The purpose of today's visit was to conduct a risk factor assessment. The following violations have been observed for a second time:
1. Separate Raw vs. Ready-To-Eat (RTE)
2. Handsink Used for Handwashing Only
The following suggestions have been made as a means to incorporate Active Managerial Control:
1. Immediately and regularly train employees using "How to Provide Cross Contamination" document provided (Chinese)
2. Provide handwashing training to all employees regularly. Include when to stock handsink with soap/paper towels and emphasis use for handwashing only.

  • Critical: Food Protection from Contamination / Separate Raw from RTE (corrected on site) (repeated violation)
    Observation: Raw animal food holding in a manner that may cause cross contamination of ready-to-eat food as follows: IN WALK-IN COOLER- RAW CHICKEN BEING STORED OVER READY-TO-EAT EGG FOO YOUNG GRAVY.
    Correction: Food shall be protected from cross contamination by separating raw animal foods like poultry, beef, pork, seafood, and eggs during holding from ALL other foods such as cooked foods, ready-to-eat foods, washed produce, etc. RAW CHICKEN MOVED TO BOTTOM SHELF OF WALK-IN COOLER.

    Correction: If time only is used as a public health control for a working supply of potentially hazardous foods (time/temperature control for safety food) before cooking or for ready to eat, potentially hazardous foods that is displayed or held for service for immediate consumption, written procedures shall be prepared in advance and maintained in the food establishment and made available to the regulatory authority upon request. * Crack between floor and wall under three-vat sink was satisfactorily repaired, and the facility received a routine professional pest treatment between the most recent routine inspection and this follow-up inspection.d
* The two door prep top refrigerator (left) was professionally repaired, but remains unable to maintain foods at 41 F or colder. Potentially hazardous foods in the unit were discarded. Do not use the existing unit to store potentially hazardous foods. CFM advised that a replacement refrigerator has been ordered. Send an invoice or other proof of purchase for the new refrigeration unit to the EHS by 5 June 2015.

    Observation: In the walk-in refrigerator, a container of raw chicken was stored above vegetables and a container of raw fish was stored above another container of vegetables.
    Correction: Raw foods like poultry, beef, pork, seafood, and eggs shall be stored properly inside refrigerators and freezers to prevent cross contamination. Raw foods shall be stored on shelving units BELOW or SEPARATED from all cooked foods, commercially processed foods, washed produce, leftover foods, etc.
  • Critical: Cold Holding of Potentially Hazardous Food at 41°F or less (corrected on site) (repeated violation)
    Observation: The following food item(s) were observed cold holding at improper temperatures using a calibrated food temperature measuring device: Bean sprouts (62 F) and garlic and oil mixture were stored without temperature control on the chef's table. Egg rolls (43 F) and raw hamburger (44 F)in two door prep cooler. Tartar sauce (43 F), cole slaw (43 F) in two door beverage display cooler.
    Correction: Potentially hazardous foods (time/temperature conrol for safety food) shall be held cold at a temperature of 41°F or below. Bean sprouts and garlic/oil mixture were relocated to a freezer for rapid cooling, and will be held in a refrigerator after cooling. Potentially hazardous foods in two door prep cooler were relocated to other refrigeration units. Tartar sauce and cole slaw in beverage display cooler were relocated to the walk-in refrigerator.

    Observation: Cutting boards were observed heavily pitted and scored. The food contact surface is no longer easily cleaned and sanitized due to condition.
    Correction: Surfaces such as cutting blocks and boards that are subject to scratching and scoring shall be resurfaced if they can no longer be effectively cleaned and sanitized, or discarded if they are not capable of being resurfaced.

    Observation: The nonfood-contact surfaces of the slicer were visibly contaminated with food residues.
    Correction: Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue and other debris to maintain a sanitary work environment and prevent pest attraction.

    Observation: Handwashing facilities were blocked by containers and/or rags.
    Correction: A hand washing sink shall be maintained so that it is accessible at all times for employee use. Handsinks were made accessible.

    Observation: Observed that the floor-wall juncture under the three vat sink was not properly sealed to prevent entry of water. This condition creates a harborage area and/or potential ingress route for roaches.
    Correction: Repair the floor wall juncture near the three vat sink. Complete repairs before the follow-up inspection scheduled on or about 29 May 2015.
  • Controlling Pests by Eliminating Harborage Conditions
    Observation: General cleanliness of facility is commendable
    Correction: some harborage conditions for cockroaches remain. Facility is making obvious efforts to abate roaches and recieves routine professional pest treatments. Several roaches were observed dead in glue traps

    Observation: Observed that the floors under shelving and equipment are in need of cleaning.
    Correction: Clean the physical facilities at a frequency necessary to ensure the protection and safe preparation of food and to eliminate harborage areas for pests.

