Actually this sounds more like a discussion for the Unemployment subforum. Your questions seem to be more about unemployment eligibility and compensation, not going back to work. If I understood this correctly, her original full time job was the one that FMLA was preserving. She doesn't want a job under those terms now, she wants something different. Then when all parties signed that agreement, she turned down the position that existed. That could affect what unemployment benefits she is entitled to.
So, ultimately she agreed to come back on a part time basis but one of the new workers refused to work with her. In a sense, she was let go but did refuse going back to the position she left when the negotiations went south. Does the fact that they wouldn’t allow her to come back part time or full time work in her favor in regards to unemployment? There is no actual documentation that the current person employed their refused to work with my wife which is why they wouldn’t allow her to come back at all. Although she does have in writing they would not contest unemployment benefits... will that hold up? I guess is ultimately my question?! Thanks
