    Observation: Chicken was at 48 F, deli cheese at 49 F, sausage at 46 F, in middle prep unit. Items iced down. Call for service was placed.
    Correction: Except during preparation, cooking, or cooling, or when time is used as the public health control as specified under section 3-501.19, and except as specified under paragraph (B) of this section, time/temperature control for safety food shall be maintained at 5ºC (41ºF) or less. Bacterial growth and/or toxin production can occur if time/temperature control for safety food remains in the temperature "Danger Zone" of 5ºC to 57ºC (41ºF to 135ºF) too long. Up to a point, the rate of growth increases with an increase in temperature within this zone. Beyond the upper limit of the optimal temperature range for a particular organism, the rate of growth decreases.     Correction: The permit holder shall inform consumers of the significantly increased risk of consuming such foods by way of a disclosure and reminder, as specified in paragraphs (B) and (C) of this section using brochures, deli case or menu advisories, label statements, table tents, placards, or other effective written means. (B) Disclosure shall include: (1) A description of the animal-derived foods, such as "oysters on the half shell (raw oysters)," "raw-egg Caesar salad," and "hamburgers (can be cooked to order);" or (2) Identification of the animal-derived foods by asterisking them to a footnote that states that the items are served raw or undercooked, or contain (or may contain) raw or undercooked ingredients.     Observation: Drinking ice at bar is not protected from effluent from soda nozzles. Part of the holsters are missing.
    Correction: Food shall be protected from contamination that may result from a factor or source not specified under Subparts 3-301 - 3-306.
  • Equipment and Utensils/Durability and Strength (repeated violation)
    Observation: The microwave in the kitchen is(are) not designed and constructed to be durable.
    Correction: Equipment and utensils shall be designed and constructed to be durable and to retain their characteristic qualities under normal use conditions. Equipment and utensils must be designed and constructed to be durable and capable of retaining their original characteristics so that such items can continue to fulfill their intended purpose for the duration of their life expectancy and to maintain their easy cleanability. If they can not maintain their original characteristics, they may become difficult to clean, allowing for the harborage of pathogenic microorganisms, insects, and rodents. Equipment and utensils must be designed and constructed so that parts do not break and end up in food as foreign objects or present injury hazards to consumers. A common example of presenting an injury hazard is the tendency for tines of poorly designed single service forks to break during use.

    Observation: The soda gun holsters at the bar are missing part of the assembly.
    The caulk at the ware washing table assembly was moldy.
    The 1 part prep sink was in need of re-caulking.

    Correction: Equipment shall be maintained in a state of repair and condition that meets the requirements specified under Parts 4-1 [Materials for Construction and Repair] and 4-2 [Design and Construction]. Proper maintenance of equipment to manufacturer specifications helps ensure that it will continue to operate as designed. Failure to properly maintain equipment could lead to violations of the associated requirements of the Code that place the health of the consumer at risk. For example, refrigeration units in disrepair may no longer be capable of properly cooling or holding potentially hazardous (time/temperature control for safety) foods at safe temperatures.
  • Sanitized/Hot Water and Chemical/Methods (corrected on site)
    Observation: After being cleaned, equipment food-contact surfaces and utensils are not sanitized in a chemical manual or mechanical operations, using a proper solution. Bucket of sanitizer at ware washing machine was empty.
    Correction: After being cleaned, equipment food-contact surfaces and utensils shall be sanitized in chemical manual or mechanical operations, including the application of sanitizing chemicals by immersion, manual swabbing, brushing, or pressure spraying methods, using a solution as specified under section 4-501.114 by providing: (1) An exposure time of at least 10 seconds for a chlorine solution specified under paragraph 4-501.114(A), (2) An exposure time of at least 7 seconds for a chlorine solution of 50 mg/L that has a pH of 10 or less and a temperature of at least 38°C (100°F) or a pH of 8 or less and a temperature of at least 24°C (75°F), (3) An exposure time of at least 30 seconds for other chemical sanitizing solutions, or (4) An exposure time used in relationship with a combination of temperature, concentration, and pH that, when evaluated for efficacy, yields sanitization as defined in Subparagraph 1-201.10(B). Efficacious sanitization depends on warewashing being conducted within certain parameters. Time is a parameter applicable to both chemical and hot water sanitization. The time hot water or chemicals contact utensils or food-contact surfaces must be sufficient to destroy pathogens that may remain on surfaces after cleaning. Other parameters, such as rinse pressure, temperature, and chemical concentration are used in combination with time to achieve sanitization.

    Observation: A light under the hood was unshielded.

    Observation: Some floor tiles on cook line were cracked. Some grout at floor tiles in kitchen was in poor repair.
    The wall tiles above the urinal in men's room were missing.

If planning to mix drinks at outside bar, a handwashing sink and ice dispenser must be installed.
  • Equipment/Nonfood-Contact Surfaces/Cleaning Frequency (repeated violation)
    Observation: The following nonfood-contact surfaces are not cleaned at a frequency necessary to preclude the accumulation of soil residues:
    1. shelving in the walk-in cooler
    2. shelving used for clean dish ware
    3. cabinetry at waitstation
    4. Outside bar area.

    Correction: Nonfood-contact surfaces of equipment shall be cleaned at a frequency necessary to preclude accumulation of soil residues. The presence of food debris or dirt on nonfood contact surfaces may provide a suitable environment for the growth of microorganisms which employees may inadvertently transfer to food. If these areas are not kept clean, they may also provide harborage for insects, rodents, and other pests.

    Observation: The floors and walls throughout facility need cleaning.
    Correction: Physical facilities shall be cleaned as often as necessary to keep them clean.     Observation: Observed knife stored between equipment (equipment soiled).
    Correction: During pauses in food preparation or dispensing, food preparation and dispensing utensils shall be stored: (A) In the food with their handles above the top of the food and the container
  • Critical: Time/Temperature Control for Safety Food, Cold Holding
    Observation: The following foods were observed cold holding at improper temperatures:
    1. Turkey 46-54 F, ham 54 F, cut tomatoes 54 F, cheese 52 F, sour cream 55 F, sausage 54 F all in the 4 drawer prep unit on left.
    2. Cheese 50 F, cut tomatoes 51 F, cheese 54 stored in prep unit (middle)
    3. All foods cold holding in the 4 drawer prep unit (top portion) observed cold holding at 50 to 52 F.
    4. Cheese observed at 48 F Bev Air 1 door refrigerator.

    The cabinets at the waitstation and the shelving used for]bar glasses are no longer easily cleanable and in need of repair and/or replacement.

    Correction: Equipment shall be maintained in a state of repair and condition that meets the requirements specified under Parts 4-1 [Materials for Construction and Repair] and 4-2 [Design and Construction]. Proper maintenance of equipment to manufacturer specifications helps ensure that it will continue to operate as designed.     Observation: Food preparation and dispensing utensils are improperly stored. 1. Ice scoop handle observed in contact with ice used for consumption at the bar. 2. A container of lemons was observed in direct contact with ice used for consumption.

Working containers are frequently used to convey these materials to areas where they will be used, resulting in working containers being stored in different locations in the establishment. Identification of these containers with the common name of the material helps prevent the dangerous misuse of the contents.