    Observation: Observed employee medications/supplements stored above foods in the dry storage areas.
    Correction: All poisonous and toxic materials shall be stored below food, equipment, utensils, linens, and single service items to prevent contamination. Medicines relocated. An area is designated for storage of employee medicines and personal items - ensure that it is properly used.

This is a complaint investigation. Due to fire at ALDI grocery store located next door, Johnny Sub Shop experienced smoke damage. Manager has discarded all foods exposed as well as wash, rinse, and sanitizer all food surfaces and equipment.
Fire caused electricity outage which lasted 2 hours. Foods in the refrigeration was not affected since they were kept closed during this time.
Ansel system did not go off.
Ceiling tiles were replaced (they were broken in by the fire department to enter the facility. No roof leak was observed.
Facility voluntarily closed to clean after the event. This facility is now in compliance to reopen.

No violation noted during this evaluation.

    Observation: A food employee failed to wash his or her hands before putting on new gloves to do food preparation.
    Correction: ALL food employees shall wash their hands OFTEN especially after handling trash, using the restroom, handling raw meats, handling soiled equipment and utensils, BEFORE putting on clean gloves, etc. Proper handwashing frequencies will aid in the reduction of foodborne illness. Hands were washed.

    Correction: Refrigerated, ready-to-eat, potentially hazardous foods that are prepared on site and kept for more than 24 hours cannot have a shelf-life of more than 7 days, including the day of preparation. These food items must be marked with either the "consume-by" date and/or "preparation" date, color-coded labels, or another marking system/method that effectively indicates shelf-life that is clearly understood and properly used by the employees.     Observation: The following refrigeration unit is not operating properly and is unable to maintain cold food at or below 41°F: 2dr prep cooler - right. Observed at 46F.
    Correction: Repair/adjust the unit so it is able to maintain foods at or below 41°F. Do not use the unit to store potentially hazardous foods while it is not operating properly. Emptied out and maintenance requested.

    Observation: Chemical sanitizer immersion time was not adequate for chlorine sanitizing solution. Employee washed dishes without performing sanitizing step at 3-vat.
    Correction: Chemical sanitization (manual or mechanical operations) including the application of sanitizing chemicals by immersion, manual swabbing, brushing, or pressure spraying methods using a solution by providing: 1) an exposure time of at least 10 seconds for a chlorine solution, 2) an exposure time of at least 7 seconds for a chlorine solution of 50mg/L that has a pH of 10 or less and a water temperature of 100°F or a pH of 8 or less and a water temperature of 75°F, 3) an exposure time of at least 30 seconds for other chemical sanitizing solutions, or 4) an exposure time used in relationship with a combination of temperature, concentration, and pH that when evaluated for efficacy yields sanitization. Sanitizer solution was set up and sanitizing step was performed.

    Correction: It shall be unlawful to operate a food establishment unless it is under the immediate control of a certified food manager. It is highly suggested that you have more than one employee with the food manager's license. ORS Interactive, Inc. (see handout provided) issues the required photo identification card with proof of successful completion of a certified food manager's exam. Failure to have a certified food manager on site during ALL hours of operation including food preparation, food service, and cleaning/sanitizing of equipment/utensils will result in closure of the establishment.

    Observation: An accumulation of dead or trapped cockroaches were found in the control devices and on shelves.
    Correction: Remove dead rodents, birds, and insects from the control devices at a frequency necessary to ensure that the establishment is clean and sanitary and to prevent carcasses from attracting other pests.

    Observation: Pesticides labeled for residential use were observed in the facility and are being applied by the operator to control pests: pest spray can.
    Correction: Remove residential use pesticides from the facility. When necessary for pest control, chemical pesticides must be applied by a certified pesticide applicator to prevent injury and contamination. Manager discarded.
03/10/2014Routine
Complainant observed roach in steak and cheese sub complainant had taken out around noon on August 20, 2013. Manager was aware of this complaint. EHS performed an investigation and observed dead roaches on control devices. Manager has been actively cleaning facility of potential food source. EHS reviewed recent pest control and noted that there is active pest control in place and discussed integrated pest management for effective pest control. Attached is the most recent pest control. Since pest control has started in July, recent activity may be driving roaches out and it may take several cycles to see significant results.

