Can anyone provide any information regarding IL law requiring counties to post "mowing ahead" signs when they are mowing along roadways. My wife recently was traveling on a county highway road when a county highway owned mower threw a rock across two lanes of traffic and struck our vehicle. They are refusing to pay for the damage and they stated that they are indemnified.

First you have to prove it, which is probably next ot impossible. Your best bet is to contact your insurance companu and let them repair the damange.

Were they negligent, or was it one of those things that just happens?

What difference would a sign have made? They are put out to protect workers from cars, not to prevent cars from getting hit with stones.

Didn't your wife see the mower even without the sign?

I highly doubt there is a Illinois state law for this. There may be a county law however.

I would assume your insurance company would pay for this. I realize the county was mowing and there machinery shot a rock at your property but how was the county to know the rock was there? I think that you insurance will cover it without any raise on rates.

To hell with consulting an attorney, file an insurance claim and let their battalion of lawyers decide if it's worth going after the county/state. If they do and they win, you'll probably get 2/3rds of your deductible back.

Thank God the Rock did not hit her ! This is a hazzard anytime there is mowing alongside a road. I don't know if any county or state has insurance that covers that. Our counties always have signs well ahead of the official mowers, but that would not prevent such an accident.
