This visit was made in order to conduct a routine food inspection, The chef and food protection manager were very helpful throughout the inspection. The following issues require long term correction:
1. Shellstock tags must remain attached to the container in which the shellstock are received until the container is empty

  • Molluscan Shellstock/Maintaining ID/Tags Attached until Container Emptied (corrected on site)
    Observation: Tags missing from the molluscan shellfish containers. Observed tags missing from bags of mussels in walk in cooler.
    Correction: Shellstock tags shall remain attached to the container in which the shellstock are received until the container is empty. Instructed PIC to return mussels to Restauraunt Depot to provide tags, and discard the small amount in the second bag.
  • Molluscan Shellstock/Maintaining ID/Tags Retained for 90 Days from Dates of Harvest (corrected on site)
    Observation: The tags for the molluscan shellfish are not being retained for 90 days. Observed tags not stored chronologically, and some tags were missing.
    Correction: The identity of the source of shellstock (oysters, clams, mussels) that are sold or served shall be maintained by retaining shellstock tags or labels for 90 calendar days from the dates of harvest using one of the following methods: 1) an approved record keeping system that keeps the tags or labels in chronological order correlated to the date when, or dates during which the shellstock are sold or served, 2) preserving source identification by using a record keeping system, and 3) ensuring that shellstock from one tagged or labeled container are not commingled with shellstock from another container with different certification numbers, different harvest dates, or different growing areas as identified on the tag or label before being ordered by the consumer. Effective methods for organizing shellstock tags were discussed with PIC.
  • Critical: Food Protection from Contamination / Separate Raw from RTE (corrected on site) (repeated violation)
    Observation: Raw animal food holding in a manner that may cause cross contamination of ready-to-eat food as follows: Observed Raw Chicken, Scallops held over cooked potatoes.
    Correction: Food shall be protected from cross contamination by separating raw animal foods like poultry, beef, pork, seafood, and eggs during holding from ALL other foods such as cooked foods, ready-to-eat foods, washed produce, etc. Instructed PIC on proper methods to store raw and ready to eat foods.
  • Critical: Cooling Potentially Hazardous Foods (corrected on site)
    Observation: Observed that the following potentially hazardous foods were not cooled from 135°F to 41°F within a total of 6 hours: Rotisserie Chickens in walk in cooler prepared Sunday were observed at a temperature of 49~55F on Monday.
    Correction: Potentially hazardous foods shall be cooled from 135°F to 70°F within 2 hours and from and 135°F to 41°F within a total of 6 hours to prevent the growth of harmful bacteria. Foods that have been temperature abused must be discarded. Chickens were discarded by PIC.
  • Cooling Methods (corrected on site)
    Observation: The following methods used for cooling were not adequate to facilitate cooling of the product from 135°F to 41°F within 6 hours: Observed egg/cream sauce cooling at 101F in tall bowl, in shallow pan of ice.
    Correction: Cooling hot foods shall be accomplished as follows: 1) placing the food in shallow pans, 2) separating the food into smaller or thinner portions, 3) using rapid cooling equipment, 4) stirring the food in a container placed in an ice water bath, 5) using containers that facilitate heat transfer, 6) adding ice as an ingredient, or 7) other effective methods. Recommended to chef that the mixture be transferred to a shallow pan, or that pan should be submerged in ice as it cools.
  • Consumer Advisory, Disclosure Provided
    Observation: The raw and/or undercooked foods provided on the menu, menu board, table tent or brochure do not provide a disclosure statement. Buffalo Strip Loin.
    Correction: The Consumer Advisory shall include a disclosure statement that includes a description of the animal-derived foods and identification of the animal-derived foods by astericking (*) them to a footnote that states that the items are served raw or undercooked, or contain raw or undercooked ingredients. Please ensure seasonal or monthly specials are also marked appropriately.
  • Kitchenware and Tableware - Preventing Contamination (corrected on site)
    Observation: Cleaned and sanitized utensils are dispensed with the lip-contact or food-contact surface exposed. Observed coffee spoons stored with food contact surface stored upright.
    Correction: Cleaned and sanitized utensils shall be dispensed so that contamination of food- and lip-contact surfaces is prevented. Spoons were collected to be washed again, and instructed PIC to store so that utensils are dispensed by the handles.
  • Plumbing / Maintained in Good Repair (corrected on site)
    Observation: Plumbing connections under the 3 compartment sink piping are leaking.
    Correction: A plumbing system shall be maintained in good repair. 3 compartment sink should not be used for washing, rinsing, and sanitizing until leak can be repaired. The dishwashing machine will be used primarily for washing rinsing and sanitizing until dishmachine can be repaired.
  • Hand Drying Provision / Individual, Disposable Towels (corrected on site)
    Observation: Observed that paper towels were not provided at each handwashing sink at the basement hand sink.
    Correction: Provide paper towels at each hand sink to allow employees to properly dry their hands after handwashing. Instucted PIC to provide hadn towels at every hand sink.

