The purpose of this visit was to conduct a risk factor assessment.
Cold-holding temperatures were reviewed with the person in charge and staff during today's visit. Three-door prep cooler was observed initially holding at 47F. Manager indicated that the cooler is emptied and shut off each night when foods are moved to the walk-in cooler. Ensure prep coolers are capable of maintaining foods at 41F (or below) prior to using them to hold potentially hazardous foods. Do not double-pan food items (such as sliced tomatoes) on the prep coolers. This prevents foods from properly cold-holding.

    Observation: The following food items were observed cold holding at improper temperatures using a calibrated food temperature measuring device: Sliced tomatoes at 49F in 3DR prep cooler.
    Correction: Potentially hazardous foods (time/temperature conrol for safety food) shall be held cold at a temperature of 41°F or below. Sliced tomoatoes had been sliced at 11:30 per manager and were moved to the walk-in cooler to cold-hold at 41F or below.

The purpose of today's visit is to conduct a follow-up inspection, to verify that the dish washing machine is sanitizing and presence of Certified food manager.
The machine is sanitizing at 200 ppm, satisfactory. (Discussed that it should not exceed 200 ppm).
Recommend getting one more person get a certified food manager card.

  • Temp Meas Devices for Ambient Air Location
    Observation: The temperature measuring device in the following mechanically refrigerated unit was not properly located in the warmest part of the unit: prep refrigerators.
    Correction: In a mechanically refrigerated unit the sensor of a temperature measuring device shall be located to measure the air temperature of a simulated product temperature in the warmest part of the refrigerator. Store the thermometer near the door of the unit.
  • Equipment / Good Repair / Components / Gaskets
    Observation: The door gaskets of the following unit is damaged: Leader 2 prep refrigerator.
    Correction: Equipment components such as doors, seals, hinges, fasteners, and kick plates shall be kept intact, tight, and adjusted in accordance with manufacturer's specifications.
  • Physical Facilities Good Repair (repeated violation)
    Observation: Observed that the ceiling tile near the kitchen entrance/close to dish washing machine is damaged.
    Correction: Repair the physical facilities. Poor repair and maintenance compromises the functionality of the physical facilities.
06/29/2015Follow-up
A follow-up inspection will be conducted within 10 days to assess if the dish machine is sanitizing and to verify presence of CFM presence. Per the manager they will replace the sanitizer this evening. Please continue to use 3-vat sink for sanitizing food contact surfaces. If the dish machine does not sanitize after refilling the sanitizer please call a technician to fix the machine and fax an invoice to my attention.
Note:
1) The facility provides hookah and smoking is allowed on the enclosed patio. Please remember no ash trays in the dining area inside.
2) The facility has not sold any shellfish in the past 3 months. They do bring shellfish sometimes.
REMINDERS and RECOMMENDATIONS:
1) The facility is open for The Health Department (inspections) if the employees are preparing food/cooking/preparing meats or cleaning food contact surfaces after the facility is closed for business.

CERTIFIED FOOD MANAGER
A CFM must be onsite at ALL times of preparation and hours of operation. It is unlawful to operate an establishment unless under the direct supervision of a CFM. The CFM has many responsibilities, one of which is to make sure that food is being prepared and served safely to prevent foodborne illness. The lack of a CFM is grounds for closure.
** It is recommended that more than one person on staff be a Certified Food Manager. A Certified Food Manager must be on the premises during ALL food preparation and service.
3) Please use test strips to check if the dish machine is sanitizing once a week.
4) Please make sure that the can opener is cleaned before and after use (treat it like knife). If it is not used, please cover and put it aside.
5) Recommend checking cold holding/hot holding temperatures at least 2 times a day and maintain a log.

