    Observation: A food employee was observed eating, smoking, or drinking in areas where they may contaminate food, clean equipment, utensils or other items needing protection.
    Correction: Food employees may only eat, drink, or use tobacco in a designated area like a dining room or office area. Employees shall not eat or drink in the kitchen areas, warewashing areas, or storage areas where items may become contaminated. food employee went to the seating area to finish eating

    Correction: The identity of the source of shellstock (oysters, clams, mussels) that are sold or served shall be maintained by retaining shellstock tags or labels and marking the tag or label with the date when the last shellstock from the container is sold or served.     Observation: Raw animal food holding in a manner that may cause cross contamination of ready-to-eat food as follows: 1) raw shrimp over lemongrass, 2)raw chicken over raw squid both in Beverage Air 2dr upright cooler
    Correction: Food shall be protected from cross contamination by separating raw animal foods like poultry, beef, pork, seafood, and eggs during holding from ALL other foods such as cooked foods, ready-to-eat foods, washed produce, etc. CFM and food employee rearranged items correctly

    Observation: The following food items that are not easily identified by appearance were observed without a label: sugar, salt, soy sauce, hoisan sauce
    Correction: Unless a food item can be easily recognized, all foods and ingredients removed from their original containers and stored in working containers shall be labeled using the common name of the food. For example: cooking oils, salt, sugar, flour, spices, herbs, etc.

    Observation: Dispensing and/or in-use utensils improperly stored between use as follows: rice scoop in standing water

    Correction: Refrigerated, ready-to-eat, potentially hazardous food (time/temperature control for safety foods) that combined with additional ingredients, or portions of the same food, must retain the date marking of the earliest or first prepared ingredient. food employee labeled items

    Observation: The food-contact surfaces of the following equipment and/or utensils are not durable: newspaper being used to cover food
    Correction: Materials that are used in the construction of utensils and food-contact surfaces of equipment may not allow the migration of deleterious substances or impart colors, odors, or tastes to food and under normal use conditions shall be durable, corrosion-resistant, and nonabsorbent.

    Observation: The food temperature measuring device was found out of calibration in the range of use.
    Correction: Food thermometers shall be calibrated in accordance with manufacturer's specifications as necessary to ensure their accuracy. It is suggested that food thermometers be calibrated at least once a week in a cup completely filled with ice and cold water to a temperature of 32°F or calibrated in a pot of boiling water at 212°F.

    Observation: The food-contact surfaces of the following equipment were not observed sanitized: bowls used to store food
    Correction: All utensils and food-contact surfaces of equipment shall be sanitized before use and after cleaning. food employee sanitized bowls

    Observation: Unwrapped knives, forks, or spoons were not stored with the handles up.
    Correction: Knives, forks, and spoons that are not prewrapped shall be presented so that only the handles are touched by employees and consumers if consumer self-service is provided.
  • Critical: Certified Food Manager/Presence Required (corrected on site) (repeated violation)
    Observation: There is no Certified Food Manager present at the beginning of the inspection.
    Correction: It shall be unlawful to operate a food establishment unless it is under the immediate control of a certified food manager. It is highly suggested that you have more than one employee with the food manager's license. ORS Interactive, Inc. (see handout provided) issues the required photo identification card with proof of successful completion of a certified food manager's exam. Failure to have a certified food manager on site during ALL hours of operation including food preparation, food service, and cleaning/sanitizing of equipment/utensils will result in closure of the establishment. The purpose of today's visit was to conduct a routine inspection.
  • Critical: Food Protection from Contamination / Separate Raw from RTE (corrected on site) (repeated violation)
    Observation: Raw animal food stored over ready-to-eat food in the following refrigeration units:
    1) Observed raw chicken being stored above curry sauce in Beverage Air 2DR upright cooler,
    2) Observed raw shell eggs being stored above noodles in True 2DR prep cooler,
    3) Observed raw chicken being stored above vegetables in True 2DR prep cooler.

    Correction: Raw foods like poultry, beef, pork, seafood, and eggs shall be stored properly inside refrigerators and freezers to prevent cross contamination. Raw foods shall be stored on shelving units BELOW or SEPARATED from all cooked foods, commercially processed foods, washed produce, leftover foods, etc.
  • Utensils That are In-Use / Between-Use Storage (corrected on site) (repeated violation)
    Observation: Dispensing and/or in-use utensils improperly stored between use as follows:-----scoop used steamed rice sitting in still room temperature water. Scooping utensils used for soups stored in room temperature water along cookline.
    Correction: During pauses in food preparation or dispensing, food utensils shall be stored in one of the following manners: 1) in the food with their handles above the top of the food and the container, 2) in food that is not potentially hazardous (time/temperature control for safe food) with their handles above the top of the food within containers or equipment that can be closed, 3) on a clean portion of the food preparation table or cooking equipment only if the in-use utensil and the food contact surface of the food preparation table or cooking equipment are cleaned and sanitized, 4) in running water of sufficient velocity to flush particulates to the drain, 5) in a clean, protected location if the utensils are used only with a food that is NOT potentially hazardous (time/temperature control for safe food), or 6) in a container of water if the water is maintained at a temperature of at least 135°F and the container is cleaned frequently.
  • Thawing / Approved Methods
    Observation: Observed the following food thawing using an improper method: -----raw chicken and cooked noodles thawing at room temperature.
    Correction: Potentially hazardous foods (time/temperature control for safety food) shall be thawed using one of the following methods: 1) under refrigeration that maintains the food temperature at 41°F or less, 2) completely submerged under running water at a water temperature of 70°F or below with a sufficient velocity to agitate and float off loose particles of food as long as held for period of time at a temperature of 41°F or less, or 3) as part of a cooking process if the food is cooked as specified by Law or thawed in a microwave oven and immediately transferred to a conventional cooking process.
  • Critical: Cold Holding of Potentially Hazardous Food at 41°F or less (corrected on site) (repeated violation)
    Observation: The following food item(s) were observed cold holding at improper temperatures using a calibrated food temperature measuring device:
    1) Garlic in oil at 68F after sitting out at room temperature overnight,
    2) Raw bean sprouts at 51F sitting on top of containers in True 2DR prep cooler,
    3) Cut tomatoes at 51F sitting on top of containers in True 2DR prep cooler,
    4) Cooked cut tofu at 51F sitting on top of containers in True 2DR prep cooler,
    5) Cooked tofu # 2 at 55F after being returned to True 2DR prep cooler after sitting out at room temperature for one hour.

