The above observations and the following were discussed with the person in charge:
-Please notify the health department once the dishmachine has been repaired.
-A bar has been added to the other side of the facility and a wall was removed. No approval was provided from the health department prior to the installation of the bar area. This is no longer permitted as a smoking establishment. The PIC stated that smoking is only conducted on the outside of the establishment.
-Additional prep cooler not in operation at the time of inspection.
-Handwashing signs provided.

    Observation: Observed that foods in the reach in coolers and freezers were not protected from contamination because they were not in packages, covered containers, or wrapped.
    Correction: Prevent contamination by storing food in packages, covered containers, or wrappings.
  • Equipment - Fixed Equipment, Spacing or Sealing (repeated violation)
    Observation: The 3 compartment sink and handsink in the back of the kitchen and the handsink in the ladies restroom are no longer sealed to adjoining equipment or walls.
    Correction: Seal the unit to adjoining equipment or walls since it is exposed to spillage or seepage.

    Observation: Several plastic food storage containers were observed in a state of disrepair and damaged. Containers observed to be cracked and broken or melted.
    Correction: Repair/replace the equipment to restore a state of condition that allows for proper operation, accuracy, functioning, maintenance, and cleanability.

    Observation: The following equipment food-contact surfaces were observed soiled to sight and touch: 1. the slicer blade and surrounding areas 2. the can opener blade.
    Correction: Clean and sanitize these surfaces for food contact.

    Observation: The food-contact surfaces of equipment were not observed sanitized. The bleach sanitizer in the dishmachine measured at 0 ppm during the inspection. The PIC contacted the repair company during the inspection and all equipment will be manually sanitized until repairs have been made.
    Correction: After cleaning and rinsing of the food-contact surface, the surface shall be effectively sanitized before coming in contact with food and before use.
  • Kitchenware and Tableware (repeated violation)
    Observation: Unwrapped straws were provided at the bars.
    Correction: Provide wrapped straws or an approved dispenser for straws at the bar to prevent cross contamination of multiple straws.

    Observation: Outer opening of the food establishment is not protected against entry of insects and rodents. Observed gaps along the sides of both back doors of the establishment.
    Correction: Protect the food establishment against the entry of insects and rodents by 1. Filling or closing holes and other gaps along floors, walls, and ceilings, 2. Closed, tight fitting windows, and 3. Solid, self-closing, tight-fitting doors. Insects and rodents are vectors of disease-causing microorganisms which may be transmitted to humans by contamination of food and food-contact surfaces.
  • Handwashing Cleanser - Availability (repeated violation)
    Observation: Soap was not provided at the hand washing sink by the bar.
    Correction: Hand soap must be provided at all hand washing lavatories to encourage proper hand washing. Hand cleanser must always be present to aid in reducing microorganisms and particulate matter found on hands.

    Observation: No disposable towels were provided at the hand washing lavatory by the bar.
    Correction: Hand drying devices such as individual disposable paper towels, a continuous towel system that supplies the user with a clean towel or heated air hand drying device must be provided at all hand washing lavatories to encourage proper hand washing and avoid employees to drying their hands on their clothing or other unclean materials

    Observation: A sign or poster that notifies food employees to wash their hands is not provided at all lavatories used by food employees. Handwashing signs provided during the inspection.
    Correction: Provide a sign or poster that notifies food employees to wash their hands at all handwashing lavatories used by food employees.
  • Lighting, Intensity
    Observation: Less than 50 foot candles of light was noted in the food prep area in the back of the kitchen. Light measured at 18 foot candles. Several blown light bulbs observed in this area.
    Correction: Provide at least 50 foot candles at a surface where a food employee is working with food or working with utensils or equipment such as knives, slicers, grinders, or saws where employee safety is a factor

The above observations and the following were discussed with the person in charge:
-Place an asterisks next to all burgers than can be served undercooked on the menu.
-Replace the covered trash can in the ladies restroom.
-Fruit Flies observed by the handsink by the bar. The PIC is working with pest control to eliminate the issue.

