You're right that they are true rather than borderline subtropical climates (they even meet criteria for Trewartha's Cf classification). But they still are within the upper third of the subtropics geographically, and they also still have below-freezing average lows as OP defines "upper" subtropical climates.

Trewartha classification is the biggest dispute, Isles of Scilly England subtropical, not at all that os pure oceanic! Köppen is way more superior, and it sets its subtropics to 25-40°N which it resumes the average of latitude of where subtropical climates end, the average of Southern Hemisphere is 37°S all continents rounded, NH is 43°N all continents rounding giving, 40°, also before tropics hit at 25°N climates are easily tropical, Southern Florida starting them at 27°N, so even in the typical latitudes of humid subtropical Köppen us superior overall.