    Correction: Potentially hazardous foods (time/temperature control for safety food) shall be held cold at a temperature of 41°F or below unless the permit holder is using "time as public health control" as specified under 3-501.19 to limit bacteria growth. ITEM 1 AND 5 DISCARDED. ITEMS 2-4 RETURNED TO COOLER HOLDING BELOW 41F.
  • Critical: Cold Holding of Raw Shell Eggs at Ambient Temperature of 45°F or less (corrected on site)
    Observation: Observed raw shell eggs stored at room temperature on spice cart per food employee for one hour.
    Correction: Shell eggs that have not been treated to destroy Salmonella shall be stored in refrigerated equipment that maintains an ambient temperature of 45°F or less. MOVED TO COOLER HOLDING BELOW 41F.
  • Temp Meas Devices for Cold & Hot Hold Equipment, Present (corrected on site)
    Observation: There was no temperature measuring device located in the following cold holding equipment: -----True 2DR prep cooler. Also air thermometer in 1DR Display Cooler was reading at 50F while inside of cooler was 37F.
    Correction: Cold or hot holding equipment used for the storage of potentially hazardous foods (time/temperature control for safety food) shall be designed to include and shall be equipped with at least one integral or permanently affixed temperature measuring device that is located to allow easy viewing of the device's temperature display. NEW THERMOMETERS INSIDE BOTH UNITS.
  • Critical: Conditions of Use/Presence & Use of Toxics Per Law (corrected on site)
    Observation: Three sprays cans on pesticides labeled for residential use were observed in the facility
    Correction: Remove residential use pesticides from the facility. When necessary for pest control, chemical pesticides must be applied by a certified pesticide applicator to prevent injury and contamination. REMOVED FROM FACILITY.
11/10/2014Routine
The purpose of today's visit was to conduct a routine inspection. EHS provided manager with and discussed the following handouts: prevent cross contamination in Thai and Spanish and time as a public health control (as future option).
  • Critical: Molluscan Shellstock/Maintaining ID/Tags Attached until Container Emptied (corrected on site) (repeated violation)
    Observation: Tags missing from the molluscan shellfish containers (mussels).
    Correction: Shellstock tags shall remain attached to the container in which the shellstock are received until the container is empty. MANAGER LOCATED THE CORRECT TAG AND RE-ATTACHED TO CONTAINER.
  • Critical: Molluscan Shellstock Tags/Labels Marked with Date Last Sold or Served (corrected on site)
    Observation: The date when the last shellstock from the container is sold or served is not recorded on the tag or label.
    Correction: The identity of the source of shellstock (oysters, clams, mussels) that are sold or served shall be maintained by retaining shellstock tags or labels and marking the tag or label with the date when the last shellstock from the container is sold or served. DISCUSSED WITH MANAGER.

* All critical violations must be corrected within 10 days and no later than the time of the next inspection.

  • Critical: Responsibility of PIC to Require Food Employees to Report GI Symptoms or Cuts, Disease, Medical Condition or Exposure to PIC
    Observation: Upon discussion with the person-in-charge, one or more of the elements of an effective employee health policy is either missing or incomplete. A complete employee health policy is required to be in place at the food establishment. At the time of this inspection, the Health Department provided and reviewed handouts and resource information in a red folder labeled "Employee Health Policy.
    Correction: A complete employee health policy must have the following elements:
    1) Employee training on foodborne illness, particularly symptoms of illness and prevention of the Big Five illnesses (see "What is Foodborne Illness" handout)
  • Critical: Eating, Drinking, or Tobacco Use / Proper Food Employee Drinking Containers (corrected on site)
    Observation: A food handler was observed drinking from an uncovered coffe mug container while in the kitchen dish area.
    Correction: Food employees may drink only from a covered container using a straw.

  • Critical: Chlorine Sanitizer Solution Concentration based on pH and Water Temp (corrected on site)
    Observation: When tested, the chlorine-based sanitizing solution was observed to be at a concentration less than what is required for effective sanitization of food-contact surfaces of equipment and utensils. Observed the sanitizing solution in the kitchen with a concentration of 0 ppm total chlorine.
    Correction: A chlorine-based sanitizing solution shall have a minimum concentration of at least 50 to100 ppm total chlorine when tested using the appropriate test kit.
