Our Department received a complaint from a customer who purchased (2) tuna subs on Saturday 1-30-09. She ate one and saved the other for the
next day. She became ill Sunday 2-1-09 1/2 hour after eating the second sandwich. She reports eating dinner at another establishment on Friday
1-30-09.
* A full inspection of this establishment was made on 2-4-09. At the time of that inspection, no violations were noted.
* The Restaurant has a written employee health policy. It is posted and all employees must sign off on it.
* The Manager states that to his knowledge, no employees were sick during the period in question.
* During this visit, I was able to observe the mixing of the Tuna Salad. What I observed was done in accordance with Food Code requirements.
* This is the only complaint received by our Department or the Restaurant.
Food contact equipment is stored underneath food preparatory sink waste line.
Violation 43 D: 4-903.11 Equipment, Utensils, Linens, and Single-Service and Single-Use
Articles.
(A) Except as specified in ¶ (D), cleaned EQUIPMENT and UTENSILS, laundered LINENS, and
SINGLE-SERVICE and SINGLE-USE ARTICLES shall be stored:
(1) In a clean, dry location;
(2) Where they are not exposed to splash, dust, or other contamination; and
(3) At least 15 cm (6 inches) above the floor.
(B) Clean EQUIPMENT and UTENSILS shall be stored as specified under ¶ (A) and shall be
stored:
(1) In a self-draining position that allows air drying; and
(2) Covered or inverted.
(C) SINGLE-SERVICE and SINGLE-USE ARTICLES shall be stored as specified under ¶ (A) and shall be kept in the original protective PACKAGE or
stored by using other means that afford protection from contamination until used.
(D) Items that are kept in closed PACKAGES may be stored less than 15 cm (6 inches) above
the floor on dollies, pallets, racks, and skids that are designed as provided under §
4-204.122.

line. Kay quat sanitizer utilized: >200 ppm in sink, >200 ppm in towel buckets. Date marking evident in refrigerator.
