This was a routine inspection. Correct all violations immediately or as soon as possible. During this inspection it was observed that a certified food manager was not on premises and as a result the restaurant was ordered to cease operation until a certified person was available. This is a repeated violation. A certified person arrived during the inspection. She was advised to have additional certified food managers so that one is available on premises at all times during operation of the restaurant. The restaurant was approved to resume operation. and the permit was reinstated.
The certified food manager was also advised to provide a thermometer in each of the flat top prep coolers to monitor the ambient temperature of these units.

  • Utensils That are In-Use / Between-Use Storage (corrected on site)
    Observation: Dispensing and/or in-use utensils improperly stored between use as follows: Ice scoop on the ice with the handle in contact with the ice at the ice bin station.
    Correction: During pauses in food preparation or dispensing, food utensils shall be stored in one of the following manners: 1) in the food with their handles above the top of the food and the container, 2) in food that is not potentially hazardous (time/temperature control for safe food) with their handles above the top of the food within containers or equipment that can be closed, 3) on a clean portion of the food preparation table or cooking equipment only if the in-use utensil and the food contact surface of the food preparation table or cooking equipment are cleaned and sanitized, 4) in running water of sufficient velocity to flush particulates to the drain, 5) in a clean, protected location if the utensils are used only with a food that is NOT potentially hazardous (time/temperature control for safe food), or 6) in a container of water if the water is maintained at a temperature of at least 135°F and the container is cleaned frequently. Place the scoop on the ice with the handle up or [place the scoop on a cleaned and sanitized container after each use to protect the ice from being contaminated.
  • Wiping Cloths/Use Limitation/Wet Towel Storage (corrected on site)
    Observation: Wet wiping cloths used for wiping counters and other equipment surfaces were observed stored on the counter.
    Correction: Wet wiping cloths are to be used for wiping counters and other equipment surfaces and are to be held in a chemical sanitizer solution at the appropriate concentration between uses.
  • Food Storage / Preventing Contamination
    Observation: Food stored on the floor and/or food stored less than 6 inches off the floor ionside the walk-in freezer.
    Correction: Food shall be protected from contamination by storing the food at least 6 inches off the floor on approved shelving units or dunnage racks. Milk crates, soda crates, or bread racks are not suitable for food storage.
  • Critical: Date Marking of Refrigerated, Ready-to-Eat PHF (TCS Food) (corrected on site)
    Observation: The following refrigerated, ready-to-eat, potentially hazardous food that is commercially processed is not used or discarded within 24 hours of when the original container was opened and is not observed to be date marked:Tazaiki sauce
    Correction: Refrigerated, ready-to-eat, potentially hazardous commercially processed foods when opened and kept for more than 24 hours cannot have a shelf-life of more than 7 days, including the day of the original container was opened. These food items must be marked with either the "consume-by" date and/or "preparation" date, color-coded labels, or another marking system/method that effectively indicates shelf-life that is clearly understood and properly used by the employees. This date cannot exceed any manufacturer determined "use-by" date based on food safety.(sauce discared)
  • Temp Meas Devices for Cold & Hot Hold Equipment, Present (repeated violation)
    Observation: There was no temperature measuring device located in the following cold or hot holding equipment: All three prep coolers.
    Correction: Cold or hot holding equipment used for the storage of potentially hazardous foods (time/temperature control for safety food) shall be designed to include and shall be equipped with at least one integral or permanently affixed temperature measuring device that is located to allow easy viewing of the device's temperature display.
  • Equip/Utensils/Linens/Single-Service/Elevation (corrected on site) (repeated violation)
    Observation: Beverage cups, straws and other single service articles were observed stored directly on the floor under the serving counter.
    Correction: All single service articles are to be stored off the floor to protect them from contamination.
  • Critical: Certified Food Manager/Presence Required (corrected on site) (repeated violation)
    Observation: There is no Certified Food Manager present in the establishment.
    Correction: It shall be unlawful to operate a food establishment unless it is under the immediate control of a certified food manager. It is highly suggested that you have more than one employee with the food manager's license. ORS Interactive, Inc. (see handout provided) issues the required photo identification card with proof of successful completion of a certified food manager's exam. Failure to have a certified food manager on site during ALL hours of operation including food preparation, food service, and cleaning/sanitizing of equipment/utensils will result in closure of the establishment.
  • Critical: Fairfax County Code/Closure Order for No CFM or No Permit/Due Process (corrected on site)
    Observation: The establishment has been ordered to close due to the lack of a Certified Food Manager. The establishment shall remain closed until there is a Certified Food Manager on premises.
    Correction: Please notify me when a Certified Food Manager is present at the establishment. You may not operate until the Health Department reinstates the permit to operate. A follow-up inspection will be conducted within ten (10) days to verify the presence of a Certified Food Manager.

