We're interested in a small lot near Austin that was divided into two smaller lots... about 40 years ago. One half of the lot was sold and amended to the adjacent lots. The other half of the lot was never replatted. The City is saying we cannot build on the other half, because its legally not platted (their assumption because they don't have proof that it was ever replatted and they had poor records during the 1970's 80's)

The plat map that the deed referenced was never updated to show it either.. and I'm actually having a hard time finding any record of the other half of the lot ever replatted, even though the neighbor actually built his house on it, some 40 years ago.

We have the metes and bounds recorded to the title.. but no replat. If we were to replat the lot, it wouldn't meet the cities minimum lot size (ordinance made in 2003)... thus the land is basically unbuildable.. yet still taxable (see the issue here?)


My question.. is there any other instruments (as in legal paperwork, description, etc ) that could indicate the lot was replatted.. other than a replat application or updated plat map. I'm having a hard time believing that the owner purchased the land (and divided the land on the same day) without getting it legally replatted.
