All violations were corrected. Replaced the prep cooler with a new unit. The new prep cooler had an ambient air temperature of 35F. Hot holding was improved. Curries are hot held in a hot well.

09/29/2015Follow-up
The purpose of today's visit was to conduct a complaint investigation regarding a confirmed case of salmonellosis and a risk factor inspection. Complainant had consumed cashew chicken at the food establishment. Discussed the complaint with the Certified Food Manager (CFM). There were no other complaints of foodborne illness during the past two weeks and there were no ill employees during the same time period. Observed good sanitation and employee hygiene. Food is obtained from an approved food source. The cashews used in the cashew chicken do not appear to be a part of the recall. They are from Gel Spice of New Jersey. Raw chicken is stored in the Walk-in-Cooler before being cooked and stored in the 3DR Superior Prep Cooler. Chicken temperature in the Walk-in-Cooler was acceptable. Chicken temperature in the 3DR Superior Prep Cooler was above 41F even though ice was being used. Food was moved to the Walk-in-Cooler and the unit will be serviced prior to storing time/temperature control for safety foods. There were no other risk factors observed that could have contributed to the foodborne illness.

1) Please email a copy of the service report for the 3DR Superior Prep Cooler and the 1DR Cooler @ the Bar to the Health Department within 3 days.
2) Train staff on proper hot holding.

    Observation: The following food items were observed cold holding at improper temperatures using a calibrated food temperature measuring device: 3DR TRUE PREP COOLER (1) CUT TOMATO AT 58F (2) COOKED SHRIMP AT 50F (3) COOKED SQUID AT 52F (4) DUMPLING AT 53F (5) TOFU AT 52F.
    Correction: Potentially hazardous foods (time/temperature conrol for safety food) shall be held cold at a temperature of 41°F or below. MOVED FOOD TO ANOTHER COOLER AND CONTACTED TECHNICIAN FOR SERVICE.

    Correction: Refrigerated, ready-to-eat, potentially hazardous foods that are prepared on site and kept for more than 24 hours cannot have a shelf-life of more than 7 days, including the day of preparation. These food items must be marked with either the "consume-by" date and/or "preparation" date, color-coded labels, or another marking system/method that effectively indicates shelf-life that is clearly understood and properly used by the employees. The single-use gloves shall be discarded when damaged or soiled or when interruptions occur in the operation.     Observation: Dispensing and/or in-use utensils improperly stored between use as follows: scoops in standing water
    Correction: During pauses in food preparation or dispensing, food utensils shall be stored in one of the following manners: 1) in the food with their handles above the top of the food and the container, 2) in food that is not potentially hazardous (time/temperature control for safe food) with their handles above the top of the food within containers or equipment that can be closed, 3) on a clean portion of the food preparation table or cooking equipment only if the in-use utensil and the food contact surface of the food preparation table or cooking equipment are cleaned and sanitized, 4) in running water of sufficient velocity to flush particulates to the drain, 5) in a clean, protected location if the utensils are used only with a food that is NOT potentially hazardous (time/temperature control for safe food), or 6) in a container of water if the water is maintained at a temperature of at least 135°F and the container is cleaned frequently.

    Correction: Surfaces such as cutting blocks and boards that are subject to scratching and scoring shall be resurfaced if they can no longer be effectively cleaned and sanitized, or discarded if they are not capable of being resurfaced.

    Observation: There is no cover to the feminine napkin refuse container in the ladies room stall.
    Correction: A toilet room used by females shall be provided with a covered receptacle for sanitary napkins.

    Observation: Observed that the wall by the rice cooker is not maintained in good repair.
    Correction: Repair the physical facilities. Poor repair and maintenance compromises the functionality of the physical facilities.
  • Cleaning Frequency for Physical Facilities
    Observation: Observed that the walls and under equipment are in need of cleaning.
    Correction: Clean the physical facilities at a frequency necessary to ensure the protection and safe preparation of food.

    Observation: The concentration of the chlorine solution was measured at over 200 ppm. This concentration exceeds the approved limits for use with food-contact surfaces of equipment and utensils in a foodservice establishment.
    Correction: Maintain the concentration of chlorine solution at 50-100 ppm. Verify concentration using the appropriate test kit. CFM reset solution to 100ppm

    Correction: Potentially hazardous foods (time/temperature control for safety food) shall be hot held at a temperature of 135°F or above unless the permit holder is using "time as public health control" as specified under 3-501.19. BOTH CURRIES REHEATED TO 165F
  • Critical: Chlorine Sanitizer Solution Concentration based on pH and Water Temp (corrected on site) (repeated violation)
    Observation: When tested, the chlorine-based sanitizing solution was observed to be at a concentration less than what is required for effective sanitization of food-contact surfaces of equipment and utensils. Observed the sanitizing solution in the sanitizer buckers with a concentration of 0 ppm total chlorine.
    Correction: A chlorine-based sanitizing solution shall have a minimum concentration of at least 50 to100 ppm total chlorine when tested using the appropriate test kit. FOOD EMPLOYEE RESET SOLUTION TO 50 PPM.

    Observation: Upon discussion with the person-in-charge, one or more of the elements of an effective employee health policy is either missing or incomplete. A complete employee health policy is required to be in place at the food establishment. At the time of this inspection, the Health Department provided and reviewed handouts and resource information in a red folder labeled "Employee Health Policy.
    Correction: A complete employee health policy must have the following elements:
    1) Employee training on foodborne illness, particularly symptoms of illness and prevention of the Big Five illnesses (see "What is Foodborne Illness" handout)
  • Critical: Package Integrity & No Dented Cans/ Specifications for Receiving (corrected on site)
    Observation: The following food item(s) from damaged packaging were found offered for sale or service: 8 dented cans. CFM removed and placed damaged cans in different area to give back to supplier.
    Correction: Food packages such as canned goods shall be in good condition and protect the integrity of the contents so that the food is not exposed to adulteration or potential contaminants. Return all dented and damaged canned goods to your food supplier for a credit.
  • Food Storage / Preventing Contamination
    Observation: Food stored on the floor and/or food stored less than 6 inches off the floor.
    Correction: Food shall be protected from contamination by storing the food at least 6 inches off the floor on approved shelving units or dunnage racks. Milk crates, soda crates, or bread racks are not suitable for food storage.
