This visit was made to conduct a risk based assessment. The Person in Charge was very helpful during the visit. The following issues require attention:
1. Please ensure that raw meats are stored separately according to their cook temperature and that raw animal foods (including eggs) are not stored over ready to eat foods like vegetables. Please review the poster on preventing cross contamination with all staff. This is a repeat observation. Future observations of this may result in enforcement action.
2. Time/temperature control for safety foods (TCS foods) must be held cold at 41°F or below. Discuss with staff whether you want to use Time as a Public Health Control Procedure for the cabbage, noodles, and bean sprouts on the cookline. The written procedure was provided to Person in Charge. This will be followed up during the next visit

    Observation: Observed shelled eggs being stored over raw vegetables in the Walk in Refrigerator
    Correction: Raw foods like poultry, beef, pork, seafood, and eggs shall be stored properly inside refrigerators and freezers to prevent cross contamination. Raw foods shall be stored on shelving units below or separated from all cooked foods, commercially processed foods, washed produce, leftover foods, etc. Eggs were relocated to a lower shelf. Discussed with person in charge about proper storage of raw foods. Poster has already been provided to the establishment and is posted and translated into Mandarin. Please review again with all staff.
  • Critical: Food Protection from Contamination / Separate Types of Raw Animal Foods (corrected on site)
    Observation: Observed a bowl of raw chicken being stored over an insert of shrimp on top of the prep top unit.
    Correction: Raw animal foods shall be sorted by their "type" and cooking temperatures while in storage inside a refrigerator or freezer. For example, if using one shelving unit for storage of only raw foods, the foods shall be sorted in this manner: 1) raw poultry (chicken, turkey, or duck) shall be stored on the bottom shelf (165°F cook temperature), 2) raw ground beef and ground pork shall be stored on the shelf above poultry (155°F cook temperature), and 3) raw pork (chops, ribs), seafood, and shell eggs shall be stored on the top shelf above beef (145°F cook temperature). Person in Charge removed the bowl of chicken and separated the raw chicken from the raw shrimp and the raw beef.
  • Critical: Cold Holding of Potentially Hazardous Food at 41°F or less (corrected on site)
    Observation: The following food item(s) were measured at improper temperatures: cut cabbage was on the counter at 60°F and had been out for more than 2 hours for lunch service, cut lettuce was on counter in sushi prep area at room temperature.
    Correction: Potentially hazardous foods (time/temperature control for safety food) shall be held cold at a temperature of 41°F or below. Food was discarded by Person in Charge. Discussed the idea of using Time as a Public Health Control Procedure with Person in Charge similar to what is being done with the sushi rice. Please discuss with the staff and decide what is the best method for controlling temperature of this food.
  • Time as a Public Health Control/ Up to 4 Hours for Cold & Hot PHF(TCS) / Requirements (corrected on site)
    Observation: Observed that the sushi rice was marked with the time that it was taken out of temperature control but not the time to indicate when the 4 hours expires.
    Correction: Food item(s) for which time rather than temperature is being used as a control shall be marked or otherwise identified to indicate the time that is 4 hours past the point in time when the food is removed from temperature control. Discussed with Person in Charge and sushi chef about marking rice with the time that rice is to be discarded.
  • Critical: Food-Contact Surface Sanitized before Use after Cleaning (corrected on site)
    Observation: Observed a food employee wash a bowl used for raw chicken in the prep sink with only soap and water.
    Correction: In conjunction with Section 4-703.11, the food-contact surfaces of equipment and utensils shall be sanitized before use and after cleaning. Food contact surfaces shall be washed, rinsed and sanitized properly. Instructed food worker on proper process and he placed bowl in dishwashing machine.

This visit was made to conduct a routine inspection. The following items require correction:
1. A food protection manager MUST be present at all times the facility is in operation (in the morning when they are preparing to open, even when they are only cleaning in the evening).
2. Train all employees on employee health. Employees are expected to know they have a responsibility to report certain symptoms of illness (vomiting diarrhea, sore throat with fever, jaundice).
3. Items that time as a public health control are being used for (sushi rice and garlic in oil) MUST be marked with time put in use OR time to be discarded.
4. Make sure employees on cook line are using a separate utensil (tong) for allergen item (shrimp). Mark tong to let employees know that it is to be used ONLY for the shrimp.
Repeat violations shall be subject to civil penalty.

