Purpose of this inspection was in response to a call from the Fire Department reporting odor and noxious gas in the restaurant. HAZMAT team was called in but could not identify the cause of the odor/gas. HAZMAT team ruled out either a gas leak or sewer leak but the Fire department suspected a freon leak but could not pin point exact location. According to the Fire Department one person an employee reported getting sick and was rushed to hospital. Restaurant had closed voluntarily as a precaution. EHS arrived at the scene and traced smell to the back of the ice cream making machine (possible compressor leak). EHS requested person in charge to open drive through window and main door to allow fresh air in. After about 40 minutes the smell disappeared and while still typing report, the employee who had been taken to hospital reported back to work saying she had been advised that she was fine. Ice cream making machine has been unplugged from power, advised PIC to take it outside and reopen restaurant.

The purpose of today's visit was to conduct a risk factor assessment inspection in conjunction with a complaint investigation. A complaint was received by the Health Department on September 3, 2013. The complainant visited this facility around 12:30 am on September 1, 2013. The complainant alleges that a smoothie was ordered and that an object that looked like rodent feces was found in the drink. EHS spoke to the district manager on the facility phone during the inspection. The District Manager was aware of the complaint and shared that she had spoken to the complainant on the phone today and resolved the customer's concern. The shift manager brought the EHS the alleged drink that was returned by the complainant. EHS observed a half full mango smoothie with multiple small brown particles floating throughout the smoothie. On the inside bottom of the smoothie drink, EHS observed three larger size brown particles that appeared to be parts of chocolate chips. If the drink observed during today's inspection is in fact the same drink that the complainant returned the brown particles appear to be pieces of chocolate chips. The same blender is used for fruit smoothies and McCafe drinks. EHS observed multiple chocolate chips in the drain of the blender spray washer. Manager shared that the drain is cleaned at least once a day and the blender is changed and/or washed, rinsed and sanitized every four hours. EHS observed contracted pest control reports. The purpose of today’s visit was to conduct a routine inspection. Renovations completed October 2012. Several certified food managers on staff. EHS provided manager with updated Employee Health handouts in English and Spanish for future use with any new employees. MAINTENANCE: *Water Heater: Bradford White EF100T199E3NA which uses 199,999 BTU with posted recovery rate of 238.8 GPH *Dish Machine: N/A Observed facility clean and organized.
