Should my new uc claim be deferred?

I lost my job the end of may 2012. I filed for unemployment in pennsylvania and they found me finacially ineligible. But since i had a previous claim with a bye date of 2008 i qualified under the Supplemental Appropriations Act, 2008. I started receiving euc benefits and got paid 8 weeks of euc. Then i received letter from labor and industry stating i was overpaid by 3 weeks of euc. They stated that i was able to open new claim july 1st. so i was no longer eligible for euc. Now according to all other paperwork that labor and industry had sent me it states that i can deferr my new claim and continue with the euc. Now they are fighting me on it and already taking overpayments out of me on the new claim. Am i wrong on beleiving my new claim should be deferred? Can someone please clarify this problem for me?