    Observation: Certified Food Manager not present at start of inspection while facility was operating.
    Correction: Ensure that a Certified Food Protection manager is on the premesis at all hours of operation.

    Observation: Mug observed in kitchen area with personal items.
    Correction: Ensure that employees are drinking from cups with a lid and a straw in food preparation areas.

    Observation: Food employee(s) was observed handling the following ready-to-eat foods using their bare hands: Cut Lemons
    Correction: Except when washing fruits and vegetables, food employees may not contact ready-to-eat foods using their bare hands. Employees shall be using suitable utensils such as deli tissue, spatulas, tongs, or clean disposable gloves to handle all ready-to-eat foods. Proper handling of food and effective handwashing procedures will help prevent foodborne illness.

    Correction: Food containers in which food is being cooled shall be: 1) arranged in the equipment to provide maximum heat transfer through the container walls, and 2) the food containers shall be loosely covered or uncovered as long as protected from contamination to facilitate heat transfer from the surface of the food.

    Correction: If time only, rather than time in accordance with temperature control, up to a maximum of 4 hours is used as the public health control : 1) the food shall have an initial temperature of 41°F or less if removed from cold holding temperature or, 2) the food shall have an initial temperature of 135°F or above if removed from hot holding temperature control, 3) the food shall be marked or otherwise identified to indicate the time that is 4 hours past the point in time when the food is removed from temperature control, 4) the food shall be cooked and served, served if ready to eat, or discarded within 4 hours from the point in time when the food is removed from temperature control, and 5) the food if unmarked or marked to exceed a 4 hour limit shall be discarded.

    Observation: The cutting board(s) along the prep units are heavily scratched and scored. The food contact surface is no longer easily cleaned and sanitized due to condition.
    Correction: Resurface or replace the cutting boards to provide a food contact surface that is smooth, easily cleaned and sanitized .
  • Equipment / Food-Contact / Visibly Clean
    Observation: The following equipment/utensils were observed soiled to sight and touch: Rice Cooker (leftover rice not cleaned out of cooker)
    Correction: Equipment food-contact surfaces and utensils shall be clean to the sight and touch. A surface that is soiled cannot be effectively sanitized.
  • Equip/Utensils/Linens/Single-Service/Invert, Cover (corrected on site)
    Observation: Clean plates, and single serve containers were observed stored with the food-contact surface facing upward.
    Correction: Clean equipment and utensils shall be stored in a self-draining position that allows air drying and covered/inverted.
  • Critical: Backflow Prevention, Air Gap / When Required (corrected on site)
    Observation: Observed a hose attached to a faucet fixture. The hose extended below the flood rim level of the sink basin.
    Correction: A plumbing system shall be installed to preclude backflow of a solid, liquid, or gas contaminant into the water supply system at each point of use at the food establishment, including on a hose bib if a hose is attached or on a hose bib if a hose is not attached and backflow prevention is required by Law by providing an air gap as specified under 5-202.13.

  • Critical: Employee Health Policy Requirements (corrected on site)
    Observation: Through conversation and/or review of written policy, it was determined that the establishment's employee health policy (EHP) is not compliant with the Food Code because: the FPM was not aware of the reportable illnesses. The FPM was provided with EHP agreement and poster. The EHS explained the policy and where to obtain more information.
    Correction: Create and implement an EHP that: 1) requires employees to report certain symptoms (vomiting, diarrhea, jaundice, sore throat with fever, or a lesion/infected wound) and illnesses (Norovirus, Hepatitis A, Salmonella Typhi, Nontyphoidal Salmonella, E. coli, or Shigella)
  • Critical: Hands and Arms / Cleaning Procedure (corrected on site)
    Observation: The food service worker failed to wash his hands for 20 seconds. The FPM explained proper hand washing procedure to employees and employees demonstrated proper hand wash technique after explanation.
    Correction: FOOD EMPLOYEES shall clean their hands and exposed portions of their arms, for at least 20 seconds, using a cleaning compound in a HANDWASHING SINK.

