Based upon information provided to the Environmental Health Office of the Eastern Shore Health District a routine inspection was conducted at the address of record for the La Fogata Mobile Food Unit. The Mobile Unit Operator, Teresa Martinez and Mobile Food Unit Owner, Agustin Rodriguez were present during the entire inspection. Inspector observed a open storage trailer containing large bags of rice and bananas behind the owners residence. The inspector observed a large pot of tamales being cooked behind the owners residence. Inspector observed a cat and dog in the vicinity of the storage trailer, tables containing food items, and the cooking tamales. In accordance with the operator signed Commissary Agreement, all food preparation is to be conducted at Don Valerio's restaurant, a permitted food establishment.
  • Critical: Food - Compliance with Food Law*
    Observation: Food prepared in a private home is distributed or offered for sale to the public. Inspector observed tamales being steamed in a large pot behind operator's private home. The operator was preparing the tamales for the Mobile Food Unit.
    Correction: Cease use of food prepared in a private home. Food must be obtained from an approved governmentally inspected food preparation/processing facility.
  • Food Storage - Prohibited Areas
    Observation: Large bags of rice and bunches of bananas were observed by the inspector being stored in a tool storage trailer.
    Correction: Relocate food storage to an approved area until the source of contamination is eliminated or removed.
  • Critical: Food - Potentially Hazardous Food - Hot Holding*
    Observation: Inspector observed sliced beef, green beans, and burritos hot holding at improper temperatures on the Mobile Food Unit steam table.
    Correction: Discard the food and ensure that potentially hazardous foods for hot holding are maintained at 135°F or above to inhibit the growth of harmful bacteria.
  • Critical: Pests-Controlling Pests*
    Observation: Observed methods are not being used to control pests. Inspector observed an open trailer being used to store large bags of rice and bananas. Inspector observed bananas, limes, and boxes of cookies being stored on a table outside adjacent to the Mobile Food Unit.
    Correction: The presence of insects, rodents, and other pests shall be controlled to minimize their presence on the premises by using methods such as trapping devices or other methods as required.
  • Critical: Animals - Prohibiting Animals*
    Observation: A dog and cat were observed by the inspector near a open trailer and outdoor table were food items were stored. A dog was also observed in the vincity of a pot of steamed tamales. A dog was observed laying on a table with a cutting board and knife.
    Correction: Prohibit all live animals on the premises of the food establishment. Animals carry disease-causing organisms and can transmit pathogens to humans through direct and/or indirect contamination of food and food-contact surfaces. Animals shed hair continuously and may deposit liquid or fecal waste, creating the need for vigilance and more frequent and rigorous cleaning effort.

  • Hand Drying Provision (corrected on site)
    Observation: No disposable towels were provided at the hand washing lavatory.
    Correction: Hand drying devices such as individual disposable paper towels, a continuous towel system that supplies the user with a clean towel or heated air hand drying device must be provided at all hand washing lavatories to encourage proper hand washing and avoid employees to drying their hands on their clothing or other unclean materials
