Violation 37 N: 3-307.11 Miscellaneous Sources of Contamination.
Several cans of soda and water, which are for personal use, are stored in the bakery refrigerated display case.
FOOD shall be protected from contamination that may result from a factor or source not specified under Subparts 3-301 - 3-306.
Violation 45 I: 4-101.111 Nonfood-Contact Surfaces.
A shelf located in the deli dept. used for storage of soups, beans, gravy, etc. is rusty.
NonFOOD-CONTACT SURFACES of EQUIPMENT that are exposed to splash, spillage, or other FOOD soiling or that require frequent cleaning shall be
constructed of a CORROSION-RESISTANT, nonabsorbent, and SMOOTH material.
Violation 46 E: 4-501.17 Warewashing Equipment, Cleaning Agents.
Replace an empty bottle of detergent at produce 3-compartment sink.
When used for WAREWASHING, the wash compartment of a sink, mechanical warewasher, or
wash receptacle of alternative manual WAREWASHING EQUIPMENT as specified in ¶
4-301.12(C), shall contain a wash solution of soap, detergent, acid cleaner, alkaline
cleaner, degreaser, abrasive cleaner, or other cleaning agent according to the cleaning
agent manufacturer’s label instructions.
Violation 35 A: WFC 3-602.11 Food packaged in a food establishment, shall be labeled as specified in law, including 21 CFR 101 - Food
Labeling, and 9 CFR 317 Labeling, Marking Devices, and Containers.
The following food products are not properly labeled: Chicken crunch, tuna spread, chicken salad, cinnamon rolls, carrot cake slices, apple pie
slices, etc.
Label information shall include:
(1) The common name of the food, or absent a common name, an adequately
descriptive identity statement;
(2) If made from two or more ingredients, a list of ingredients in descending order of predominance by weight, including a declaration
of artificial color or flavor and chemical preservatives, if contained in the food;
(3) The name of the food source for each major food allergen contained in the food
unless the food source is already part of the common or usual name of the respective
ingredient (effective January 1, 2006).
Note: Under the Food Allergen Labeling and Consumer Protection Act (FALCPA), a
"major" food allergen" is an ingredient that is one of the following eight foods/food
groups or is an ingredient that contains protein derived from one of the following: Milk
and milk products (whey, nonfat dry milk, casein, sodium caseinate, etc.); eggs
(albumen, whites, meringue, etc.); fish (bass, flounder, cod, etc.); crustacean shellfish
(crab, lobster, shrimp, etc.); tree nuts (almonds, walnuts, pecans, etc., each is a
separate allergen); wheat and wheat proteins (malt, caramel color, flour, etc.); peanuts
(peanut butter, unrefined peanut oil, flour, etc.); and soybeans and soy products
(hydrogenated soy protein, tofu, unrefined soybean oil, etc.).
(4) An accurate declaration of the quantity of contents;
(5) The name and place of business of the manufacturer, packer, or distributor; and
(6) Except as exempted in the Federal Food, Drug, and Cosmetic Act § 403(Q)(3)-(5),
nutrition labeling as specified in 21 CFR 101 - FOOD Labeling and 9 CFR 317 Subpart
B Nutrition Labeling.
(7) For any salmonid fish containing canthaxanthin as a color additive, the labeling of
the bulk fish container, including a list of ingredients, displayed on the retail container or
by other written means, such as a counter card, that discloses the use of canthaxnthin.
Violation 35 D: Qualifying Statements
All products must be labeled the same as they come in from the federal -or state-inspected plant.
If you slice or repackage state - or federally-inspected products, you must transfer the information from those products to your label. The
state or federal legend may not be transferred to products that are repackaged or further processed (sliced).
Ham and Picnic Products
Badger ham is labeled as “boiled ham”. (See deli display case).
* Ham products must be identified as one of the four following products:

The following baby formulas are sold beyond it’s coded date of expiration: 17-13 oz. cans of Similac(use by dates of Oct. and Dec. 1, 2008). 8-
13 oz. cans of Enfamil(use by date of Jan. 1, 2009).
(A) If required by LAW, CONSUMER warnings shall be provided.
(B) FOOD ESTABLISHMENT or manufacturers’ dating information on FOODS may not be concealed or altered.
(C) Infant formula may not be sold or offered for sale after the code date specified by the
manufacturer on the infant formula label.
Outdated baby formulas have been removed from sale.
Violation 47 A**: 4-601.11 Equipment, Nonfood-Contact Surfaces
Honeycomb vents at salads to go and bottom vents at biscuit, yogurt and Claussen pickles are soiled.

**CDC Risk Factor Violation 06 C**: 2-301.14 When to Wash Hands.
FOOD EMPLOYEES shall clean their hands and exposed portions of their arms as specified
under § 2-301.12 immediately before engaging in FOOD PREPARATION including working with exposed FOOD, clean EQUIPMENT and UTENSILS, and
unwrapped SINGLE-SERVICE and SINGLE- USE ARTICLES and:
(A) After touching bare human body parts other than clean hands and clean, exposed portions
of arms;
(B) After using the toilet room;
(C) After caring for or handling SERVICE ANIMALS or aquatic animals as specified in ¶
2-403.11(B);
(D) Except as specified in ¶ 2-401.11(B), after coughing, sneezing, using a handkerchief or
disposable tissue, using tobacco, eating, or drinking;
(E) After handling soiled EQUIPMENT or UTENSILS;
(F) During FOOD PREPARATION, as often as necessary to remove soil and contamination and to prevent cross contamination when changing tasks;
(G) When switching between working with raw FOOD and working with READY-TO-EAT FOOD;
(H) Before putting on gloves for working with FOOD; and
(I) After engaging in other activities that contaminate the hands.
Complaint Details: The meat cutter(Howie) that waited on the complainant had emptied the garbage can and returned to the meat display case and
was handling meats without washing hands.
Violation 31 C: 3-501.11 Refrigerated food stored above the air flow line. Packages of sausages and cheese are stored beyond manufacturer’s
recommended storage line. Store food products below the air flow line.

Complaint Details:
Customer had purchased a package of whole cut up chicken (Smart Chicken Brand) and veal soup bones. She stated that both packages had foul
odor.
Investigation Findings:
-Random packages of Smart chicken Brand and veal soup bones were opened. Foul odor was not present in any of the packages.
-Sell by dates on the packages were July 11,10.
-Temperature in the self-serve meat case was recorded at 34f.
-No other complaints were received by the establishment.

range of use.