    Correction: Chemical sanitization (manual or mechanical operations) including the application of sanitizing chemicals by immersion, manual swabbing, brushing, or pressure spraying methods using a solution by providing: 1) an exposure time of at least 10 seconds for a chlorine solution, 2) an exposure time of at least 7 seconds for a chlorine solution of 50mg/L that has a pH of 10 or less and a water temperature of 100°F or a pH of 8 or less and a water temperature of 75°F, 3) an exposure time of at least 30 seconds for other chemical sanitizing solutions, or 4) an exposure time used in relationship with a combination of temperature, concentration, and pH that when evaluated for efficacy yields sanitization.

    Correction: It shall be unlawful to operate a food establishment unless it is under the immediate control of a certified food manager. (see handout provided) issues the required photo identification card with proof of successful completion of a certified food manager's exam. Failure to have a certified food manager on site during ALL hours of operation including food preparation, food service, and cleaning/sanitizing of equipment/utensils will result in closure of the establishment.

    Observation: Observed the handsink by 3-vat sink is used to hold dirty equipments.
    Correction: Handsinks are to be used only for washing hands to encourage proper hand washing and to prevent contamination of cleaned hands.

    Observation: Methods are not being used to control pests: 1 roach.
    Correction: Insects and other pests are capable of transmitting disease to people by contaminating food and food-contact surfaces. If pests are found on the premises methods shall be used to control their presence.

Complainant observed bare hand touching of ready to eat food as well as coughing while prepping. In addition, complainant was concerning about sanitary condition of this facility (tables not clean, trash overflowing, dirty and out of order bathroom).
EHS performed complaint inspection and observed and observed employee barehand touching ready to eat food. Manager also said employee who was coughing while prepping is no longer working at this facility. Other concerns were not observed during this inspection. EHS trained employees on no barehand handling of ready to eat food.

    Observation: A food employee was observed handling the following ready-to-eat food using their bare hands: sandwiche (bread and lettuce) - discarded.
    Correction: Except when washing fruits and vegetables, food employees may not contact ready-to-eat foods using their bare hands. Employees shall use suitable utensils such as deli tissue, spatulas, tongs, or clean disposable gloves to handle all ready-to-eat foods.

    Observation: Upon discussion with the person-in-charge, one or more of the elements of an effective employee health policy is either missing or incomplete. A complete employee health policy is required to be in place at the food establishment. At the time of this inspection, the Health Department provided and reviewed handouts and resource information in a red folder labeled "Employee Health Policy.
    Correction: A complete employee health policy must have the following elements:
    1) Employee training on foodborne illness, particularly symptoms of illness and prevention of the Big Five illnesses (see "What is Foodborne Illness" handout)
  • Critical: Hands and Arms / Cleaning Procedure (corrected on site)
    Observation: Observed food employees using improper handwashing procedures: employee did not use soap when washing hands.
    Correction: Food employees shall wash their hands and exposed portions of their arms by: 1) discarding used gloves

    Observation: A food employee failed to wash his or her hands before engaging in food preparation, after touching bare human body parts, after coughing, sneezing, eating, after handling soiled utensils, or after engaging in any activity that could contaminate the hands: before putting on gloves.
    Correction: ALL food employees shall wash their hands OFTEN especially after handling trash, using the restroom, handling raw meats, handling soiled equipment and utensils, BEFORE putting on clean gloves, etc. Proper handwashing frequencies will aid in the reduction of foodborne illness.