This visit was made to conduct a routine food safety evaluation.

  • Certified Food Manager: Responsibilities
    Observation: The Food Protection Manager is not training his/her employees in food safety. (Through conversation with the PIC and observation, it became clear the the person in charge did not know proper hand washing, proper glove use, cooling procedures, proper holding temperatures, food preparation procedures in the establishment, requirements for parasite destruction and shellfish tag retention, and was not training the employees on proper food safety practices).
    Correction: The FPM is responsible for training food service personnel in sanitary food-handling techniques and proper methods of food protection. In addition, the manager shall ensure that good public health and food protection practices and sanitary techniques in manufacturing, storing, serving, and transporting foods are used at all times on the premises under his/her control. (Contact me to schedule a hand washing and food safety training for staff. Translation into Spanish can be arranged).
  • Critical: Hands and Arms / Cleaning Procedure (repeated violation)
    Observation: I observed that all of the staff including the FPM did not dry their hands and use the paper towel to turn the water off.
    Correction: Train employees to wash hands properly by using soap and warm water, scrubbing for 20 seconds, rinsing hands, drying with a paper towel, and then using tht paper towel to turn the water off. (I explained this procedure to the FPM who continued to wash his hands improperly).
  • Critical: Handwashing / When to wash hands (corrected on site)
    Observation: A food employee failed to wash his or her hands before engaging in food preparation, after touching bare human body parts, after coughing, sneezing, eating, after handling soiled utensils, or after engaging in any activity that could contaminate the hands. (The employee washing dishes was not washing his hands after handling dirty dishes, and before handling clean dishes)
    Correction: ALL food employees shall be washing their hands OFTEN especially after handling trash, using the restroom, handling raw meats, handling soiled equipment and utensils, BEFORE putting on clean gloves, etc. Proper handwashing frequencies will aid in the reduction foodborne illness. (Employee washed his hands upon request)

    Observation: The date on which the last shellstock from the container is sold or served was not recorded on the tag or label.
    Correction: The date when the last shellstock from the container is sold or served shall be recorded on the tag or label.
  • Critical: Food Protection from Contamination / Separate Raw from RTE (corrected on site) (repeated violation)
    Observation: Raw animal food stored over ready-to-eat food in the refrigeration unit. (Observed raw steak and fish over croissants, corn salsa, and cooked ham in the walk-in cooler).
    Correction: Raw foods like poultry, beef, pork, seafood, and eggs shall be stored properly inside refrigerators and freezers to prevent cross contamination. Raw foods shall be stored on shelving units BELOW or SEPARATED from all cooked foods, commercially processed foods, washed produce, leftover foods, etc. (PIC moved the raw meat items back to thr 2 door prep top).

    Observation: Dispensing and/or in-use utensils improperly stored between use as follows: (Observed containers without handles in dry ingredients)
    Correction: During pauses in food preparation or dispensing, food utensils shall be stored in one of the following manners: 1) in the food with their handles above the top of the food and the container, 2) in food that is not potentially hazardous (time/temperature control for safe food) with their handles above the top of the food within containers or equipment that can be closed, 3) on a clean portion of the food preparation table or cooking equipment only if the in-use utensil and the food contact surface of the food preparation table or cooking equipment are cleaned and sanitized, 4) in running water of sufficient velocity to flush particulates to the drain, 5) in a clean, protected location if the utensils are used only with a food that is NOT potentially hazardous (time/temperature control for safe food), or 6) in a container of water if the water is maintained at a temperature of at least 135°F and the container is cleaned frequently.

    Observation: The following farm-raised fish served or sold in a ready-to-eat form without freezing for parasite destruction is not properly identified as such: Smoked Salmon
    Correction: If raw or partially cooked fish are served or sold in ready-to-eat form and the fish is raised and fed as specified by Law, a written agreement or statement from the supplier or aquaculturist stipulating that the fish were raised and fed shall be obtained by the person in charge and retained in the records for 90 calendar days beyond the time of service or sale to a consumer.