    Observation: Open drinking containers stored in a manner that may contaminate food, food contact surfaces or utensils. (kitchen) Open drinking cups were discarded during the inspection.
    Correction: Food employees may have beverages in the kitchen areas as long as they are covered and consumed through a straw and stored in a manner that will prevent contamination to food, equipment, utensils, linens, and single service item
  • Critical: Food Protection from Contamination / Separate Raw from RTE (corrected on site) (repeated violation)
    Observation: Raw animal food stored over ready-to-eat food in the walk-in and reach-in refrigeration units Cooked chicken was improperly stored under raw chicken in the reach-in refrigerator. Raw chicken was improperly above the sauces and produce.
    Correction: Raw foods like poultry, beef, pork, seafood, and eggs shall be stored properly inside refrigerators and freezers to prevent cross contamination. Raw foods shall be stored on shelving units BELOW or SEPARATED from all cooked foods, commercially processed foods, washed produce, leftover foods, etc.
  • Utensils That are In-Use / Between-Use Storage (corrected on site)
    Observation: Dispensing and/or in-use utensils improperly stored between use as follows: plastic bowls were improperly used to dispense soy sauces. The plastic bowls were removed and the FPM was instructed to use ladles or utensil with a ladle the would extend out of the product.
    Correction: During pauses in food preparation or dispensing, food utensils shall be stored in one of the following manners: 1) in the food with their handles above the top of the food and the container, 2) in food that is not potentially hazardous (time/temperature control for safe food) with their handles above the top of the food within containers or equipment that can be closed, 3) on a clean portion of the food preparation table or cooking equipment only if the in-use utensil and the food contact surface of the food preparation table or cooking equipment are cleaned and sanitized, 4) in running water of sufficient velocity to flush particulates to the drain, 5) in a clean, protected location if the utensils are used only with a food that is NOT potentially hazardous (time/temperature control for safe food), or 6) in a container of water if the water is maintained at a temperature of at least 135°F and the container is cleaned frequently.
  • Consumer Advisory, Disclosure Provided
    Observation: The following raw and/or undercooked foods are provided on the menu, menu board, table tent or brochure without proper disclosure: the rainbow salad, sushi, tartari, yellow tail jalapeno, SOSa combo, the red dragon roll, and the Virginia roll. Correct menu in 10 days.
    Correction: The Consumer Advisory shall include a disclosure statement that includes a description of the animal-derived foods and identification of the animal-derived foods by asterisking (*) them to a footnote that states that the items are served raw or undercooked, or contain raw or undercooked ingredients.
  • Critical: Separation of Toxics by Spacing or Partitioning (corrected on site)
    Observation: Observed that poisonous and toxic materials are not properly stored to prevent the contamination of food, equipment, utensils, linens or single service items. W-D 40 was improperly stored with food items. The W-D 40 was removed during the inspection.
    Correction: All poisonous and toxic materials shall be stored to prevent contamination of food, equipment, utensils, linens, and single service items by separating the poisonous and toxic materials by spacing or partitioning.

  • Critical: Handwashing / When to wash hands (corrected on site)
    Observation: A food employee failed to wash his or her hands before engaging in food preparation, after touching bare human body parts, after coughing, sneezing, eating, after handling soiled utensils, or after engaging in any activity that could contaminate the hands.(employee didn't wash hands prior to putting on gloves)
    Correction: ALL food employees shall be washing their hands OFTEN especially after handling trash, using the restroom, handling raw meats, handling soiled equipment and utensils, BEFORE putting on clean gloves, etc. Proper handwashing frequencies will aid in the reduction foodborne illness.
  • Jewelry Prohibition (corrected on site)
    Observation: Employees observed wearing jewelry (watch) on their arms and hands while preparing food.
    Correction: Food employees shall limit their jewelry to a plain wedding ring while preparing food. Food employees may not wear bracelets, watches, etc. because they can inhibit proper hand washing.