  • Temp Meas Devices for Ambient Air Location (corrected on site)
    Observation: The temperature measuring device in the following mechanically refrigerated unit was not properly located in the warmest part of the unit: 3dr smoothie prep refrige
    Correction: In a mechanically refrigerated unit the sensor of a temperature measuring device shall be located to measure the air temperature of a simulated product temperature in the warmest part of the refrigerator. Store the thermometer near the door of the unit. ( thermometer relocated to the front section of the refrige).
  • Temp Meas Devices for Cold & Hot Hold Equipment, Present (repeated violation)
    Observation: There was no temperature measuring device located in the following cold holding equipment/3-dr sandwich refrige and 1-dr sandwich refrige.
    Correction: Cold or hot holding equipment used for the storage of potentially hazardous foods (time/temperature control for safety food) shall be designed to include and shall be equipped with at least one integral or permanently affixed temperature measuring device that is located to allow easy viewing of the device's temperature display.
  • Sanitizer Test Kit Required
    Observation: A proper test kit is not located in the facility for monitoring the concentration of the chemical sanitizing solutions.
    Correction: Obtain a QUATERNARY AMMONIUM COMPOUND /QAC test kit. Thye chlorine test kit on premises is not the proper test kit for the sanitizer being used on premises.
  • Equip/Utensils/Linens/Single-Service/Elevation (corrected on site)
    Observation: Boxes of straws observed stored on the floor under the serving counter
    Correction: Keep all single service utensils off the floor to protect them from contamination. (straw were elevated off the floor)
  • Permit to Operate Required, Must be Posted, Must be Valid (corrected on site) (repeated violation)
    Observation: The establishment has not posted the permit to operate in a conspicuous location.
    Correction: No person shall operate a food establishment unless that person possesses a valid permit issued by the Director. Only a person who complies with the requirements of this Chapter shall be entitled to receive or retain such a permit. Permits are not transferable from one owner to another. A valid permit shall be posted in every food establishment in a conspicuous place in the public view. Food establishment permits are issued for a calendar year and expire on December 31 regardless of the month of issue. (permit posted on wall near cashier's counter)

    Observation: There is no Certified Food Manager present at the beginning of the inspection.
    Correction: It shall be unlawful to operate a food establishment unless it is under the immediate control of a certified food manager. The purpose of this visit was to conduct a routine inspection.
Environmental health specialist (EHS) discussed the public health rationale about proper handwashing. EHS discussed proper method to air dry and how to calibrate a thermometer.

    Observation: Absence of no-smoking signs or international no-smoking signs in non-smoking area.

  • Critical: Hands and Arms / Cleaning Procedure (corrected on site)
    Observation: Observed food employees using not using soap to hand wash.
    Correction: Food employees shall wash their hands and exposed portions of their arms by: 1) discarding used gloves
  • Critical: Handwashing / When to wash hands (corrected on site)
    Observation: A food employee failed to wash his or her hands before engaging in food preparation, before and after putting on gloves, or after engaging in any activity that could contaminate the hands.
    Correction: ALL food employees shall wash their hands OFTEN especially after handling trash, using the restroom, handling raw meats, handling soiled equipment and utensils, BEFORE putting on clean gloves, etc. Proper handwashing frequencies will aid in the reduction of foodborne illness.