    Observation: Employees observed handling ready-to-eat (RTE) food with their bare hands. Observed the PIC cutting lettuce and handling ready to eat baked potatoes with his bare hands. The PIC obtained gloves both times during the inspection.
    Correction: Provide suitable utensils such as deli tissue, spatulas, tongs, single-use gloves, or dispensing equipment to handle RTE food to prevent contamination from hands.
  • Critical: Food - Packaged and Unpackaged - Separation, Packaging, and Segregation* (corrected on site)
    Observation: Different types of raw animal foods stored in such a manner that may cause cross contamination. Observed raw hamburger stored over raw beef in the reach in cooler.
    Correction: Separate types of raw animal foods from each other such as beef, fish, lamb pork, and poultry during storage, preparation, holding, and display by the following: (a) Using separate equipment for each type. (b) Arranging each type of food in equipment so that cross contamination of one type with another is prevented. (c) Preparing each type of food at different times or in separate areas.
  • Ice Used as Exterior Coolant - Prohibited as Ingredient (corrected on site)
    Observation: Ice used as a medium for cooling the exterior surfaces of food is also for drink ice or used as food. Observed lemons stored in a container in the ice used for customers drinks.
    Correction: Cease use of ice used as a cooling medium for food. Ice that has been in contact with unsanitized surfaces or raw animal foods may contain pathogens and other contaminants.
  • Utensils - In-Use - Between-Use Storage (corrected on site)
    Observation: Dispensing utensils improperly stored between uses. Observed the scoop used for dispensing butter and sour cream stored in water that was measured at 74'F. The PIC replace the water during the inspection with water measuring above 135'F.
    Correction: Store in-use utensils or dispensing utensils in one of the following manners: 1) In the food with their handles above the top of the food and the container. 2) In food that is not potentially hazardous with their handles above the top of the food within containers or equipment that can be closed. 3) On a clean portion of the food preparation table or cooking equipment only if the in-use utensil and the food-contact surface of the food preparation table or cooking equipment are cleaned and sanitized every 4 hours. 4) In running water of sufficient velocity to flush particulates to the drain. 5) In a clean, protected location if the utensils are used only with a food that is not potentially hazardous. 6) In a container of water if the water is maintained at a temperature of at least 135°F.
  • Food Storage - Clean and Dry Location
    Observation: Observed foods stored uncovered in the reach in freezer and reach in cooler.
    Correction: Store food where it is not exposed to splash or install an approved durable, and cleanable barrier between the splash source and the food to prevent contamination.
  • Critical: Date Marking - Ready-to-Eat - Potentially Hazardous Food - Date Marking* (repeated violation)
    Observation: The prepared ready-to-eat (RTE) foods in the refrigeration units are not properly dated for disposition. Observed cooked chicken wings, ribs, potatoes and chili stored in the coolers without being dated.
    Correction: Mark the name and "consume by" date on the container of RTE foods at the time of preparation if the food is to be held for more than 24 hours. If the food is held at 41°F or below the food shall be served or sold within 7 calendar days. Some harmful bacteria continue to grow even at refrigeration temperatures so limiting the amount of time in storage limits the amount of growth allowed for these bacteria.

    Correction: Resurface or discard and replace the cutting boards to provide a food contact surface that is smooth, easily cleaned and sanitized.

    Observation: Unwrapped straws were provided at the bar.
    Correction: Provide wrapped straws or an approved dispenser for straws at the bar to prevent contamination of multiple straws.

    Observation: The handwashing facility located in between the bar and the kitchen is blocked, preventing access by employees for easy handwashing.
    Correction: Access to the handwashing facility identified above is to be available during all hours of operation. Remove any equipment preventing its use.

    Observation: Soap was not provided at the hand washing lavatory in the bar.

