The purpose of today's visit was to conduct a risk factor assessment inspection. EHS discussed with CFM/owner the use of time as a public health control at the grill station and recommended pre-chilling salad bar items to 41F prior to placing at salad bar and/or verifying whether item has properly cooled to 41F within four hours of preparation.
  • Critical: Time as a Public Health Control/ Up to 4 Hours for Cold & Hot PHF(TCS) / Requirements (corrected on site) (repeated violation)
    Observation: The following food item(s) for which time rather than temperature is used as a control is not marked or otherwise identified to indicate the time that is 4 hours past the point in time when the food is removed from temperature control:------------raw shell eggs, raw liquid eggs, sausage, cooked potatoes and shredded cheese mix at the grill station.
    Correction: If time only, rather than time in accordance with temperature control, up to a maximum of 4 hours, is used as the public health control the food shall: 1) have an initial temperature of 41°F or less if removed from cold holding temperature OR 135°F or above if removed from hot holding temperature control, 2) be marked or otherwise identified to indicate the time that is 4 hours past the point in time when the food is removed from temperature control, 3) be cooked and served, served if ready-to-eat, or discarded within 4 hours from the point in time when the food is removed from temperature control, and 4) be discarded if unmarked or marked to exceed a 4 hour limit. The purpose of today's visit was to conduct a routine inspection. Observed facility clean and organized. EHS provided CFM with and discussed handouts on the following topics: Employee Health, time as a public health control and sample menu with complete consumer advisory (as future reference)
  • Critical: Responsibility of PIC to Require Food Employees to Report GI Symptoms or Cuts, Disease, Medical Condition or Exposure to PIC (corrected on site) (repeated violation)
    Observation: Upon discussion with the person-in-charge, one or more of the elements of an effective employee health policy is either missing or incomplete. A complete employee health policy is required to be in place at the food establishment. At the time of this inspection, the Health Department provided and reviewed handouts and resource information in a red folder labeled "Employee Health Policy.
    Correction: A complete employee health policy must have the following elements:
    1) Employee training on foodborne illness, particularly symptoms of illness and prevention of the Big Five illnesses (see "What is Foodborne Illness" handout)
  • Utensils That are In-Use / Between-Use Storage (corrected on site)
    Observation: Dispensing and/or in-use utensils improperly stored between use as follows:------rice scoop observed stored in still room temperature water (76F).
    Correction: During pauses in food preparation or dispensing, food utensils shall be stored in one of the following manners: 1) in the food with their handles above the top of the food and the container, 2) in food that is not potentially hazardous (time/temperature control for safe food) with their handles above the top of the food within containers or equipment that can be closed, 3) on a clean portion of the food preparation table or cooking equipment only if the in-use utensil and the food contact surface of the food preparation table or cooking equipment are cleaned and sanitized, 4) in running water of sufficient velocity to flush particulates to the drain, 5) in a clean, protected location if the utensils are used only with a food that is NOT potentially hazardous (time/temperature control for safe food), or 6) in a container of water if the water is maintained at a temperature of at least 135°F and the container is cleaned frequently. RICE SCOOP CHANGED AND PLACED IN HOT WATER ABOVE 135F.

    Observation: Surfaces of ice bins and enclosed components of equipment are observed in need of cleaning.
    Correction: Surfaces of utensils and equipment contacting food that is NOT potentially hazardous (time/temperature control for safety food) such as ice bins, beverage dispensing nozzles, and enclosed components of equipment such as ice makers, cooking oil storage tanks and distribution lines, beverage and syrup dispensing lines or tubes, coffee bean grinders, and water vending equipment at a frequency specified by the manufacturer or at a frequency necessary to preclude accumulation of soil or mold.

