immunity and if not, they have so many loopholes to get out of it.

Plus, the cover couldn't be seen but it damaged the front bumper???

Come on, now.

Well, never say never I guess. All men are equal, but some are more equal than others for sure. I mean look at this article from a while ago, which happened in San Diego CA. The mayor's wife fell and busted her fake boobs due to a broken sidewalk, end up getting paid $85k from the city.

Tripping on a broken sidewalk is not the same as driving your car into a manhole equivalent.

NY and CA are both pure comparative negligence states.

Town of Huntington pulls the same nonsense when I hit a massive pothole on Sweet Hollow Road. They reject all claims and you're forced to hire an attorney.
