Bacterial growth and/or toxin production can occur if time/temperature control for safety food remains in the temperature "Danger Zone" of 5ºC to 57ºC (41ºF to 135ºF) too long. Up to a point, the rate of growth increases with an increase in temperature within this zone. Beyond the upper limit of the optimal temperature range for a particular organism, the rate of growth decreases. The consumer advisory statement was observed on the menu. The Summit and True 1-Door preparation units were observe cold holding at 41 F or below.

Facility uses a prepackaged smoked salmon product. The packing on the salmon product reads that it was farm raised pellet fed. Recommend not storing any TCS food product in the Summit Refrigeration unit until it is properly cold holding at 41 F or below. If unit does not hold at 41 F or below then discontinue storing TCS product in that unit. A recheck will be conducted in approximately 10 days.

    Observation: Container of milk in the "Summit" small reach in refrigerator observed cold holding at the improper temperature (43 F - 44 F). Product relocated to additional refrigeration.

Requirements and restrictions regarding floor coverings, utility lines, and floor/wall junctures are intended to ensure that regular and effective cleaning is possible and that insect and rodent harborage is minimized.

1. Single service knives are not properly dispensed to prevent contamination (all handles are not facing one direction).
2. Mouse droppings were observed on the floors and lower shelving throughout the establishment.
3. The mop sink is missing it's cold water handle.
4. The coffee cup dispensers are missing their lids/caps.

    Correction: A food employee may drink from a closed beverage container if the container is handled to prevent contamination of: (1) The employee's hands

    Observation: (REPEAT): Cut lettuce, sliced tomatoes, and shredded cheese are cold holding at the improper temperatures of 46-60 F inside and in the top portion of the "Cooltech" three door prep refrigerator. The thermometer inside the unit was reading 36 F, which I believe is incorrect, because I found the thermostat at 45 F and the food temperatures were 46-60 F. The unit thermostat was adjusted to 36 F and I recommended that the manager place the top lid back on the unit.
    Correction: Except during preparation, cooking, or cooling, or when time is used as the public health control as specified under section 3-501.19, and except as specified under paragraph (B) of this section, time/temperature control for safety food shall be maintained at 5ºC (41ºF) or less. Requirements and restrictions regarding floor coverings, utility lines, and floor/wall junctures are intended to ensure that regular and effective cleaning is possible and that insect and rodent harborage is minimized.

    Observation: (REPEAT): The light intensity is below 20 foot candles inside the kitchen area sliding glass door refrigerator. Some ceiling lights are also out above the three compartment sink.
    Correction: The light intensity shall be at least 215 lux (20 foot candles): (1) At a surface where food is provided for consumer self-service such as buffets and salad bars or where fresh produce or packaged foods are sold or offered for consumption, (2) Inside equipment such as reach-in and under-counter refrigerators

    Observation: There are damaged wall tiles by the three compartment sink and handsink. There are gaps in-between the wood 2 x 4's and the floor behind the prep refrigerators. There are gaps in the wood shelving at the coffee station. There are gaps in-between the 2 x 4's and the underside of the counter-top to the left of the grill.
    Correction: Physical facilities shall be maintained in good repair. Poor repair and maintenance compromises the functionality of the physical facilities. This requirement is intended to ensure that the physical facilities are properly maintained in order serve their intended purpose.
  • Cleaning, Frequency and Restrictions
    Observation: The floors are not cleaned as often as necessary to keep them clean.
    Correction: Physical facilities shall be cleaned as often as necessary to keep them clean. Cleaning of the physical facilities is an important measure in ensuring the protection and sanitary preparation of food. A regular cleaning schedule should be established and followed to maintain the facility in a clean and sanitary manner.

    Observation: Restricted use pesticides do not meet the requirements in 40 CFR 152. "Raid" roach foggers and "Ortho" home defense pesticides were found in the establishment. They were discarded. Only licensed pest control applicators can apply pesticides in a retail food establishment. These home pesticides are not allowed.
    Correction: Restricted use pesticides specified under paragraph 7-202.12(C) shall meet the requirements specified in 40 CFR 152 Subpart I - Classification of Pesticides.

1. Ensure all refrigerators have thermometers and that they are maintaining foods at 41 F or below.
2. Remind employees not to wear bracelets while preparing food.
3. Eliminate mouse and cockroach harborage in the facility. Mouse droppings were observed on the floor near the slicer. Dead roaches were observed in the glue board.
4. Seal up and holes, cracks, and crevices in the walls, floors, and ceiling.
5. Keep wiping cloths in a sanitizing solution.
6. Shield the light above the microwave.

    Observation: Ready-to-eat food is not protected from cross contamination by separating them from raw animal foods (Box of mushrooms found stored in the walk-in refrigerator under a carton tray of raw shell eggs). The tray of eggs was relocated below the vegetables.
    Correction: Food shall be protected from cross contamination by separating raw animal foods during storage, preparation, holding, and display from: (a) Raw ready-to-eat food including other raw animal food such as fish for sushi or molluscan shellfish, or other raw ready-to-eat food such as fruits and vegetables, and (b) Cooked ready-to-eat food.

    Observation: Cut lettuce and egg salad in the top portion of the "Cooltech" three door prep refrigerator cold holding at the improper temperatures of 46-52 F. The unit thermostat was found set at 46 F, it was adjusted to 36 F. Cut melon in a fruit salad container located in the counter-top display case refrigerator found at 44 F. Relocate or adjust the unit setting to be colder.
    Correction: Except during preparation, cooking, or cooling, or when time is used as the public health control as specified under section 3-501.19, and except as specified under paragraph (B) of this section, Potentially Hazardous Food (Time/Temperature Control for Safety Food) shall be maintained at 5ºC (41ºF) or less. Bacterial growth and/or toxin production can occur if potentially hazardous food (time/temperature control for safety food) remains in the temperature "Danger Zone" of 5ºC to 57ºC (41ºF to 135ºF) too long. Up to a point, the rate of growth increases with an increase in temperature within this zone. Beyond the upper limit of the optimal temperature range for a particular organism, the rate of growth decreases. Equipment that is easily cleaned minimizes the presence of pathogenic organisms, moisture, and debris and deters the attraction of rodents and insects.