    Observation: The certified food manager is not properly monitoring sanitizing procedures at the 3-compartment sink. An employee was observed washing and rinsing in one compartment and sanitizing at the middle compartment and the third compartment is left empty.
    Correction: The certified food manager must train and monitor employees for proper operation of the 3-compartment sink to ensure that utensils are sanitized accordingly preventing recontamination of utensils

    Observation: Employees are not properly sanitizing cleaned multiuse equipment and utensils.
    Correction: The Person in Charge or certified food manager shall train his/her employees to properly sanitize all equipment, utensils, and surfaces after being cleaned using either an approved sanitizer at the adequate concentration or heat sanitization at the proper temperature to destroy pathogenic bacteria.

    Observation: Employees are not properly trained in food safety as it relates to their assigned duties. The warewashing employee was not properly trained to operate the 3-compartment sink.
    Correction: The Person in Charge or certified food manager shall train all his/her employees in food safety as it relates to their assigned duties. Train employee on how to properly operate the 3-compartment sink. Utensils should be washed-Rinsed-Sanitized each time.
  • Critical: Food Protection from Contamination / Separate Raw from RTE (corrected on site)
    Observation: Raw animal food stored over ready-to-eat food in the refrigeration unit. Raw meat, raw chicken and raw seafood were found stored above cooked foods, vegetables and ready-to-eat food in the walk-in refrigerator.
    Correction: Raw foods like poultry, beef, pork, seafood, and eggs shall be stored properly inside refrigerators and freezers to prevent cross contamination. Raw foods shall be stored on shelving units BELOW or SEPARATED from all cooked foods, commercially processed foods, washed produce, leftover foods, etc.
  • Critical: Date Marking of Refrigerated, Ready-to-Eat PHF (TCS Food) (corrected on site) (repeated violation)
    Observation: The following refrigerated, ready-to-eat, potentially hazardous food that is prepared on site is not used or discarded within 24 hours of preparation and was not observed to be date marked: Cooked chicken and other cooked items noted in the walk-in refrigerator without date marking.
    Correction: Refrigerated, ready-to-eat, potentially hazardous foods that are prepared on site and kept for more than 24 hours cannot have a shelf-life of more than 7 days, including the day of preparation. These food items must be marked with either the "consume-by" date and/or "preparation" date, color-coded labels, or another marking system/method that effectively indicates shelf-life that is clearly understood and properly used by the employees.
  • Food-Contact Surface in Contact with Non-PHF(TCS) Cleaned Any Time after Contamination (corrected on site)
    Observation: Surfaces of the can opener blade were observed soiled with accumulations of grime and debris.
    Correction: Surfaces of utensils and equipment contacting food that is NOT potentially hazardous (time/temperature control for safety food) shall be cleaned at any time when contamination may have occurred. Clean the can opener at least once every 24 hours to prevent contamination of food.
  • Critical: Food-Contact Surface Sanitized before Use after Cleaning (corrected on site)
    Observation: The food-contact surfaces of utensils cleaned at the 3-compartment sink were not observed sanitized. The 3-compartment sink was not set up properly to Wash, Rinse, and Sanitize utensils.
    Correction: All utensils and food-contact surfaces of equipment shall be sanitized before use and after cleaning. Utensils and equipment must be sanitized after wash and rinse.

