I would definitely give them at least 30 days, but by statute, they have one year for misdemeanors. § 19.2-8. Limitation of prosecutions. https://law.lis.virginia.gov/vacode/...section19.2-8/

Are you sure of the jurisdiction? Roanoke County? Roanoke City? Botetourt County? The Clerk would be the best source to give an idea of the timeframe, but since she doesn't know, I'd call the Commonwealth's Attorney and ask them. Just tell them you want to close the thing out, that's not a commitment, but a reason for calling if they ask.

There is no way to tell what's the reason for a delay, maybe they decided not to turn it in; or call the officer, but I wouldn't do that. A FOIA request isn't out of the question, but again, I wouldn't do that either. Exactly who issued the ticket? State Police, the police, the sheriff?

It's not out of the question to call a speeding ticket attorney. The alleged offense is not backed up by radar. You do not have to prove you are innocent, they have to prove you are guilty. While a ticket can be just a nuisance, depending on a person's work, it can present issues.

It says Botetourt County Sheriff's office. I called 540-473-8244 and the clerk indicated the case was not there in the system yet.

No, it is not for overspeeding. It is for "Improper Driving" VA code 46.2-864 and local code 13-7. The officer indicated it was not a misdemeanor, but I could pay the fine. Of course, I was upset as it was a clear a money milking scheme at play from out-of-state drivers ( apologies to VA residents, but it is what many outside-state drivers feel going through VA)

The summons was issued by the Botetourt County Sheriff's Office.

I could not find the case on the court Web site. So not sure what is going on.

Today I got a letter dated 09/18/2023 with a backdated hearing from the deputy county clerk. I could not understand much hence any help is appreciated. I am going to call them anyway, but trying to understand and have some information handy

Perhaps your being stopped was meant to be a warning?

This used to happen when I was younger as a way to remind drivers who weren’t immediately endangering others that there were laws that required them to be more attentive and precise.

But those were actually handed out to the driver on the ticketing form with a handwritten statement. If you subsequently were stopped for the same issue within a certain period it would generate an official ticket.

I called the county clerk.And she said the case was dropped and no fine either. I asked if there was a reason as if I am so inclined to pay the fine. she told she would not know

As mentioned, if the LEO actually cited you for Improper Driving (46.2-864), the case was probably dropped as they can't write that offense.