    Observation: There was no temperature measuring device located in the following cold or hot holding equipment: 1dr, 2dr, and 3dr refrigeration units
    Correction: Cold or hot holding equipment used for the storage of potentially hazardous foods (time/temperature control for safety food) shall be designed to include and shall be equipped with at least one integral or permanently affixed temperature measuring device that is located to allow easy viewing of the device's temperature display.
  • Equipment & Utensils / Air-Drying or Adequate Draining Required
    Observation: Food storage containers were found stacked while wet after cleaning and chemical sanitization.
    Correction: After cleaning and sanitizing, equipment and utensils shall be air-dried or used after adequate draining before contact with food. Store food storage containers in such a way that they are drained properly before use.
  • Critical: Certified Food Manager/Presence Required (corrected on site)
    Observation: There is no Certified Food Manager present at the beginning of the inspection.
    Correction: It shall be unlawful to operate a food establishment unless it is under the immediate control of a certified food manager.     Observation: Water from the handwashing sink in the kitchen was measured at a temperature less than 100°F. The water was measured at 70 degrees.
    Correction: A handwashing sink shall be equipped to provide water at a temperature of at least 100°F through a mixing valve or combination faucet.
  • Handwashing Cleanser, Available at Handwashing Facilities (corrected on site)
    Observation: Observed that hand soap was not provided at the handwashing sink in the kitchen.
    Correction: Provide hand soap at each hand sink to allow employees to properly wash their hands.
  • Physical Facilities Good Repair
    Observation: Observed that the light bulb in the walk-in cooler is blown out and the 3vat sink water is not reaching at least 110 degrees.
    Correction: Repair the physical facilities. Poor repair and maintenance compromises the functionality of the physical facilities. Replace light bulb in walk-in cooler and repair or adjust water temperature so that all water being dispense from the faucets are reaching proper temperature.

The purpose of this visit was to conduct training based on additional information provided with an complaint.
EHS discussed employee health policy and proper handwashing procedures.
EHS discussed proper gloves use and when to change gloves.
Sanitizing procedures for food contact surfaces were discussed and EHS recommended that more sanitizing buckets are provided throughout the kitchen.

No violation noted during this evaluation.

The purpose of this visit was to conduct a follow up inspection.
EHS provided additional employee health information via email.
Manager will fax over any updated CFM cards as new employees receive the certification.

  • Critical: Responsibility of PIC to Require Food Employees to Report GI Symptoms or Cuts, Disease, Medical Condition or Exposure to PIC
    Observation: Upon discussion with the person-in-charge, one or more of the elements of an effective employee health policy is either missing or incomplete. A complete employee health policy is required to be in place at the food establishment. At the time of this inspection, the Health Department provided and reviewed handouts and resource information in a red folder labeled "Employee Health Policy.
    Correction: A complete employee health policy must have the following elements:
    1) Employee training on foodborne illness, particularly symptoms of illness and prevention of the Big Five illnesses (see "What is Foodborne Illness" handout)
  • Critical: Handwashing / When to wash hands (corrected on site)
    Observation: A food employee failed to wash his or her hands before engaging in food preparation, before and after glove use,or after engaging in any activity that could contaminate the hands.
    Correction: ALL food employees shall wash their hands OFTEN especially after handling trash, using the restroom, handling raw meats, handling soiled equipment and utensils, BEFORE putting on clean gloves, etc. Proper handwashing frequencies will aid in the reduction of foodborne illness.

    Correction: Food employees may have beverages in the kitchen areas as long as they are covered and consumed through a straw and stored in a manner that will prevent contamination to food, equipment, utensils, linens, and single service items.

    Correction: Non-food contact surfaces of equipment that are exposed to splash, spillage, or other foods that require frequent cleaning shall be constructed of a corrosion-resistant, nonabsorbent, and smooth material.
  • Food Temp Meas Device with Small-Diameter Probe, when Required
    Observation: The certified food manager could not provide a small diameter food temperature measuring device.
    Correction: A small diameter metal-stemmed probe food thermometer shall be provided and readily accessible to accurately measure the temperature of thin foods such as meat patties and fish filets.

1.The installed self-serve soda dispensing machine has short levers that may lead to saliva contamination of soda contact surfaces. Approved plans called for "Push Buttons."
2. A mop rack has not been installed.
3. A space between the right side of walk-in refrigerator and the wall has not been sealed.
*Owner shall correct the above listed items and schedule for a final follow up Health Department inspection.
