This is getting too complicated OP. If this were me I'd tell the neighbors that you are getting a tree company to trim the "Dangerous" tree that is over your house which is causing you and your family a lot of fear and concern. The tree company will need access to the tree which is on their property. If they give you and lip I'd inform them that you will get the police and will sue them. You should not have to deal with this BS OP.
Uh, just one problem. This village has its own police force, and yes, the neighbors will call them if I get someone to climb the tree, and the police will not support me, but will make the guys get off their tree and property.
How would you suggest I do that when no one is allowed to climb the tree?
Sorry: Certified letter from your attorney copying you, any homeowner's association, etc. advising the imminent danger to life and limb (no pun intended) - and that they must grant access to their limb so you can alleviate the danger.
I guess you'd have to have a conversation with them about where (what part of the limb) would be cut.
A. Have photographs of the two incidents of previous limb fall damage you mention in first post?
B. A written statement from a licensed tree company/arborist (or more than one) saying the job is impossible and/or unable to be carried out safely without accessing adjoining property, etc? Or can you get one? Might they also put in writing the situation is potentially dangerous or poses an imminent danger or hazard ?
I suggest the following as a lay-individual non-attorney C-D poster. Please consult with an actual attorney if you decide to go that route.
A. Go to the town hall and look up the legal owner(s) of the property (you would be surprised, the people denying you may not even be the legal owners).
B. Consider hiring an attorney to draft certified letters stating what you have said here, such as having approached the person(s) on property and they have repeatedly denied access, town/village won't get involved, you consider it a serious danger and hazard, police say its dangerous, arborist(s) say its dangerous, also maybe include that thing 1200RT posted about providing your insurer with photos, subrogating against their insurer, etc. Back up all with arborist statements, photo's, etc.
C. Have attorney send certified copies to village, village police department, the neighbor's residence, the legal owner of the property if not the neighbor located at residence, etc.
No one has the apparatus. Had three companies here. Limbs are 85 feet up.
Well that's ridiculous. We've had two separate companies with cranes come in and cut down pine trees at least 100 feet tall.
You've shot down all suggestions, not sure what you want people to tall you.
All you can do is send the letters and if the worst happens, provide copies to your insurer.
sell the house and leave a bag of dog **** in their mailbox the day you leave..
