Hi all...Someone called townhall on the new owner of the house i live in. It is not a legal apartment. I've been there 7 years and my boyfriend has been there 18 years. Any advice would be appreciated. The inspectors coming tomorrow to inspect the house, Thank you.

In my experience, most Towns will give 30 days notice to vacate the illegal apartment.

Who arranged for the inspection? Inspector doesn't have the right to simply enter. We required informed consent for an inspection. You do have a right to know the scope and nature of the inspection prior to allowing entry. Also as the lawful occupants of that living space (possession law, not town code legal) you make the call, not the landlord on your behalf.

Evictions take time. An inspector may issue notice and order to remedy which may not be completed in the prescribed time. Even if the Town summons the landlord to court, they can't speed up the eviction process.

Seek out other accommodations since it's likely over, but maintain your rights while that happens.

Regarding the apartment itself: there are some cases where it may be legalized. Certain townships (Hempstead for sure) allow for the creation of accessory apartments for seniors. The accessory unit must be under 800 sq ft (could be owner or tenant space), owner must be on the deed, age 62, and must occupy the home. Still no basements, though, if that's the case. Worth exploring.

Guessing the new owner doesn't want a tenant. Perhaps THEY are the ones who called.