  • Critical: Eating, Drinking, or Tobacco Use / Proper Food Employee Drinking Containers (corrected on site)
    Observation: A food handler was observed drinking from an uncovered beverage container while in the kitchen.
    Correction: Food employees may drink only from a covered container using a straw.
  • Critical: Date Marking of Refrigerated, Ready-to-Eat PHF (TCS Food) (corrected on site)
    Observation: The following refrigerated, ready-to-eat, potentially hazardous food that is prepared on site is not used or discarded within 24 hours of preparation and was not observed to be date marked: cooked pasta in walk-in refg.
    Correction: Refrigerated, ready-to-eat, potentially hazardous foods that are prepared on site and kept for more than 24 hours cannot have a shelf-life of more than 7 days, including the day of preparation. These food items must be marked with either the "consume-by" date and/or "preparation" date, color-coded labels, or another marking system/method that effectively indicates shelf-life that is clearly understood and properly used by the employees.
  • Wood, Use Limitation (corrected on site)
    Observation: Wood or wood wicker is used in contact with food. Observed wooden mortar and pastel at bar area. (used for drinks).
    Correction: Wood and wood wicker may not be used as a food-contact surface unless the wood is hard maple or close-grained and used for cutting boards, cutting blocks, bakers' tables, and utensils such as rolling pins, doughnut dowels, salad bowls, and chopsticks. Note: Discarded.

    Observation: The door gaskets of the following unit is damaged: Leader 2 prep refrigerator.
    Correction: Equipment components such as doors, seals, hinges, fasteners, and kick plates shall be kept intact, tight, and adjusted in accordance with manufacturer's specifications.
  • Critical: Chlorine Sanitizer Solution Concentration based on pH and Water Temp (corrected on site) (repeated violation)
    Observation: When tested, the low temperature, chemical sanitizing warewashing machine was observed with a sanitizing rinse concentration of less than 50 ppm chlorine solution. Observed at 0 ppm. The sanitizer container was empty.
    Correction: Immediately discontinue use of the dishmachine. Until the machine is adequately repaired, set up the three-compartment sink to manually wash, rinse and sanitize food-contact surfaces using a sanitizing solution at the proper concentration of at least 50 to 100 ppm total chlorine. Note: The manager set up sanitizing sink and ordered new sanitizer.
  • Clean Ice Bins, Beverage Dispenser Nozzles, Etc. per Manufacturer Specs. (corrected on site)
    Observation: Inner surfaces of ice machine has pink mold on the metal surface.
    Correction: Surfaces of utensils and equipment contacting food that is NOT potentially hazardous (time/temperature control for safety food) such as ice bins, beverage dispensing nozzles, and enclosed components of equipment such as ice makers, cooking oil storage tanks and distribution lines, beverage and syrup dispensing lines or tubes, coffee bean grinders, and water vending equipment at a frequency specified by the manufacturer or at a frequency necessary to preclude accumulation of soil or mold.
  • Equip/Utensils/Linens/Single-Service/Original Package
    Observation: Coffee filters were observed stored unprotected above the shelf in kitchen.
    Correction: Single-service items shall be stored in a clean, dry location that is not exposed to splash, dust, or other contamination and at least 6 inches off the floor on approved shelving units or dunnage racks. In addition, the single-service items shall be kept in the original protective package or stored by using other means that afford protection from contamination until used.
  • Critical: Certified Food Manager/Presence Required (corrected on site)
    Observation: There is no Certified Food Manager present at the beginning of the inspection.
    Correction: It shall be unlawful to operate a food establishment unless it is under the immediate control of a certified food manager. It is highly suggested that you have more than one employee with the food manager's license. ORS Interactive, Inc. (see handout provided) issues the required photo identification card with proof of successful completion of a certified food manager's exam. Failure to have a certified food manager on site during ALL hours of operation including food preparation, food service, and cleaning/sanitizing of equipment/utensils will result in closure of the establishment. Note: The CFM arrived at 12:10 pm.

    Observation: A food employee failed to wash his or her hands before engaging in food preparation, after touching bare human body parts, after coughing, sneezing, eating, after handling soiled utensils, or after engaging in any activity that could contaminate the hands. DURING INSPECTION NO ONE WASHED HANDS AND A FOOD SERVICE WORKER DID NOT WASH HANDS BEFORE PUTTING ON NEW GLOVES.
    Correction: ALL food employees shall wash their hands OFTEN especially after handling trash, using the restroom, handling raw meats, handling soiled equipment and utensils, BEFORE putting on clean gloves, etc. Proper handwashing frequencies will aid in the reduction of foodborne illness.