    Correction: Maintain physical facilities in good repair. Poor repair and maintenance compromises the functionality of the physical facilities.
  • Physical Facilities - Cleaning Frequency and Restrictions
    Observation: The floors under and behind equipment noted in need of cleaning.
    Correction: All floors, walls, and ceilings must be cleaned as often as necessary to keep them clean. Cleaning of the physical facilities is an important measure in ensuring the protection and sanitary preparation of food. A regular cleaning schedule should be established and followed to maintain the facility in a clean and sanitary manner.
03/31/2015Routine
The above observations and the following were discussed with the person in charge:
-Employee health policy discussed.
-Apparent fruit flies observed by the handsink in the front of the kitchen. PIC is working with pest control operators to resolve the issue.
-Several stained and buckled ceiling tiles observed throughout the dining areas, replace as needed.
-Facility added an additional dining area. The facility is to remain non-smoking at this time. No food is to be prepared in the storage area behind the dining room. If facility plans to prepare foods in this area a handsink must be provided and the ceiling tiles need to be replaced with tiles that are smooth and easily cleanable.
-Reseal the handsink across from the food prep area to the wall. Replace the door gasket on the reach in cooler by the grill.
-Bleach sanitizer in the dishmachine measured at 100 ppm.
The person in charge was very complaint and willing to make several corrections throughout the inspection, thanks!

    Observation: Unlabeled food containers. Bulk containers of sugar and flour stored in the storage area and on the prep table.
    Correction: Label working containers with the common name of its contents. Consumers may be allergic to certain foods or ingredients. The mistaken use of an ingredient when the consumer has requested that it not be used may result in severe medical consequences. Liquid foods and granular foods may resemble cleaning compounds. The mistaken use of food from an unlabeled container could result in chemical poisoning.
  • Critical: Food Contact with Equipment and Utensils* (corrected on site)
    Observation: Per conversation with the person in charge, all in use utensils are being washed rinsed and sanitized or changed out once per day after each shift. Discussed cleaning and sanitizing procedures of in use utensils with the person in charge during the inspection.
    Correction: Use only cleaned and sanitized utensils or equipment during food preparation. All in use utensils need to be washed, rinsed and sanitized or changed out at least once every 4 hours.
  • Critical: Food - Potentially Hazardous Food - Cold Holding* (corrected on site)
    Observation: The following foods were observed to be cold holding at improper temperatures. The cooked chicken wings (52'F), raw chicken (54'F) and sliced tomatoes (54'F) stored in the prep cooler across from the fryer were not measured at 41'F and below. PIC discarded all foods during the inspection.
    Correction: Relocate food to a refrigeration unit that is capable of maintaining food storage at 41°F or below.
  • Critical: Date Marking - Ready-to-Eat - Potentially Hazardous Food - Date Marking* (corrected on site) (repeated violation)
    Observation: The prepared ready-to-eat (RTE) foods in the refrigeration units are not properly dated for disposition. Facility is not date marking any foods being held longer than 24 hours. Discussed date marking foods with the person in charge.

    Correction: Nonfood contact equipment that is exposed to splash, spillage, food soiling, or requires frequent cleaning must be smooth, durable, and nonabsorbent.
  • Refuse - Maintaining Refuse Areas and Enclosures
    Observation: Grease was observed adjacent to the grease receptacle outside the facility.
    Correction: The grease receptacle storage area and grounds adjacent to the container are to be maintained clean and sanitary.

    Observation: Light bulb in the kitchen are not shielded, coated, or otherwise shatter-resistant.
    Correction: Shield or replace light bulb with a coated or shatter-resistant bulb.

The above observations and the following were discussed with the person in charge:
-Leak observed in the basin of the handsink in the front of the kitchen. PIC stated that this handsink only leaks when the water is constantly ran. Water needs to run for a period of time to ensure it gets hot. Repair as needed.
-All in use utensils are being washed, rinsed and sanitized or changed out at least once every 3 hours.
-Employee health policy observed, handout provided.
-The person in charge had a ServSafe certification, handout provided regarding recertification.
The PIC was preparing foods throughout the inspection and could not make several corrections to the report.
The bleach sanitizer in the dishmachine measured at 50 ppm during the inspection.

    Observation: The bleach sanitizer that is being applied to food contact surfaces does not meet the requirements. Observed the bleach sanitizer in the sanitizer buckets throughout the facility to be measured at >200 ppm. All buckets were corrected to 100 ppm during the inspection.
    Correction: Utilize only bleach sanitizer that meets the requirements when applying to food contact surfaces.
