Situation is I am 52 and my wife is 35 that never worked in the USA, that is a legal Immigrant with a green card, working towards getting USA citizenship in a few years.
If I die before I collect SS at age 62, will my wife be able to collect any SS from my account at that time, or on my account when she turns 62?
What about if this happens after I am collecting SS at 62, will she be able to collect SS from my account or does she have to wait till she is 62, or would she have to have been 62 and already collecting from my SS?
Just wondering how my wife will survive after my departure when my pension will stop, and any SS I might be collecting at the time...
I am just guressig from what I have read before on similar situations. That is that illegals or people living in other coutries collected on social security under the law.I never read anything but spouse on survivor benefits. Why not call SS or go to the office and ask.

Assuming she otherwise qualifies for survivor benefits, she will not be eligible to collect on your account until she is either 60 years old, or if she is disabled, age 50. (Assuming the two of you have no minor children).

The above rules apply to ALL Survivors. If you die before she obtains citizenship, I think she will also need to prove she has legally resided in the U.S. for 5 years AND that the two of you were married during that time period. Here's the link: http://www.ilw.com/immigrationdaily/...1,0607-crs.pdf
In general, a surviving spouse can start collecting benefits at age 60. (As I am) If there are children under 16 or disabled, then there is no age requirement.
Its far more of a cut then most who file early realize their spouse will get in survivor benefits.
The dilema is those that can least afford it are those who file early for various reasons. They then even leave their spouse worse off especially if they have to file early too.
The best advice I can give is to tell her to start working now and work all long as she can and save every penny she earns. Invested in a fund appropriate. As you progress through time and age and you see how your situation rotates through your age vs hers you will understand what I say.
Unless you have children under 16, she has to be 62 or older.
Kind of an odd question to throw in, it's not like you get to choose whether you'll be getting SS or SSDI. Apples and oranges.
