I just spoke to Roya, update is that all the houses are in contract and they will be closing soon.

ok so I feel extremely uneasy about the professionalism and integrity of how this was handled. I'm thinking of contacting HDC, HPD and the city of New york regarding this developer if i do not hear from them in the correct fashion that is stipulated by the those programs. I am VERY familiar with the process and regulations. There is NO WAY someone can be approved and rejected without your income/loan status changing. Also regarding the subsidy they have pre determined allocations for each property and they should have approved the individuals on the log before you and determined their subsidy before you were given approval. It sounds more like they bumped you for another reason. I know several people who have applied over the years and bought houses this way and NEVER has this occurred.

Sorry for chiming in late to this Party.

I was just emailed privately regarding this blog.

Clearly, the developer should have communicated better.

IMO, the developer probably interviewed way more applicants than needed and didn't initially disclose the applicants' position in order of the lottery log (based on the various preferences).

If an applicant was determined to be "Eligible" for the subsidy, but was not the next applicant according to the log; they should be told where they are in order (as a courtesy). That position relative to others would not be specified in a letter however.

If a mistake is made, the easiest way to deal with it would be to immediately own up, explain, and move forward. Further, when there are so few units, conducting mass interviews can be problematic.

Finally, if the developer sought an approval of a "Preliminary Eligible " applicant and submitted the file for Public Agency approval, the Agency would have no reason to question whether lower log # applicants were deemed Preliminary Ineligible unless they were notified of an "Appeal" of the ineligible status. In this instance, the agency would direct the developer to hold a home available until a FINAL Eligibility determination was made by HPD.

All that being said, I've been Selling through the lottery process since 1986 and it is indeed an arduous process. Generally, there is no impropriety just poor communication and processing errors which leads to minor backtracking. This may be very upsetting for those affected, hence the need for more/continuous face-to-face ("Sales") with Applicants.

This rant may not answer your questions, but I hope it provides additional understanding of the process.

What you said make sense, if in case a mistake was made and one should own up.
But when developer changed story about what happened and not enable to provide a simple email or letter to describe what happened when requested, it created more confession and made it seems like that they are up for no good.
However, in my case, it is not just communication. They did not follow procedure, I was offered a home with contract and then they backed out. So was I ever in the system, final eligibility or they just messed up pretty bad and found out the last second and kicked me out of the line.

As you said you been selling since 1986, wasn't there ever a HPD agency oversee the whole process, from what I have been reading on this site, the process is pretty broken, developer had all/most of the control. It can easily create an unfairness situation with a heart beat.

By any chance do you know if the city improving the lottery system anytime soon? make it more transparent to the applicants?
