Hi, my husband and I are expecting a baby and need to know whether we have to move or not. we live in a a 1 bed/ 1bath apartment and from what I can find the TX state law says 3 people to a bedroom, but I can't find anything about it here in fort worth, my lease doesnt mention it either way.
Does anyone know if 2 parents and 1 child can legally live in a 1 bedroom apartment? thanks in advance.

I think Texas allows 3 people per bedroom in an apartment, but I would confirm that. Call your complex leasing office anonymously and ask.

Nope. It is two people per bedroom, and a bedroom is a room with a window and a closet. When my nephew and his wife had their first baby, the apartment required them to go up to a 2 bedroom within 6 months.

Every Google search I came up with said the law is up to 3 people per bedroom, but complexes may be able to limit as they choose.

I do not believe this is exactly correct. The OP needs to check with Code Compliance, but I believe they can remain in a 1/1 until the child is 6 months. After that, they would have to move to a 2/1 or larger.

You need to call the city and speak to Code Compliance. They are your authority for what you can and cannot do. If you were to be cited, it would be a HEFTY fine. I am talking many hundreds of dollars. Do not risk it. It is not worth the fine and having it on your record.

City code enforcement typcially doesn't oversee resident policies or punish or fine individual tenants of an apartment complex.