    Observation: Raw animal food holding in a manner that may cause cross contamination of ready-to-eat food as follows: raw chicken over whole onion, raw shrimp over onion in walk-in cooler.
    Correction: Food shall be protected from cross contamination by separating raw animal foods like poultry, beef, pork, seafood, and eggs during holding from ALL other foods such as cooked foods, ready-to-eat foods, washed produce, etc.
  • Food Storage Containers, Identified with Common Name of Food
    Observation: The following food items that are not easily identified by appearance were observed without a label: sugar, flour bins
    Correction: Unless a food item can be easily recognized, all foods and ingredients removed from their original containers and stored in working containers shall be labeled using the common name of the food. For example: cooking oils, salt, sugar, flour, spices, herbs, etc.
  • Wiping Cloths/Use Limitation/Wet Towel Storage (repeated violation)
    Observation: Wet wiping cloths used for wiping counters and other equipment surfaces were observed stored on the counter.
    Correction: Wet wiping cloths are to be used for wiping counters and other equipment surfaces and are to be held in a chemical sanitizer solution at the appropriate concentration between uses.
  • Food Storage / Preventing Contamination (repeated violation)
    Observation: Food stored on the floor and/or food stored less than 6 inches off the floor: sauces in walk-in cooler, raw chicken in walk-in freezer, canned foods in kitchen.
    Correction: Food shall be protected from contamination by storing the food at least 6 inches off the floor on approved shelving units or dunnage racks. Milk crates, soda crates, or bread racks are not suitable for food storage.
  • Thawing / Approved Methods (corrected on site) (repeated violation)
    Observation: Observed the following food thawing using an improper method: frozen chicken on counter - moved into cooler.
    Correction: Potentially hazardous foods (time/temperature control for safety food) shall be thawed using one of the following methods: 1) under refrigeration that maintains the food temperature at 41°F or less, 2) completely submerged under running water at a water temperature of 70°F or below with a sufficient velocity to agitate and float off loose particles of food as long as held for period of time at a temperature of 41°F or less, or 3) as part of a cooking process if the food is cooked as specified by Law or thawed in a microwave oven and immediately transferred to a conventional cooking process.
  • Critical: Hot Holding of Potentially Hazardous Food at 135°F or above (corrected on site)
    Observation: The following food item(s) were found hot holding at improper temperatures using a calibrated food temperature measuring device: fried chicken wings (60F), fried chicken (64F), french fries (74F) on counter - moved to cooler to cool further. Confirmed they were fried 1hr ago but employee was not hot holding correctly.
    Correction: Potentially hazardous foods (time/temperature control for safety food) shall be hot held at a temperature of 135°F or above unless the permit holder is using "time as public health control" as specified under 3-501.19.
  • Critical: Cold Holding of Potentially Hazardous Food at 41°F or less (corrected on site) (repeated violation)
    Observation: The following food item(s) were observed cold holding at improper temperatures using a calibrated food temperature measuring device: American cheese (46F), cheddar cheese (48F) on prep top but not in cooling bowls - moved to cooler below. Garlic and oil mix (68F) on chef's table - discarded.
    Correction: Potentially hazardous foods (time/temperature control for safety food) shall be held cold at a temperature of 41°F or below unless the permit holder is using "time as public health control" as specified under 3-501.19 to limit bacteria growth.
  • Critical: Date Marking of Refrigerated, Ready-to-Eat PHF (TCS Food) (corrected on site) (repeated violation)
    Observation: The following refrigerated, ready-to-eat, potentially hazardous food that is prepared on site is not used or discarded within 24 hours of preparation and was not observed to be date marked: fried chicken, egg rolls in walk-in cooler
    Correction: Refrigerated, ready-to-eat, potentially hazardous foods that are prepared on site and kept for more than 24 hours cannot have a shelf-life of more than 7 days, including the day of preparation. These food items must be marked with either the "consume-by" date and/or "preparation" date, color-coded labels, or another marking system/method that effectively indicates shelf-life that is clearly understood and properly used by the employees.
  • Nonfood-Contact Surface/Corrosion Resistant/Nonabsorbent (repeated violation)
    Observation: The nonfood-contact surface of the following equipment is not corrosion resistant, nonabsorbent, and/or smooth: paperboard used to line shelves.

    Observation: Observed that sign or poster that notifies food employees to wash their hands is not provided at all handwashing sinks used by food employees: front sink, employee bathroom and customer bathroom.
    Correction: Provide a sign or poster at all handwashing sinks used by food employees that reminds food employees to wash their hands.
  • Cleaning Frequency for Physical Facilities
    Observation: Observed that following are in need of cleaning: floor, shelve and walls.
    Correction: Clean the physical facilities at a frequency necessary to ensure the protection and safe preparation of food.
  • Critical: Conditions of Use/Presence & Use of Toxics Per Law (corrected on site)
    Observation: Pesticides labeled for residential use were observed in the facility and are being applied by the operator to control pests: dozen cans of bug sprays - discarded or moved out of facility.
    Correction: Remove residential use pesticides from the facility. When necessary for pest control, chemical pesticides must be applied by a certified pesticide applicator to prevent injury and contamination.
