    Correction: Surfaces such as cutting blocks and boards that are subject to scratching and scoring shall be resurfaced if they can no longer be effectively cleaned and sanitized, or discarded if they are not capable of being resurfaced. Cutting surfaces such as cutting boards and blocks that become scratched and scored may be difficult to clean and sanitize. As a result, pathogenic microorganisms transmissible through food may build up or accumulate. These microorganisms may be transferred to foods that are prepared on such surfaces.

Due to a pattern of repeated violations (Improper Cold Holding), A Notice of Violation will be issued. The NOV will be hand delivered. A follow up inspection will be conducted in 30 (thirty) days on or after April 3, 2015.
  • Time/Temperature Control for Safety Food, Cold Holding (corrected on site) (repeated violation)
    Observation: Observed foods cold holding at improper temperatures in the two door upright reach-in (R-15) and two door prep unit (R-13) on the cookline. Foods were observed at 45-49 F. All foods above 41 F were discarded and all others were moved to other refrigeration units.

    Correction: Except during preparation, cooking, or cooling, or when time is used as the public health control as specified under section 3-501.19, and except as specified under paragraph (B) of this section, time/temperature control for safety food shall be maintained at 5ºC (41ºF) or less. Bacterial growth and/or toxin production can occur if time/temperature control for safety food remains in the temperature "Danger Zone" of 5ºC to 57ºC (41ºF to 135ºF) too long. Up to a point, the rate of growth increases with an increase in temperature within this zone. Beyond the upper limit of the optimal temperature range for a particular organism, the rate of growth decreases. Operations requiring heating or cooling of food should be performed as rapidly as possible to avoid the possibility of bacterial growth.

    Correction: Equipment shall be maintained in a state of repair and condition that meets the requirements specified under Parts 4-1 [Materials for Construction and Repair] and 4-2 [Design and Construction]. Proper maintenance of equipment to manufacturer specifications helps ensure that it will continue to operate as designed. Failure to properly maintain equipment could lead to violations of the associated requirements of the Code that place the health of the consumer at risk. For example, refrigeration units in disrepair may no longer be capable of properly cooling or holding potentially hazardous (time/temperature control for safety) foods at safe temperatures.

    Correction: Floors, floor coverings, walls, wall coverings, and ceilings shall be designed, constructed and installed so that they are smooth and easily cleanable except for anti-slip floor coverings or applications that may be used for safety reasons and except as specified under section 6-201.14. Floors that are of smooth, durable construction and that are nonabsorbent are more easily cleaned. Requirements and restrictions regarding floor coverings, utility lines, and floor/wall junctures are intended to ensure that regular and effective cleaning is possible and that insect and rodent harborage is minimized.

Insects and other pests are capable of transmitting disease to man by contaminating food and food-contact surfaces. Effective measures must be taken to control their presence in food establishments.

    Observation: Observed floors and walls under and behind equipment are not cleaned as often as necessary to keep them clean.

A regular cleaning schedule should be established and followed to maintain the facility in a clean and sanitary manner.

Today a follow-up inspection was conducted for the Notice of Violation (NOV) issued on 10/02/2014. Substantial compliance observed. The 2-door Traulsen reach-in refrigerator has been taken out of service and is currently not being used to store food product. According to the manager the unit is still due to be replaced and/or repaired.
No violation noted during this evaluation.
10/31/2014Follow-up
The chlorine concentration in the warewashing machine was measured for proper concentration using the provided test strips (50 ppm - 100 ppm). The automatic cleaning system in the kitchen hood ventilation was observed leaking. The food product that was on the cook-line at the time was discarded and the floors were cleaned by the maintenance personal during time of inspection. The Director of Operations, the Food and Beverage Director, along with other members of the kitchen staff were present to handle the situation. Cold holding equipment must maintain TCS food product at 41 F or below. Due to the pattern of violation, a Notice of Violation (NOV) will be issued. A follow-up will be conducted on or about October 31, 2014. Do not store TCS Food Product in the 2-door cook-line refrigerator that was observed cold holding above 41 F. Repair and/or replace the unit to cold hold properly.

    Observation: Eggs, sliced cheese, deli ham, observed cold holding at the improper temperature in the 2-door Traulsen reach-in refrigerator (45 F - 48 F). Product was taken out of the walk-in refrigerator this morning at 41 F according to the manager, so the product was relocated to another refrigeration unit.
    Correction: Except during preparation, cooking, or cooling, or when time is used as the public health control as specified under section 3-501.19, and except as specified under paragraph (B) of this section, time/temperature control for safety food shall be maintained at 5ºC (41ºF) or less. There was no asterisk observed in front of the menu items that may be served raw and/or undercooked.
    Correction: The permit holder shall inform consumers of the significantly increased risk of consuming such foods by way of a disclosure and reminder, as specified in paragraphs (B) and (C) of this section using brochures, deli case or menu advisories, label statements, table tents, placards, or other effective written means. (B) Disclosure shall include: (1) A description of the animal-derived foods, such as "oysters on the half shell (raw oysters)," "raw-egg Caesar salad," and "hamburgers (can be cooked to order);" or (2) Identification of the animal-derived foods by asterisking them to a footnote that states that the items are served raw or undercooked, or contain (or may contain) raw or undercooked ingredients. (C) Reminder shall include asterisking the animal-derived foods requiring disclosure to a footnote that states: (1) Regarding the safety of these items, written information is available upon request