    Observation: Uncovered food containers were noted in the walk-in and reach-in refrigerators subjecting the food to contamination:
    Correction: Foods shall be protected from contamination by being stored in packages, covered containers or wrappings unless being cooled.
  • Food Storage Containers, Identified with Common Name of Food (corrected on site)
    Observation: Unlabeled food containers with the following food items that are not easily identified by appearance: sauces, corn flour, gravy, etc.
    Correction: ALL food and ingredients removed from their original container and stored in other food containers, squeeze bottles or "shakers" shall be labeled properly using the common name of the food (if the food or ingredient is not easily distinguished). For example, all cooking oils, salt, sugar, flour, starch, spices, herbs, etc. shall be labeled.
  • Ice Used as Exterior Coolant, Prohibited as Ingredient (corrected on site)
    Observation: Ice used as a medium for cooling the exterior surfaces of food is also for beverage ice or used as food. Food in plastic bags were stored directly on the use that is being used for beverage at the bar.
    Correction: After use as a medium for cooling the exterior surfaces of food, packaged foods, beverages, or cooling coils/tubes, the ice may not be used as food. Place the food in refrigerated units or on ice baths to cold hold. Do not place any food on the ice that is intended for customers' drinks. (Ice discarded)
  • Wiping Cloths/Use Limitation/Wet Towel Storage (corrected on site)
    Observation: Wet wiping cloths used for wiping counters and other equipment surfaces were observed stored on the counter.
    Correction: Wet wiping cloths are to be used for wiping counters and other equipment surfaces and are to be held in a chemical sanitizer solution at the appropriate concentration between uses.

    Observation: The following food item(s) were observed cold holding at improper temperatures using a calibrated food temperature measuring device:cream cheese =55-F, vegetable cream cheese = 54-F,

    Observation: Manufacturer containers of feta cheese and tofu were observed reused for the storage of other foods.
    Correction: Manufacturer containers may not be reused for secondary storage of other foods because the containers are not durable enough for multiple reuse and become uncleanable.

The Health Department has been notified that settlement on a change of ownership will occur on June 3, 2013. This inspection was conducted to facilitate the issuance of a Health Department Permit to Operate during the change of ownership at this establishment. At the time of this inspection, the establishment is in compliance with Chapter 43.1, Fairfax County Food Code. The current permit is not transferable. In order for a Permit to Operate to be issued after settlement, please contact Ron Campbell, Environmental Health Specialist III, at 703-246-8427. A first routine inspection will be conducted approximately 30 days after the Permit to Operate is issued. All items listed out of compliance must be corrected by the time of the first routine inspection.
Note the following recommendations:
It is recommended that more than one person on staff be a Certified Food Manager. A Certified Food Manager must be on the premises during ALL food preparation and service.
Recommendation is made to have exhaust hood cleaned at least every six months. Maintain records of hood cleaning for Health Department review. Hood was cleaned in December 2012.
Recommendation is made to clean hood filters at least every two weeks.
It is recommended that the grease trap be cleaned at least every two months. Maintain records of grease trap cleaning for Health Department review.
It is recommended that a monthly pest control program be implemented. Maintain records of pest control treatments for Health Department review.

  • Physical Facilities Good Repair (repeated violation)
    Observation: Caulk is damaged and mildewed along the back of the three vat sink.
    Correction: Remove old caulk and apply new caulk along back edge of 3 vat sink.

  • Equipment / Good Repair / Operation
    Observation: The 3DR prep refrigerator is not maintaining 41F ambient air temperature.
    Correction: Do not use the refrigerator. Service the refrigerator. All refrigerators must maintain 41F or less ambient air temperature.
  • Mop Sink / Numbers and Capacities
    Observation: The mop sink is completely unusable. The faucet is missing.
    Correction: Repair or replace the mop sink. There must be a functional mop sink - hot and cold water available for use for cleaning the facility.
  • Critical: Direct Connection Not Allowed / Backflow Prevention Required/ 3-Vat Sink & Food Equipment
    Observation: There is a direct connection from the wash and rinse sinks to the sewer line going through the grease trap. An air break is required at the wash and rinse drain lines.
    Correction: Install an air break on the wash and rinse drain lines leading to the grease trap.
  • Physical Facilities Good Repair
    Observation: 1) The wall behind the slicer, adjacent to the kitchen handsink, has leftover adhesive on it. The wall is no longer smooth and cleanable.
    2) The caulk along the back of the 3 vat sink in the kitchen is damaged and mildewed.

    Correction: 1) Remove the adhesive to make the wall smooth and easier to clean.
    2) Remove the old caulk and re-caulk along the back of the 3 vat sink.