    Observation: Food containers for cooling food are arranged so as not to allow for maximum heat transfer. (Observed chicken salad cooling from ambient in a closed container in the 2 door prep top.)
    Correction: Food containers in which food is being cooled shall be: 1) arranged in the equipment to provide maximum heat transfer through the container walls, and 2) the food containers shall be loosely covered or uncovered as long as protected from contamination to facilitate heat transfer from the surface of the food.

    Observation: The following food item(s) were measured at improper temperatures: cooked potatoes on ice next to the fryer.
    Correction: Potentially hazardous foods (time/temperature control for safety food) shall be held cold at a temperature of 41°F or below. (Potatoes will be used within 4 hours)
  • Date Marking of RTE, PHF(TCS) Prepared On-Site, Stored at 41°F or less (repeated violation)
    Observation: The following ready-to-eat, potentially hazardous food in the refrigeration unit is not used within 24 hours of preparation and is not properly dated for disposition within 7 days at 41°F: sauces, pasta, cooked vegetables, etc. in walk-in.
    Correction: Refrigerated, ready-to-eat, potentially hazardous foods (time/temperature control for safety food) that are prepared on site and held at 41°For below shall be clearly labeled and date marked with a "USE BY" not exceeding 7 TOTAL DAYS. If the food is held for only 24 hours, no date marking is required. For example, if foods like leftover soups, chili, tuna salad, potato salad, pasta salad, etc. are prepared on 1/1/15 they shall be date marked with a "use by" date not exceeding 1/8/15.

    Observation: The following raw and/or undercooked foods are provided on the menu, menu board, table tent or brochure without proper disclosure: Ahi Tuna Salad, Smoked Salmon (all dishes with it), July Specials: Ribeye Steak, Lamb top sirloin. A dislocure is NOT needed for omelets that are cooked through and don't have other undercooked animal products.
    Correction: The Consumer Advisory shall include a disclosure statement that includes a description of the animal-derived foods and identification of the animal-derived foods by asterisking (*) them to a footnote that states that the items are served raw or undercooked, or contain raw or undercooked ingredients.

    Observation: The handwashing facility located at the kitchen cook line is blocked, preventing access by employees for easy handwashing. (The sink was blocked by a trash can and dish racks).

The dish machine is fixed and approved for use.

Hand washing is the most important practice to prevent the spread of foodborne illness. Sinks should always be stocked with soap and paper towels. Hands shall be washed before putting on new gloves, when entering the kitchen from a different area, when switching tasks (raw to ready to eat), or when they become soiled.

2. Repair dish machine so that it produces chlorine sanitizer solution at 50-100 ppm. Until it is repaired, use the sanitizer portion of the 3 comp sink next to the machine to sanitize dishes after they are washed and rinsed.
3. obtain a parasite destruction letter for the smoked salmon from Profish within 10 days and fax/email to me.
4. Provide disclosure (*) for Caesar salad on menu since the dressing contains raw eggs.

This visit was made to conduct a follow-up inspection. A separate room has been created to house the 2 door reach in housing produce. All other listed in the previous report have been corrected except for the following pending items:
- Self closing doors for the bathrooms
- Installation of mop rack.

05/30/2014Other
Courtesy inspection for the outdoor refrigerators installed recently by the owner. The owner installed a painted partition wall between the furnace and the produce refrigerator. The floors were painted and the shelving units next to the refrigerator. The unit under the stairs has a corrugated vinyl over protection and 4 inches above the ground but, the first shelving unit is 12 inches above the ground. One unit was installed by the ramp but in enclosed closet and the other one was installed under the stairwells with vinyl corrugated roofing over it. But, need 6 inches above the ground.

This visit was made to conduct a follow-up. The prep unit has since been repaired and the ambient temperature of the unit today was 39.9 F. Facility has ordered new cutting boards and rubber mats to keep boards from slipping. Hinges for self-closing doors have also been ordered and are pending delivery.
- A 2 door reach in refrigerator being used to store whole produce in being stored in a mechanical room (furnace in this room). The facility must separate this refrigeration unit in a completely separate room and wooden floor in this area must be power washed and painted.
The items listed above are still pending and must be corrected within 10 days. Follow-up inspection scheduled for Tues. 5/27/14.
